St. Lucie Village Annexations -- 2002-09/ 20002-10 and 2002-11
As requested, I have looked over the three (3) annexations by the St. Lucie Village and had
them mapped collectively to try and verify compliance with the requirements of Chapter 171,
Florida Statutes. These annexations are being processed as "voluntary annexations" into the
Village. In reviewing the requirements of Section 171.044, Florida Statues, and as I read this
Section, there is nothing in here that relieves the Village from the report requirements of Section
171,042 or the character tests required under Section 171 .043, Florida Statutes.
In the case of these three (3) annexations, I am not aware of a report being filed with us, or the
Village for that matter, pursuant to Section 171.042, Florida Statutes, Again, as I read the
requirements of Section 171,043, a voluntary annexation does not relive the CityNillage of this
report requirement.
As to the character of the area being annexed, all of the properties involved are developed in
one manner or another. There is a bowling alley on one site, a boat sales center on another
and a mini-storage facility on the third. There may be some vacant areas on these sites, but I
believe that they generally meet the definition of "Urban in Character" and "Urban Purposes" as
setout in Chapter 171, Florida Statutes. Prior annexations in this area has apparently resulted
in the creation of an enclave area to the east of these specific parcels (see attached map),
however the specific annexations that I have been asked to comment on do not appear to
create an "enclave" area as defined under Chapter 171, Florida Statutes. These parcels
appear to be generally consistent with the definition of "Compactness," except that I believe
that they are coming close to creating a "finger pattern" of annexation unless the Village starts to
backfill towards Old Dixie Highway.
At this point, given the small acreage associated with this annexation, the fact that the Village
really provides no urban or community services to any of their incorporated area other than
building inspections and permitting, I do not see any purpose in filing an action against the
Village challenging this annexation. However, I do think that we need to send a letter to the
Village advising them that they apparently have/ are violating the standards and requirements of
Section 171.042 and 171,044(5) Florida Statutes and it also appears that they are coming close
to violating the provisions of Section 171.043(1), Florida Statutes.
