LUCIE COUNTY INTERNATIONAL AIRPORT, FOR THE DEVELOPMENT OF A 75 FOOT X 4,000 FOOT RUNWAY AND TAXIWAY SYSTEM ALLOWING AIRCRAFT TO TAKE-OFF AND LAND FROM THE EAST AND WEST WHILE ADDING CAPACITY AND ENHANCING THE SAFETY OF THE EAST I WEST AIRPORT APPROACH ZONES. THE NEW RUNWAY WILL REDUCE THE AMOUNT OF TRAINING TRAFFIC OVER ST. LUCIE VILLAGE. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. The Airport Director presented an application for a Major Adjustment to an existing Conditional Use approval on 105 acres for the development of a 75 foot by 4,000 foot runway and taxiway system located at the St. Lucie County International Airport, the general location being north of St. Lucie Boulevard, east of Taylor Dairy Road, south of Indrio Road, and west of 251h Street. 2. The Development Review Committee has reviewed the application for the Major Adjustment to the existing Conditional Use and found it to meet all technical requirements and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 3. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety, and general welfare. 4. All reasonable steps have been taken to minimize any adverse effect on the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 5. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 6 The project site will be served by the Ft. Pursuant to Section 11.02.04(A) and 11.07.05(E)(2)(b) of the St. Lucie County Land Development Code, the Major Adjustment to the existing Conditional Use for the development of a runway and taxiway at the St. Lucie County International Airport, is hereby approved as depicted on the site plan drawings for the project prepared by Post, Buckley, Schuh & Jernigan, Inc., dated August 2006, last revised August, 2006, and date stamped received by the St. Lucie County Growth Management Director on November 14, 2006, subject to the following conditions: A condition of approval of the Major Adjustment to the existing Conditional Use shall be, prior to the Final Major Site Plan approval; 1. A condition of approval shall be that the applicant provides an existing vegetation survey to the County's Environmental Resource Department (ERD) for review. 2. A condition of approval shall be that the applicant provides a protected species management plan to the County's ERD for review. 3. A condition of approval shall be that the applicant provides a Phasing Plan to the County for review. 4. A condition of approval shall be that the applicant provides an updated Scrub- jay survey performed onsite and the results forwarded to the County's ERD for review. 5. A condition of approval shall be that the applicant provides an updated Audubon crested caracara survey performed onsite and the results forwarded to the County's ERD for review. 6. A condition of approval shall be that the applicant provides the Standard Protection measures and monitoring report for the Eastern indigo snake to the County's ERD for review. 7. A condition of approval shall be that the applicant provides a copy of the tortoise relocation permit application, including maps of proposed recipient area(s), and permit approval documentation from the Florida Fish and Wildlife Conservation Commission (FWC), to the County's ERD for review. 8. A condition of approval shall be that the applicant shall indicate that the wetlands and their upland buffers be clearly labeled on the revised site plan and should be included in the preserve areas covered by the Airport Layout Plan (or Conservation Easement) and Preserve Area Management Plan. 9. A condition of approval shall be that the wetlands and other surface waters be delineated on the Boundary survey with course and distance data and tied to the property lines and acreage indicated. 11. A condition of approval shall be that the applicant consult with the South Florida Water Management District and the U.S. Army Corps of Engineers (ACOE) for verification of the Environmental Consultant's wetland evaluation, and submit all correspondence with applicable jurisdictional agencies regarding wetland and other surface water delineation, allowed impacts, and required mitigation. 12. A condition of approval shall be that prior to the approval of a SLC Vegetation Removal Permit that ACOE has verified and agreed on the proposed wetland boundaries and avoidance/mitigation measures as shown on the approved site plan. 13. A condition of approval shall be that the applicant place all wetland mitigation and protected species areas under conservation easement (or other protection standards acceptable to the Federal, State, and County agencies and departments) for protection in perpetuity. 14. A condition of approval shall be that the applicant ensure that habitat preserve areas have a "Preserve Area Management and Monitoring Plan" (PAMP) approved by the County. The PAMP shall be recorded in the public records of the County and shall at a minimum identify the area covered by the plan, its ownership, and assignment of management and maintenance responsibility, as outlined under ERD DRC comment number 16(a). 15. A condition of approval shall be that the applicant provides a Tree Survey and Tree Mitigation Plan to the County ERD for review. 16. A condition of approval shall be that the applicant address the DRC comments and provide the necessary documents to complete the application (as stated within the attached DRC comments), prior to Final Major Site Plan approval. B. The property on which this conditional use approval is being granted is described as follows: A PARCEL OF LAND LYING IN AND BEING A PART OF SECTION 24, TOWNSHIP 34 SOUTH AND RANGE 39 EAST, ST. LUCIE COUNTY, FLORIDA, BEING MORE PARTICULARLY DESCRIBED AS: PARCEL 46 THE NORTHEAST 'I. OF THE SOUTHWEST 'I. This Major Adjustment to an existing Conditional Use approval shall expire on January 16, 2008, unless an extension is granted in accordance with Section 11.07.05(F), St. Lucie County Land Development Code or Final Site Plan Approval has been granted. D. The Major Adjustment to an existing Conditional Use approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, the Airport Director, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, including but not limited to: the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. E. The conditions set forth in Part A are an integral non-severable part of the conditional use approval granted by this Resolution. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the conditional use approval granted by this Resolution shall become null and void. F. A copy of this Resolution shall be attached to the existing conditional use and site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director. G. A copy of this Resolution shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. H. This Resolution shall be recorded in the Public Records of St. Lucie County.
