LUCIE COUNTY, FLORIDA, TO PERMIT A MAJOR ADJUSTMENT TO THE AIRPORT CONDITIONAL USE SITE PLAN AFFECTING APPROXIMATELY 2.17 ACRES OF LAND INSIDE THE ST, LUCIE COUNTY AIRPORT AT THE INTERSECTION OF TAXIWAY DELTA AND TAXIWAY ALPHA, APPROXIMATELY 240 FEET NORTHWEST OF THE END OF INDUSTRIAL AVENUE 3, TO PERMIT A 8,327 SQ. FT. BUILDING 35 FEET IN HEIGHT TO HOUSE AN AIRPORT RESCUE AND FIREFIGHTING FACILITY WITH AN ACCESSORY 125 FOOT HIGH COMMUNICATIONS TOWER. THIS FACILITY WILL REPLACE THE EXISTING FIRE STATION AT THE AIRPORT. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. The Airport Director presented an application for a Major Adjustment to an existing Conditional Use site plan approval to permit an 8,327 square foot building, 35 ft. in height, to house an Airport Rescue and Firefighting Facility with an accessory 125 ft. communications tower on 2.17 acres located at the St. Lucie County International Airport, the general location being north of St. Lucie Boulevard, east of Taylor Dairy Road, south of Indrio Road, and west of 25th Street. 2. The Development Review Committee has reviewed the application for the Major Adjustment to the existing Conditional Use site plan and found it to meet all technical requirements and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 3. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety, and general welfare. 4. All reasonable steps have been taken to minimize any adverse effect on the proposed project on the immediate vicinity through building design, site design, landscaping and screening. EDWIN M. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations, 6. The project site will be served by the Ft. Pierce Utility Authority. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.07.05(E)(2)(b) and 11.02.07 of the St. Lucie County Land Development Code, the Major Adjustment to the existing Conditional Use site plan for the development of an 8,327 square foot building, 35 ft. in height, to house an Airport Rescue and Firefighting Facility with an accessory 125 ft. communications, is hereby approved as depicted on the site plan drawings for the project prepared by Kimley-Horn and Associates, Inc. last revised on September 7, 2006, and date stamped received by the St. Lucie County Growth Management Director on September 13, 2006, subject to the following conditions: 1. Prior to issuance of a Vegetation Removal Permit for the ARFF station, the applicant must provide ERD with an after-the-fact Vegetation Removal Permit and associated fees for the ditch relocation activities. 2. Prior to issuance of a Vegetation Removal Permit, the applicant must provide a revised Landscape Plan, including the minimum sizes and quantities of native landscaping trees. 3. The revised Airport Layout Plan and Master Plan shall incorporate preservation of the approximately 12-acre site on the airport's eastern edge as mitigation for the prior ditch relocation activities and the future ARFF site clearing activities. B. The Major Adjustment to an existing Conditional Use site plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, the Airport Director, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, including but not limited to: the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. E. The conditions set forth in Part A are an integral non-severable part of the conditional use approval granted by this Resolution, If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the conditional use approval granted by this Resolution shall become null and void, F. A copy of this Resolution shall be attached to the existing conditional use site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director. G. A copy of this Resolution shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications.
