A RESOLUTION PROVIDING FOR A 12-MONTH EXTENSION OF
THE FINAL PLANNED UNIT DEVELOPMENT KNOWN AS
CELEBRATION POINTE - PUD CONSISTING OF 318 SINGLE-
FAMILY LOTS, 292 SINGLE-STORY VILLAS, AND 145 TWO-
STORY TOWNHOUSES FOR A TOTAL OF 755 UNITS FOR 147.14
ACRES OF LAND LOCATED AT THE SOUTHEAST CORNER OF
THE INTERSECTION OF SOUTH JENKINS ROAD AND
PETERSON ROAD
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations
1. On January 18, 2005, this Board, through Resolution 05-008, granted Final Planned Unit
Development approval for the project known as Celebration Pointe - PUD, a proposed
755 unit project consisting of 318 single-family lots, 292 single-story villas, and 145 two-
story townhouses on 147.14 acres of property located at the southeast corner of the
intersection of South Jenkins Road and Peterson Road.
2. The developer of Celebration Pointe - PUD has requested that the 12-month extension of
the Final Planned Unit Development through Resolution No. 05-008, be extended for a
period of 12 additional months from its date of scheduled expiration, January 18, 2007,
with the new date of expiration being January 18, 2008.
3. The developer of Celebration Pointe - PUD has requested revisions to the conditions of
approval and the addition of one condition.
4. On February 20,2007, the St. Lucie County Board of County Commissioners held a public
hearing, of which due public notice was published and mailed to all property owners within
500 feet at least 10 days prior to the hearing. That meeting was continued to the March 6,
2007, Board of County Commissioners meeting.
5. On March 6, 2007, the public hearing on this item was heard.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. Pursuant to Section 11.02.06(B)(2) of the St. Lucie County Land Development Code, the
Planned Unit Development, approved through Resolution 05-008, is hereby extended for a

B.
Condition #1 cited within the resolution has been revised as follows:
1. The developer shall convey to SI. Lucie County, in manner and form acceptable to the
County Attorney, 45 feet of additional right of way for Peterson Road along the North
property line of the subject property. Twelve (12) months from the recording of this
resolution or the recording of the Road Improvement Agreement, whichever occurs earlier,
the developer shall construct Peterson Road to County specifications to include pedestrian
and bicycle paths.
C.
Additional Conditions #8, 9, 10, 11, 12, 13, 14, 15, and 16 read as follows:
8. Pursuant to Section 11.03.01 (C) of the SI. Lucie County Land Development Code, the
developer, his successors or assigns, shall be allowed a building permit for up to a
maximum of four (4) residential units to be issued after approval of a Preliminary Record
Plat and construction plans, but before approval of a Final Plat.
9. The single-family homes proposed for location on the northern property limits of the subject
property adjacent to Peterson Road shall be limited to a maximum height of one-story. The
Final Plat for the project shall provide a note thatthese homes shall not exceed one story.
10. Water truck will be onsite and shall be used as needed.
11. The applicant shall be in compliance with the National Pollutant Discharge and Elimination
Service (NPDES) permit and shall implement Best Management Practices for a
sedimentation control program and follow it daily.
12. The developer shall provide an enhanced landscaping plan and a berm along Peterson
Road. The plan shall be designed by a registered landscape architect. The enhanced
landscaping plan shall be reviewed with the neighbors and shall exceed the SI. Lucie
County's landscaping codes in terms of number of trees and height of trees and shall be
agendaed for Board consideration within 60 days from the date of this resolution.
13. No access to the project shall be permitted from the Swain Road extension.
14. The developer shall complete the perimeter wall around the property on Swain Road within
60 days from the issuance of the building permit from SI. Lucie County.
15. The hours of operation for construction activities shall be limited to the time period from
7:00 A.M. to 5:30 P.M., Monday through Friday, 7:00 A.M to 1:00 P.M. Saturday, and no
work on Sundays. No construction shall take place on Federal Holidays. The hours of
operation restrictions do not apply to sales activities. The hours of operation shall be
clearly posted on the subject property in a conspicuous location for viewing by the public.

16. Any additional infraction shall implement an immediate Stop Work Order and be referred to
the Board of County Commissioners for action.
D. This Final Planned Unit Development extension shall expire on January 18, 2008, unless
building permits are issued or another extension has been granted in accordance with
Section 11.02.06, St. Lucie County Land Development Code.
E. The Certificate of Capacity granted by the Growth Management Director shall remain valid
until January 18, 2008.
F. The SI. Lucie County Growth Management Director is hereby authorized and directed to
cause the notation of this resolution to be made on the Official Zoning Map of SI. Lucie
County, Florida, and to make notation of reference to the date of adoption of this resolution.
G. A copy of this resolution shall be placed on file with the SI. Lucie County Growth
Management Director.
