WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site plan approval submitted by Land Planning Systems, Inc., reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Land Planninq Systems, Inc., has applied for minor site plan approval for the project to be known as One Acre Woods Subdivision located on the west side of Johnston Road, approximately 1,000 feet north of Angle Road, consisting of 8 single-family lots located in the AG-1 (Agricultural- 1 du/ac) Zoning District and described in Part B. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet minimum technical requirements of the St. Lucie County Land Development Code and to be consistent with the future land use maps from the St. Lucie County Comprehensive Plan. 3. The proposed project is consistent with the general purpose, goals, objectives and standards of review of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The proposed project will be served by adequate public facilities and services. 8. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the site plan for the project to be known as One Acre Woods Subdivision, is hereby approved as depicted on the site plan drawings for the project prepared by Land Planning Systems, Inc., a copy of which is attached as Exhibit 8, dated July 11 2005, last revised October 12, 2006, and date stamped received by the St. Lucie County Growth Management Director on October 20, 2006, for the following described property below, subject to the following conditions: 1. Prior to the recording of any Final Plats of One Acre Woods project, the developer, his successors or assigns, shall pay Road Impact Fees to St. Lucie County in the amount of $2,616.00 per single-family lot. The developer, his successors or assigns, shall not be responsible for any additional Road Impact Fee payments to St. Lucie County. Should the Board of County Commissioners approve a Road Impact Fee adjustment more than or less than the agreed to payment schedule described above, the above described schedule shall apply. 2. The Final Plat for the One Acre Woods Subdivision shall not be recorded until constructible engineering plans are approved, and all common improvements are either: a) built and accepted or approved by St. Lucie County; or b) appropriate security is provided to St. Lucie County in a form approved by the County Attorney and an amount approved by the County Engineer, including an amount necessary to cover the period of maintenance required by the Land Development Code. 3. No construction Development Permits shall be issued by the County until complete sets of sealed constructible final engineering plans, supporting calculations and survey data for all site work and offsite improvements are submitted to the County and approved by the Public Works Department, Utilities Department, Environmental Resources Department, Growth Management Department, St. Lucie County Fire District, and any other agency or County Department that may be determined by the Director of Growth Management to be necessarily involved in the review and approval of the constructible final engineering plans for the site work and offsite improvements, The determination of whether or not plans submitted by the applicant constitute a complete set of constructible plans shall be made by the departments involved in the plan review within five business days of the date the plans are received in the Department of Growth Management. 4. A condition of approval shall be that the developer provide a copy of the Vegetation Protection and Preservation Plan (outlining preserve area allowed, prohibited, and recommended activities within the preserve areas) and the plat (identifying the preserve area locations) to the purchaser of each lot of the One Acre Woods subdivision. 5. Prior to issuance of any building permits or vegetation removal permits for any portion of the One Acre Woods site, the developers, their successor or assigns, shall submit to St. Lucie County an executed and recorded copy of the File No.: MJSP-05-020 April 2, 2007 GM Order No. 07-007 Page 2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 52 53 54 conservation easement, made in favor to St. Lucie County, covering the preserve areas on this site, At a minimum, the documents shall include: signed draft conservation easement, site plans or map of conservation easement areas, and legal description and number of acres of conservation easement. 6. Prior to issuance of any vegetation removal permits for the portions of the One Acre Woods site that the developer has identified as "neutral" (Building and Drive) in the tree mitigation proposal, the developers, their successor or assigns, shall submit to St. Lucie County a mitigation plan detailing how any approved vegetation removal activities in these "neutral" areas will be mitigated. Trees already used by the developer to meet mitigation (Le.; trees within preserve areas or planted by the developer) shall not be able to be used by future homeowners to satisfy any mitigation that will result from clearing of trees to build their homes and related improvements, 7. As part of the application for vegetation removal at the One Acre Woods site, a detailed Tree Protection Plan showing where tree barricades will be placed, what the grade changes will be around the trees to be preserved, which methods are proposed to be employed to ensure the trees will not die as a result of increased grade changes (Le.; drain tiles, etc), who will be responsible for implementing the plan, shall be required to be submitted to St. Lucie County. 8. Prior to issuance of any building permits or vegetation removal permits for any portion of the One Acre Woods site, the developers, their successor or assigns, shall clearly delineate all areas to be preserved and/or protected per the approved site plan. Delineation shall be by either the placing of silt fencing, safety fencing or similar type of materials. Flagging shall not be used except to guide the installation of the fencing materials. All land clearing activities shall be in accordance to the specific conditions/standards outlined in the Vegetation Removal Permit. Prior to issuance of any building permits or vegetation removal permits, the St. Lucie County Environmental Resources Department shall inspect the installed fencing. 9. Prior to issuance of any building permits or vegetation removal permits for any portion of the One Acre Woods site, the developers, their successor or assigns, shall conduct a pre-clearing meeting with the applicant's environmental consultant, the land clearing contractors, and St. Lucie county Environmental Resources Department staff to discuss vegetation protection guidelines during construction. At a minimum, the following conditions will be placed on the Vegetation Removal Permit: A tree protection plan, identifying tree and vegetation protection methods proposed be given to the site contractor(s) to work from. A conspicuous, suitable protective barrier (highly visible so that equipment operators can see the limits of permitted construction activity) shall be placed and maintained around the perimeter of the protected area to form a continuous unbroken boundary, around individual protected trees at a minimum distance of ten (10) feet from the radius of the dripline from all protected trees prior to the commencement of onsite construction activities. Protective barriers shall remain in place until issuance of a certificate of occupancy. In the event that any protective barriers are removed or altered all land clearing and site alteration work will be stopped until the barriers are restored and any necessary corrective actions taken to repair or replant any vegetation removed or damaged as a result of these File No.: MJSP-05-020 April 2, 2007 GM Order No. 07-007 Page 3 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 B. 25 26 27 28 29 30 31 32 C. 33 34 35 36 D. 37 38 39 40 41 42 43 44 45 E. 46 47 48 49 50 51 52 encroachments. The entire vegetation preservation area shall be maintained in its natural state so as not to alter the water and oxygen content of the soil and impair its natural function. No grade changes or excavation of any sort may be made within the barricaded areas. If underground utilities must be routed through a protected root zone area, tunneling under the roots shall be required. Irrigation shall be installed outside of the dripline of all protected trees. No soil shall be removed from within a vegetation preservation area. No fill material, construction material, concrete, paint, chemicals, or other foreign materials shall be stored, deposited or disposed of within a vegetation preservation area. No signs, permits, wires, or other attachments shall be affixed or attached to protected vegetation. No equipment, including passenger vehicles, shall be driven, parked, or stored or repaired within designated vegetation preservation areas. Please be advised that trees destroyed due to construction damage are required to be mitigated for at a ratio of 4:1. 10. The hours of operation for construction activities shall be limited to the time period from 7:00 A.M. to 5:30 P.M" Monday through Friday, 7:00 A.M. to 1 :00 P.M. Saturday and no work on Sundays. No construction shall take place on Federal Holidays. The hours of operation restrictions do not apply to sales activities, In the event the County adopts uniform hours of operation for construction activities that apply county wide, then such hours of operation shall supersede the hours of operation set forth herein. The property on which this Minor Site Plan is being approved is described as follows: 343439 N 1/2 OF N 1/2 OF SW 1/4 OF SE 1/4-LESS E 40 FT- (9,83 AC) (OR 2217-2258; 2278- 2086) (Property Tax I.D. #: 1334-431-0001-000/0) (Location: West side of Johnston Road, approximately 1,000 feet north of Angle Road.) The site plan shall expire on April 2, 2009, unless a building permit is issued or a site plan extension is granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, NIC Development, including any successors in interest, shall obtain all necessary development permits and construction authorizations form the appropriate State and Federal regulatory authorities, including but not limited to: the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Section A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(8), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the S1. Lucie County Growth Management Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. G. This order shall be recorded in the Public Records of S1. Lucie County. The certificate of capacity exemption, attached as Exhibit A, shall be valid for the same period as this order.
