WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site plan approval submitted by SWS Engineering, Inc., reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Treasure Coast Food Bank, has applied for minor site plan approval for the project to be known as Treasure Coast Food Bank located at 3051 Industrial 25th Street in the IL (Industrial, Light) Zoning District. The project consists of the addition of 10,251 square feet to an existing 8,989 square foot facility for a total of 19,240 square feet of space. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet minimum technical requirements of the St. Lucie County Land Development Code and to be consistent with the future land use maps from the St. Lucie County Comprehensive Plan. 3. The proposed project is consistent with the general purpose, goals, objectives and standards of review of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The proposed project will be served by adequate public facilities and services. 8. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Pursuant to Section 11.02.05 of the SI. Lucie County Land Development Code, the site plan for the project to be known as Treasure Coast Food Bank, is hereby approved as depicted on the site plan drawings for the project prepared by SWS Engineering, Inc., a copy of which is attached as Exhibit B, dated December 12, 2005, and date stamped received by the SI. Lucie County Growth Management Director on December 7, 2006, for the property described below, subject to the following conditions: 1. Prior to issuance of a SLC Vegetation Removal Permit, the applicant must provide a Conservation Easement (CE) and a Preserve Area Management and Monitoring Plan (PAMP) to SLC for our review and approval. The Conservation Easement shall be dedicated to, or made in favor of, the County, per Policies 8.1.4.13 and 8.1.12.8 of the Conservation Element of the St. Lucie County Comprehensive Plan. Please provide the following information in order to process the conservation easement: 1) signed draft conservation easement, 2) site plans or map of conservation easement areas, and 3) legal description and number of acres of conservation easement. The PAMP, at a minimum, should specify restrictions on any encroachment into the Preserve Areas as well as restrictions on vegetation removal outside the building pad areas. The plan should also include: a. Language which notifies property owners that the property includes upland preservation areas which are protected under conservation easements; b. Language which informs the property owners that the upland preserve areas may not be altered from their naturall permitted condition with the exception of exotic vegetation removal or restoration; and c. Language addressing exotic removal in all preserves, silt fencing and protection barricades during construction, proposed monitoring program, proposed replanting plan of native vegetation in any impacted areas, signage for preserve area boundaries, explanation of who will be responsible for future maintenance, etc. 2. Prior to issuance of a SLC Vegetation Removal Permit, the South Florida Water Management District's Water Use Division shall be contacted to determine if a water use permit will be required for the irrigation activities. 3. Prior to issuance of a SLC Vegetation Removal Permit, the applicant must obtain a Gopher Tortoise Relocation Permit from the Florida Fish and Wildlife Conservation Commission (FWC). The relocation area must be covered by a Conservation Easement and Preserve Area Management Plan approved by SLC. Copies of all relevant correspondence with FWC shall be provided to SLC. 4. Prior to issuance of a SLC Vegetation Removal Permit, a pre-clearing meeting shall be conducted with the clearing contractors to provide educational materials (poster & pamphlets) to inform them of the protocol that shall be followed should a Florida scrub jay be encountered. If a Florida scrub jay is encountered during site construction, all work shall be halted and the FWS shall be contacted for further guidance. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, Treasure Coast Food Bank, including any successors in interest, shall obtain all necessary development permits and construction authorizations form the appropriate State and Federal regulatory authorities, including but not limited to: the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. This Order shall become effective upon the date of approval indicated below. Should the property owner, developer or authorized agent wish to appeal any condition described in Section A above, all such appeals must be filed in writing with the County Administrator within 30 days of the rendering of this Order, as described in Section 11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order be filed, no permitting reviews or further administrative action shall take place on the processing of this development project until the appeal is resolved. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. G. This order shall be recorded in the Public Records of St. Lucie County. The certificate of capacity exemption, attached as Exhibit A, shall be valid for the same period as this order.
