A RESOLUTION GRANTING A CONDITIONAL USE PERMIT
TO ALLOW THE OPERATION OF A CONCRETE BLOCK
MANUFACTURING PLANT IN THE IH (INDUSTRIAL, HEAVY)
ZONING DISTRICT LOCATED IN THE MIDWAY INDUSTRIAL
PARK; AND ESTABLISHING AN EXPIRATION DATE FOR THE
CONDITIONAL USE.
WHEREAS, the Board of County Commissioners ofSt Lucie county, Florida, based
on the testimony and evidence, including but not limited to the staff report, has made
the following determinations:
1. Ft. Pierce #4, presented an application for a Conditional Use Permit to allow
the operation of a concrete block rnanufacturing plant in the IH (Industrial,
Heavy) zoning district
2. The Development Review Committee has reviewed the proposed Conditional
Use and found it to meet all technical requirements and to be consistent with the
Future Land Use Maps of the St Lucie County Comprehensive Plan.
3. On march 15,2007, the St Lucie County Planning and Zoning Commission, by
a vote of five to one, recommended approval of the petition with a condition
limiting the hours of operation.

5. The proposed Conditional Use is consistent with the general purpose, goals,
objectives and standards of the St Lucie County Land Development Code, the
St Lucie County Comprehensive Plan, and the Code of Ordinances of St Lucie
County, Florida.
6. The proposed Conditional Use will not have an undue adverse effect on
adjacent property, the character ofthe neighborhood, traffic conditions, parking,
utility facilities, or other matters affecting the public health, safety and general
welfare.
7. All reasonable steps have been taken to minimize any adverse effect of the
proposed Conditional Use on the immediate vicinity through building design,
site design, landscaping and screening.
8. The proposed project will be constructed, arranged and operated so as not to
interfere with the development and use of neighboring property, in accordance
with applicable district regulations.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Comrnissioners
of St Lucie County, Florida:
A. Pursuant to Section 11.07.00 of the St Lucie County Land Development Code,
the Conditional Use Permit to allow the operation of a Concrete Block
Manufacturing Plant in Phase III of the Midway Industrial Park, is hereby
approved as depicted on the site plan drawings for the project prepared by
Corzo Castella Carballo Thornpson Salman, P.A., dated 03/28/06, and date
stamped received by the St Lucie County Growth Management Director on
04/06/06, for the property described in Section B.
B. The property on which this Site Plan approval is being granted is described as
follows:
LOT 13 OF THE PLAT OF "MIDWAY INDUSTRIAL
PARK- PHASE III-SOUTH", ACCORDING TO THE
PLAT THEREOF AS RECORDED IN PLAT BOOK
45 AT PAGE 40, PUBLIC RECORDS OF SAINT
LUCIE COUNTY, FLORIDA.
SAID LOT CONTAINING 323787 SQUARE FEET OR
7.433 ACRES MORE OR LESS.
C. This Conditional Use Permit is issued subject to compliance with the following
conditions:
1. Hours of operation shall be limited to between 5:00 AM and 10:00 PM.
2. Prior to approval of a St Lucie County Notice of Vegetation Rernoval, the
applicant must have performed the required caracara nesting tree survey surveys
and provided the survey results to the St Lucie County Environmental Resources
Department U. S. Fish and Wildlife Service staff have indicated that an
acceptable survey methodology on this site, given its size and surroundings,
would be to spend two days during caracara nesting season surveying the cabbage
palms on-site for evidence of nesting activity. If caracaras are using any of
cabbage palms on-site for nesting, additional consultation with the U. S. Fish and
Wildlife Service and the St Lucie County Environrnental Resources Department
will be req ui red.
3. Prior to approval of a St Lucie County Notice of Vegetation Removal
Application, an Eastern Indigo Snake protection/education/plan shall be provided
to the St Lucie County Environmental Resources Department for review and
approval. The approved protection/education plan must then be implement3ed
prior to initiation of on site clearing.
4. Prior to approval of a Notice of Vegetation Removal, the applicant must
provide the S1. Lucie County Environmental Resources Department with a
Conservation Easement and Declaration of Restrictive Covenants for review. All
conservation easements and environmental dedications shall include a
requirement that S1. Lucie County must approve any release, in part or total, of
any portion of any conservation easement or dedication, as required by the
Midway Road Industrial Park Development Order.
5. Prior to approval of a S1. Lucie County Notice of Vegetation Removal, the
applicant must provide the S1. Lucie County Environmental Resources
Department with documentation trom the South Florida Water Management
District indicating that they have approved the applicant's permit modification
and that sufficient water quality pretreatment has been provided on-site.
6. Prior to approval of a S1. Lucie County Notice of Vegetation Removal, the
applicant must provide the S1. Lucie County Environmental Resources
Department with an executed (signed) copy of the conservation easement
document for the pre-treatment pond and its upland buffer, including a map
showing the area covered. Also, within sixty (60) days of issuance of a permit a
recorded copy of the Conservation Easement will be required to be submitted.
7. Prior to approval of a S1. Lucie County Notice of Vegetation Removal, the
applicant must provide the S1. Lucie County Environmental Resources
Department with a final Preserve Area Monitoring and Management Plan
(P AMP) and documentation indicating the P AMP has been recorded in the public
records of S1. Lucie County.
8. Prior to approval of a Notice of Vegetation Removal, the applicant shaH
provide the S1. Lucie County Environmental Resources Department with final
construction drawings showing the exact placement and type of barricades to be
used and a note stating that the barricades shaH be in place around trees and
vegetation to be preserved prior to site clearing. The Code of Ordinance of S1.
Lucie County, Florida, require that conspicuous, durable barricades be erected
around each individual tree or areas of vegetation that are to be preserved.
D. This Conditional Use Permit for the Ft. Pierce #4 Block Plant shall expire on
April 18, 2008 unless a building permit or certificate of zoning compliance is
secured.
