AN ORDER GRANTING MINOR SITE PLAN APPROVAL
FOR THE PROJECT TO BE KNOWN AS PINO CAR
WASH.
WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for
site plan approval submitted by EDC, Inc., reviewed the comments of the St. Lucie County
Development Review Committee on this application, and made the following determinations:
1. Robert Pino, has applied for minor site plan approval for the project to be known as
Pi no Car Wash located on the south side of Orange Avenue, approximately 420 feet
east of North Jenkins Road. The project consists of a 3,303 square foot car wash
facility and a 6,000 square foot office building for a total of 9,303 square feet of space.
2. The Development Review Committee has reviewed the site plan for the proposed
project and found it to meet minimum technical requirements of the St. Lucie County
Land Development Code and to be consistent with the future land use maps from the
St. Lucie County Comprehensive Plan.
3. The proposed project is consistent with the general purpose, goals, objectives and
standards of review of the St. Lucie County Land Development Code, the St. Lucie
County Comprehensive Plan, and the Code of Ordinances of St. Lucie County.
4. The proposed project will not have an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other
matters affecting the public health, safety and general welfare.
5. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
6. The proposed project will be constructed, arranged and operated so as not to interfere
with the development and use of neighboring property, in accordance with applicable
district regulations.
7. The proposed project will be served by adequate public facilities and services.
8. The applicant has applied for and received a certificate of capacity, a copy of which is
attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land
Development Code.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the site
plan for the project to be known as Treasure Coast Food Bank, is hereby approved as

depicted on the site plan drawings for the project prepared by EDC, Inc., a copy of which
is attached as Exhibit ß, dated February 19, 2007, and date stamped received by the 51.
Lucie County Growth Management Director on February 26, 2007, for the property
described below, subject to the following conditions:
1. Prior to the issuance of any building permits, the developer, his successor or
assigns shall provide written documentation from the Florida Department of
Transportation (FDOT) regarding their determination for additional right-of-way
for this segment of Orange Avenue.
2. Prior to issuance of any building permits or vegetation removal permits for any
portion of the Pinot Car Wash site, the developers, their successor or assigns,
shall submit to St. Lucie County Environmental Resources Department a plan
that outlines tree and vegetation protection methods proposed and that this
plan, once approved, is included in the set of construction drawings that are
given to the site contractor(s) to work from. At a minimum, the plan should
show placement and type of barricades to be used and a note stating that the
barricades shall be in place around trees and vegetation to be preserved prior
to site clearing. St. Lucie County code requires that conspicuous, durable
barricades be erected around each individual tree or areas of vegetation that
are to be preserved. At a minimum, barricades should be placed at the dripline
of a tree. In the event that any protective barricades are removed or altered
and land clearing or construction work is being conducted on the site, all work
at the site will be stopped until the barriers are restored and ERD staff shall be
immediately contacted to determine if any necessary corrective actions taken
to repair or replant any vegetation removed or damaged as a result of these
encroachments. Please be advised that trees destroyed due to construction
damage are required to be mitigated for at a ratio of 4:1:
3. The applicant has responded that the site plan only addresses the design of
the project at the planning level and that elevations and vertical design of the
site are developed in the Construction Plan development phase, after site plan
approval. Prior to issuance of any building permits or vegetation removal
permits for any portion of the Pinot Car Wash site, the developers, their
successor or assigns, shall submit to St. Lucie County Environmental
Resources Department a plan that outlines tree and vegetation protection
methods proposed and that this plan, once approved, is included in the set of
construction drawings that are given to the site contractor(s) to work from. At
a minimum, the plan should include existing site grades, proposed site grades,
and specific plans for preservation areas around trees (within the dripline area
of the tree). Should it be necessary to raise the grade around the tree
preservation island, we recommend transitional sloping of the raised grade to
the natural grade, or tree wells around the outer edges of the driplines, with
drain tiles or something similar to ensure that water will not pond around the
roots of the trees.
4. Prior to issuance of any building permits or vegetation removal permits for any
portion of the Pinot Car Wash site, the developers, their successor or assigns,
shall submit to St. Lucie County Environmental Resources Department a plan
that outlines tree and vegetation protection methods proposed and that this
plan, once approved, is included in the set of construction drawings that are
given to the site contractor(s) to work from. At a minimum, the plan should
include plans and methodologies for protection of existing native understory
under the trees, within the dripline areas and the removal of any undesirable

plants within the dripline areas (specifically requiring hand removal and proper
treatment (I.e.: no soil disturbance by pulling out by the roots, and no use of
heavy machinery)), as well as notes specifying that nothing may be stored,
parked, placed, or disposed of within the dripline areas, supplemental irrigation
for the trees will be necessary, any tree pruning for clearance during
construction must be performed by a qualified arborist and not by construction
personnel, etc and explanation on how the applicant proposes to implement
these guidelines throughout the site construction phases.
B. The property on which this Minor Site Plan is being approved is described as follows:
THE EAST 240 FEET OF THE NORTH Y, OF THE NORTHWEST V. OF THE NORTHWEST
V. OF THE SOUTHWEST V. , LESS THE NORTH 46.50 FEET OF SECTION 8, TOWNSHIP
35 SOUTH, RANGE40 EAST. ST. LUCIE COUNTY, FLORIDA.
CONTAINING 68,130 SQUARE FEET OR 1.564 ACRES, MORE OR LESS. (PROPERTY
TAX I.D. #: 2408-322-0001-000/4)
(Location: South side of Orange Avenue, approximately 420 feet east of North
Jenkins Road.)
C. The site plan shall expire on May 22, 2009, unless a building permit is issued or a site
plan extension is granted in accordance with Section 11.02.06, St. Lucie County Land
Development Code.
D. The Final Site Plan approval granted under this resolution is specifically conditioned to
the requirement that the petitioner, Robert Pino, including any successors in interest,
shall obtain all necessary development permits and construction authorizations form the
appropriate State and Federal regulatory authorities, including but not limited to: the
United States Army Corps of Engineers, the Florida Department of Environmental
Protection, and the South Florida Water Management District, prior to the issuance of
any local building permits of authorizations to commence development activities on the
property described in Part B.
E. This Order shall become effective upon the date of approval indicated below. Should
the property owner, developer or authorized agent wish to appeal any condition
described in Section A above, all such appeals must be filed in writing with the County
Administrator within 30 days of the rendering of this Order, as described in Section
11.02.03(B), St. Lucie County Land Development Code. Should an appeal to this Order
be filed, no permitting reviews or further administrative action shall take place on the
processing of this development project until the appeal is resolved.
F. A copy of this Order shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Growth Management
Director and mailed, return receipt requested to the developer and agent of record as
identified on the site plan applications.
G. This order shall be recorded in the Public Records of St. Lucie County. The certificate of
capacity exemption, attached as Exhibit A, shall be valid for the same period as this
order. If this order expires or otherwise terminates, the certificate of capacity exemption
shall automaticallt terminate.
