FRY, Jr., CLERK OF THE CIRCUIT COURT - SAINT LUCIE COUNTY .E # 2614529 OR BOOK 2230 PAGE 265, Recorded 05/03/2005 at 10:03 AM RESOLUTION 05-029 FILE NO.: MJSP-Q4-oo2 A RESOLUTION DENYING MAJOR SITE PLAN APPROVAL FOR THE PROJECT TO BE KNOWN AS EMERSON COMMERCIAL CENTER WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. Glassman Holdin9s. LLC. applied for major site plan approval for the 185,388 square foot retail project to be known as Emerson Commercial Center for property located at the northwest corner of the intersection of Emerson Avenue and Indrio Road in the CG (Commercial, General) Zoning District for the property described in Part A below. 2. On April 5, 2005, this Board conducted a Regular Hearing on the petition and continued that hearing to April 19, 2005. 3. Based on the evidence presented in the applicant's traffic impact study, the proposed project will not be served by adequate public facilities and services. NOW. THEREFORE. BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the site plan for the project known as Emerson Commercial Center, is hereby deniedas shown on the site plan drawings for the project prepared by Gentile Holloway O'Mahoney and Associates, Inc., dated, April 13, 2005, and date stamped received by the St. Lucie County Growth Management Director on April 13, 2005, for the property described as follows: SECTION 15, TOWNSHIP 34, RANGE 39, THE SOUTH 830 FEET OF THE EAST 1,550 FEET Of THE SOUTH t Of NORTHEAST 1/4 LESS EAST 80 FEET AND LESS SOUTH 60 FEET fOR ROAD AND CANAL RIGHT-Of-WAY. (TAX ID#: 1315-131-00oo-000/0) (Location: Northwest corner of the intersection of Emerson Avenue and Indrio Road.) B. A copy of this resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director. C. A copy of this resolution shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. dOOK 2230 PAGE 266 D. This resolution shall be recorded in the Public Records of St. Lucie County.
