LUCIE COUNTY, FLORIDA, GRANTING A 12 MONTH EXTENSION OF THE DATE OF EXPIRATION FOR THE PRELIMINARY AND FINAL PLANNED UNIT DEVELOPMENT SITE PLAN APPROVAL ON 103.642 ACRES (MORE OR LESS) OF LAND LOCATED ON THE SOUTH SIDE OF ORANGE AVENUE, APPROXIMATELY 865 FEET WEST OF KINGS HIGHWAY, FOR THE DEVELOPMENT OF 531 TOTAL DWELLING UNITS FOR THE PROJECT KNOWN AS HAWK'S RESERVE - PUD. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. On November 29,2005, this Board, through Resolution 05-391, granted Preliminary and Final Planned Unit Development approval for the project known as Hawk's Reserve - PUD, proposed for 103.642 acres of land located on the south side of Orange Avenue, approximately 865 feet west of Kings Highway and consisting of 531 total dwelling units- 165 single-family lots, 126 villa units, and 240 townhouse units. 2. The developer of Hawk's Reserve - PUD has requested that the Preliminary and Final Planned Unit Development granted through Resolution 05-391, be extended for a period of 12 additional months from its date of scheduled expiration, November 29,2007, with the new date of expiration being November 29, 2008. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.06(B)(2) of the St. Lucie County Land Development Code, the Planned Unit Development, approved through Resolution 05-391, is hereby extended for a period of 12 additional months from its scheduled date of expiration November 29,2007, with the new expiration date being November 29, 2008, for the property described as follows: PARCEL NO.1: THE NORTHEAST 1/4 OF THE SOUTHEAST 1/4 OF SECTION 11, TOWNSHIP 35 SOUTH, RANGE 39 EAST LESS AND EXCEPTING THEREFROM ALL RIGHTS OF WAY FOR PUBLIC ROADS AND DRAINAGE CANALS. This Resolution shall not take effect until Condition #2 referenced in Resolution 66=594 in regard to the Road Contribution Agreement concerning the improvements to the intersection of Kings Highway and Orange Avenue are met. If the Agreement is not entered into by November 29,2007, this Resolution granting a 12-month extension shall become null and void. C. This Preliminary and Final Planned Unit Development extension shall expire on November 29, 2008, unless building permits are issued or another extension has been granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. D. The Certificate of Capacity granted by the Growth Management Director shall remain valid until November 29, 2008 upon this Resolution becoming effective. E. The St. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution. F. A copy of this resolution shall be placed on file with the St. Lucie County Growth Management Director.
