LUCIE COUNTY INTERNATIONAL AIRPORT, FOR THE DEVELOPMENT OF A 75 FOOT X 4,000 FOOT FLIGHT TRAINING RUNWAY AND PARALLEL TAXIWAY SYSTEM ALLOWING AIRCRAFT TO TAKE-OFF AND LAND FROM THE EAST AND WEST WHILE ADDING CAPACITY AND ENHANCING THE SAFETY OF THE EAST I WEST AIRPORT APPROACH ZONES. RESOLUTION NO. 07-133 FILE NO.: MJSP # 2320071089 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. The Airport Director presented an application for Major Site Plan approval on 105 acres located at the St. Lucie County International Airport for the development of a 75 foot by 4,000 foot training runway and parallel taxiway system, the general location being north of St. Lucie Boulevard, east of Taylor Dairy Road, south of Indrio Road, and west of 25th Street. 2. The Development Review Committee has reviewed the application for the Major Site Plan and found it to meet all technical requirements and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Comprehensive Plan and St. Lucie County Land Development Code. 3. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety, and general welfare. 4. All reasonable steps have been taken to minimize any adverse effect on the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 5. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of 5t. Lucie County, Florida: A. Pursuant to Sections 11.02.09, "Submittals for Minor and Major Site Plans" and 11.02.04, "Review of applications for Major Site Plans", of the St. Lucie County Land July 3, 2007 Page 1 Resolution No. 07-133 File No.: MJSP #2320071089 1 Development Codes, the Major Site Plan for the development of a training runway and parallel 2 taxiway system at the St. Lucie County International Airport, is hereby approved as depicted 3 on the site plan drawings for the project prepared by Post, Buckley, Schuh & Jernigan, Inc., 4 dated March 20,2007, last revised on June 15, 2007, and date stamped received by the St. 5 Lucie County Grow1h Management Director on June 18, 2007, subject to the following 6 conditions: 7 8 1. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 9 successors or assigns, shall provide an existing Vegetation Survey I Tree survey and 10 Tree Mitigation Plan to the County's Environmental Resource Department (ERD) for 11 review. 12 13 2. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 14 successors or assigns, shall provide a FWC-approved tortoise relocation area 15 management plan to the County's ERD. 16 17 3. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 18 successors or assigns, shall provide ERD with documentation from the US Fish and 19 Wildlife Service that they have reviewed the updated Florida scrub jay survey 20 information and have concurred that the proposed project will not result in "take" of 21 Florida scrub-jays. 22 23 4. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 24 successors or assigns, shall provide an updated Audubon crested caracara survey 25 performed onsite, if required by the US Fish and Wildlife Service (FWS), and the 26 results forwarded to the County's ERD for review. If it is determined by the FWS that 27 such a survey is not required, correspondence from FWS documenting this 28 determination shall be forwarded to ERD. 29 30 5. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 31 successors or assigns, shall provide the Standard Protection Measures and Monitoring 32 Report for the Eastern indigo snake to the County's ERD for review. 33 34 6. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 35 successors or assigns, shall provide a copy of the Tortoise Relocation Permit approval 36 documentation from the Florida Fish and Wildlife Conservation Commission (FWC), to 37 the County's ERD for review. 38 39 7. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 40 successors or assigns, shall show the location of the delineated wetlands lines and 41 their upland buffers clearly labeled on the revised Site Plan and include the Preserve 42 Areas covered by the Airport Layout Plan (or Conservation Easement) and Preserve 43 Area Management Plan. 44 45 8. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 46 successors or assigns, shall provide a SFWMD-approved wetland mitigation area 47 management plan to the County's ERD. 48 July 3, 2007 Page 2 Resolution No. 07-133 File No.: MJSP #2320071089 1 9. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 2 successors or assigns, shall provide the conservation easement documents for the 3 wetland mitigation area and any other areas required by other regulatory agencies to 4 be placed under conservation easement. 5 6 10. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 7 successors or assigns, shall consult with the South Florida Water Management District 8 and the U.S. Army Corps of Engineers (ACOE) for verification of the Environmental 9 Consultant's wetland evaluation, and submit all correspondence with applicable 10 jurisdictional agencies regarding wetland and other surface water delineation, allowed 11 impacts, and required mitigation. 12 13 11. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 14 successors or assigns, shall place all wetland mitigation and habitat preservation 15 areas under conservation easement or other protection standards (such as protection 16 under the Airport Layout Plan) acceptable to the Federal, State, and County agencies 17 and departments) for protection in perpetuity. Wildlife habitat areas will be managed in 18 accordance with the State and Federal authorizations. 19 20 12. Prior to the issuance of a Vegetation Removal Permit for the project, the developer, his 21 successors or assigns, shall ensure that habitat preserve areas have a "Preserve Area 22 Management and Monitoring Plan" (PAMP) approved by the County. The PAMP shall 23 be recorded in the public records of the County and shall at a minimum identify the 24 area covered by the plan, its ownership, and assignment of management and 25 maintenance responsibility. 26 27 13. Prior to any development performed onsite, the developer, his successors or assigns, 28 shall obtain and provide the County, a copy of the St. Lucie County Stormwater Permit, 29 the modification to the existing South Florida Water Management District 30 Environmental Resource Permit, the Ft. Pierce Farms Water Control District drainage 31 connection permit, and the Ft. Pierce Farms Water Control District canal crossing 32 permit, required for the project. 33 34 14. The proposed project will require that a conservation easement be placed over the 35 project mitigation area. This easement will be maintained in perpetuity. However, the 36 St. Lucie Board of County Commissioners recognize their obligations regarding their 37 grant assurances under the Airport Improvement Program (AlP), specifically that the 38 County needs to take immediate action in correcting or eliminating any hazard to 39 airport operations. This includes mitigation areas that are placed under a conservation 40 easement for the proposed project and associated development. If these areas result 41 in a wildlife hazard to airport operations, the County will take appropriate action to 42 mitigate the hazard in accordance with the respective protection agency requirements. 43 The size of the easement will never change, but boundaries may shift based on air 44 navigation hazards or airport safety requirements. 45 46 15. Any matter required to be performed under the existing ordinances of St. Lucie County 47 shall not be otherwise amended, modified or waived, unless such modification, 48 amendment, or waiver is expressly provided for within this resolution. 49 July 3, 2007 Page 3 Resolution No. 07-133 File No.: MJSP #2320071089 1 16. The developer, his successors or assigns, are not relieved from the responsibility of 2 obtaining the necessary permits required by Federal, State, and Local jurisdictional 3 agencies not mentioned within this resolution. 4 5 B. This Major Site Plan approval shall expire on July 3, 2009, unless an extension is 36 granted in accordance with Section 11.07.05(F), St. Lucie County Land Development Code. 37 38 D. The Major Site Plan approval granted under this Resolution is specifically conditioned 39 to the requirement that the petitioner, the Airport Director, including any successors in interest, 40 shall obtain all necessary development permits and construction authorizations from the 41 appropriate State and Federal regulatory authorities, including but not limited to: the United 42 States Army Corps of Engineers, the Florida Department of Environmental Protection, and the 43 South Florida Water Management District, prior to the issuance of any local building permits of 44 authorizations to commence development activities on the property described in Part B. 45 46 E. The conditions set forth in Part A are an integral non-severable part of the site plan 47 approval granted by this Resolution. F. A copy of this Resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Grow1h Management Director. G. A copy of this Resolution shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. H.
