LUCIE COUNTY, FLORIDA; PROVIDING FOR DETERMINATIONS; PROVIDING FOR APPROVAL SUBJECT TO CONDITIONS; PROVIDED FOR DESCRIPTION OF THE AFFECTED PROPERTY; PROVIDING FOR ENFORCEMENT OF CONDITIONS; AND PROVIDING FOR A RECORD FILE LOCATION. WHEREAS, the SI. Lucie County Growth Management Director has reviewed the application for site plan approval submitted by Culpepper & Terpening, Inc. on behalf of Richard J. Oldfield, reviewed the comments of the SI. Lucie County Development Review Committee on this application, and made the following determinations: 1. EQuestrian Acres is a proposed 6-lot subdivision for 38.01 acres of property located on the southwest comer of the intersection of Shinn Road and Carlton-Adams Road, approximately 1,900 feet north of Okeechobee Road in the AG-5 (Agricultural- 1 du/5 acre) Zoning District. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the SI. Lucie County Comprehensive Plan. 3. The project is consistent with the general purpose, goals, objectives, and standards of the SI. Lucie County Comprehensive Plan and the SI. Lucie County Land Development Code. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect ofthe proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The project is to be served by adequate public facilities and services. 8. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, SI. Lucie County Land Development Code. NOW, THEREFORE, BE IT ORDERED: A. Pursuantto Section 11.02.03 of the 51. Lucie County Land Development Code, the proposed Minor Site Plan to be known as Equestrian Acres, is hereby approved as shown on the site plan drawings for the project prepared by Culpepper and Terpening, Inc., dated stamped received by the SI. As a part of any Final Plat of the proposed project, the petitioner, his successors or assigns, shall conveyor dedicate by plat to St. Lucie County, the east 32 feet of the subject property along Shinn Road and the north 70 of the subject property along Carlton-Adams Road for additional right-of-way. To the extent pennitted under the County's Code and Compiled Laws, any such dedication may be considered eligible for Road Impact Fee Credits. 2. This Development Order shall be recorded in the Public Records of St. Lucie County, Florida. This Development Order shall be recorded in order to provide constructive legal notice of development conditions that run with the land. 3. The Final Plat shall not be recorded until constructible engineering plans are approved, and all public and common improvements, including those items referenced in Condition Number 3, are either: a) built and accepted or approved by St. Lucie County; or b) secured with a developer's surety held by the St. Lucie County in a form approved by the County Attorney and an amount approved by the County Engineer, including an amount necessary to cover the period of maintenance required by the Land Development Code. 4. Pursuant to Section 11.03.02 and 11.04.00 of the St. Lucie County Land Development Code constructible engineering plans shall be submitted to the County Engineer. 5. The County Engineer shall receive a copy of this Development Order and the site plan it approves The County Engineer shall not approve constructible engineering plans or cost estimates that do not implement or are not consistent with this Development Order and the plans hereby approved. 6. Prior to approval of a Notice of Vegetation Removal Application, the applicant must provide ERD with a final plat in which all existing ditches to be retained on-6ite are platted as "Drainage Easement" areas. The removal of any ditches which the applicant does not intend to retain must be properly pennitted thru the applicable wetland jurisdictional agencies, prior to approval of a Notice of Vegetation Removal application. 7. If the internal road/drive will be used to access multiple lots and will be paved, then prior to approval of Notice of Vegetation Removal Application, a plan showing the required vehicular use area landscaping trees must be provided to ERD. 8. Prior to approval of a Notice of Vegetation Removal Application, the applicant must provide ERD with Homeowners' Association documents which include best management practices to protect water quality. These practices can be included by referencing the Florida Yards and Neighborhoods program (FYN) and attaching a copy of the FYN Handbook to the Homeowners' Association documents provided to new residents. The property on which this Minor Site Plan approval is being granted is described as follows: THE NORTHEAST V. OF THE SOUTHWEST V. OF SECTION 31, TOWNSHIP 35 SOUTH, RANGE 39 EAST, ST. LUCIE COUNTY, FLORIDA, SUBJECT TO THE RIGHT-OF-WAY FOR SHINN ROAD (COUNTY ROAD 609-A) OVER AND UPON THE EAST 33 FEET THEREOF, AND FURTHER SUBJECT TO THE RIGHT-OF-WAY FOR NORTH ST. LUCIE RIVER WATER CONTROL DISTRICT CANAL NUMBER 82 OVER AND UPON THE NORTH 43 FEET THEREOF. (TAX ID#: 2331-310-0000-000/5) (Location: Southwest comer of Shinn Road and Carlton-Adams, approximately 2,500 feet north of Okeechobee Road) C. The approvals granted by this administrative order shall expire on July 11, 2009, unless an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. D. The Final Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Richard J. Oldfield, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the SI. Lucie County Growth Management Director and mailed, retum receipt requested to the developer and agent of record as identified on the site plan applications. F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. G. This order shall be recorded in the Public Records of SI. Lucie County.
