A RESOLUTION GRANTING A MINOR ADJUSTMENT TO CHANGE THE
APPLICANT AND AGENT NAME ON AN APPROVED CONDTIONAL USE
PERMIT FOR A SAND MINING OPERATION IN THE AG-S
(AGRICULTURAL - 1 DU/SACRES) ZONING DISTRICT FOR PROPERTY
LOCATED IN ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the St. Lucie County Growth Management Director has reviewed the
application for a minor adjustment to an approved conditional use permit submitted by
Guettler Brothers Construction, LLC, reviewed the comments of the St. Lucie County
Development Review Committee on this application, and made the following
determinations:
1. Guettler Brothers Construction, LLC, presented a petition for a Minor
Adjustment to a Conditional Use Permit to change the applicant and agent
name on the conditional use permit that allows for a sand mining operation
of two borrow pits in the AG-5 (Agricultural - 1 du/5 acres) Zoning District
for the property described in Part B.
2. On June 6, 2006, through Resolution 06-049, the St. Lucie County Board
of County Commissioners approved the petition of Guettler & Sons, LLC
for a Conditional Use Permit to allow for a sand mining operation of two
borrow pits in the AG-5 (Agricultural - 1 unit per 5 acres) Zoning District.
3. The proposed Minor Adjustment to an Approved Conditional Use Permit is
consistent with the goals, objectives, and policies of the St. Lucie County
Comprehensive Plan and has satisfied the requirements of Section
11.07.05(E) of the St. Lucie County Land Development Code.
4. The proposed modification will not have an undue adverse effect on
adjacent property, the character of the neighborhood, traffic conditions,
parking, utility facilities, or other matters affecting the public health, safety
and general welfare.
5. The applicant has received a Certificate of Capacity, a copy of which is
attached to this order as Exhibit "A", as required under Chapter V, St.
Lucie County Land Development Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St.
Lucie County, Florida:

Pursuant to Section 11.07.05(E) of the St. Lucie County Land Development
Code, the request of Guettler Brothers Construction, LLC for a Minor
Adjustment to change the name and agent of an Approval Conditional Use
Permit for a sand mining operation in the AG-5 (Agricultural - 1du/5 acres)
Zoning District is hereby granted for the property described below, subject to
the following condition:
All conditions and obligations set forth in Resolution No. 06-
049 approving the original conditional use permit shall remain
in full force and effect.
The property on which this Conditional Use Adjustment approval is being
granted is described as follows:

of Engineers, the Florida Department of Environmental Protection, and the
South Florida Water Management District, prior to the issuance of any local

building permits of authorizations to commence development activities on the
property described in Part A
D. The St. Lucie County Growth Management Director is hereby authorized and
directed to cause the notation of this resolution to be made on the Official
Zoning Map of St. Lucie County, Florida, and to make notation of reference to
the date of adoption of this resolution.
F. This order shall be recorded in the Public Records of St. Lucie County.
