M-t-ß -x= I Î/1 GVV1 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 GM-07-015 MNSP-06-028 AN ORDER GRANTING APPROVAL FOR A MINOR SITE PLAN TO BE KNOWN AS GENTILE LAND SUBDIVISION CONSISTING OF 3 SINGLE FAMILY LOTS WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site plan approval submitted by Gentile LLC., reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Gentile Land is a proposed 3-lot subdivision for 9.02 acres of property located on the east side of Gentile Road, approximately 1,500 feet north of Okeechobee Road in the AG-2.5 (Agricultural- 1 du/2.5 acre) Zoning District. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet technical requirements of the Land Development Code and to be consistent with the St. Lucie County Comprehensive Plan. 3. The project is consistent with the general purpose, goals, objectives, and standards of the St. Lucie County Comprehensive Plan and the St. Lucie County Land Development Code. 4. The project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The project will be constructed, arranged, and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 7. The project is to be served by adequate public facilities and services. 8. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code, NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Site Plan to be known as Gentile Land, is hereby approved as shown on the site plan drawings for the project prepared by Absolute Surveying, Inc., dated September 14, 2006, and date stamped received by the St. Lucie County Growth Management Department on May 16, 2007, on the property described below, subject to the following conditions: 1. Prior to the Certificate of Occupancy of the first building permit for the proposed project, the developer, his successor or assigns, shall construct a six (6) foot wide sidewalk along the project's frontage on Gentile Road. Pursuant to Section 11.02.08(A)(6) ofthe St. Lucie County Land Development Code, 3 no work shall commence on the site until all regulatory permits required from Federal, State, 4 and regional agencies and special districts have been issued. The Florida Department of 5 Environmental Protection, National Pollutant Discharge and Elimination System compliance 6 notice must be submitted to the County Engineer with the constructible site plan at the time of 7 building permit application or during permit review or no paving, grading, and drainage permit 8 and no building permit shall be issued. All National Pollutant Discharge and Elimination 9 System Best Management Practices shall be instituted on the site prior to site clearing and 10 maintained daily. Stormwater ponds shall be roughed in at the same time the site is cleared 11 of groundcover. 12 13 3. As a part of any Final Plat of the proposed project, the developer, his successors or 14 assigns, shall conveyor dedicate by plat to St. Lucie County, the west 5 feet of the subject 15 property along Gentile Road for additional right-of-way. 16 1 7 4, This Development Order shall be recorded in the Public Records of St. Lucie County, 18 Florida, in order to provide constructive legal notice of development conditions that run with 19 the land. 20 21 5. The Code Compliance Manager shall receive a copy of this Development Order and 22 the site plan it approves and shall not approve any building permits that do not implement or 23 are not consistent with this Development Order and the plans hereby approved. 24 25 6. Prior to approval of a Notice of Vegetation Removal, the applicant shall provide an 26 Eastern Indigo Snake Protection Plan, Adherent to FWS standards. The plan should be 27 followed during all site clearing and construction activities. 28 29 7. Prior to approval of the Notice of Vegetation Removal, a revised PAMP, 30 Conservation Easement documents, and revised site plans should be provided, each clearly 31 delineating the preserve areas. Preserve areas shall include the wetland pond and an 32 associated 50-foot wide buffer, as well as the borrow area and its 1 O-foot wide upland buffer. 33 34 8. Prior to approval of the Notice of Vegetation Removal, the following additional details 35 shall be incorporated into the PAMP; show the locations and types of silt fencing and 36 protection barricades to be used during construction; and provide locations and design of 37 proposed signs for preserve area boundaries. 38 39 9. Prior to approval of the Notice of Vegetation Removal Application, a Conservation 40 Easement covering the wetland and, borrow area, and associated upland buffers shall be 41 provided. The following information shall be provided in order to process the conservation 42 easement: 1) signed draft conservation easement, 2) site plans or map of conservation 43 easement areas, and 3) legal description and number of acres of conservation easement. 44 Please note that prior to the issuance of a Vegetation Removal Permit, an executed (signed) 45 copy of the easement document must be provided. Also, within 60 days of issuance of a 46 permit a recorded copy of the easement document will be required to be submitted. 47 48 10. Prior to approval of a Notice of Vegetation Removal, the applicant shall provide a 4 9 copy of the Homeowners Association guidelines (Homeowners/Property Owners Association 50 or Declaration of Covanence documents) for review. At a minimum the documents shall include: a. Language which notifies prospective property owners that the association property includes preserve areas which are protected under conservation easements; b. Language which informs the prospective property owners that the preserve areas may not be altered from their natural/permitted condition with the exception of: exotic vegetation removal, or restoration in accordance with the restoration plan included in the conservation easement; c. Language by which the homeowner's association accepts, the responsibility for perpetual maintenance of the conservation easement and agrees to take action against lot owners as necessary to enforce the conditions of the easement; and d. Notification of property owners of any mitigation/monitoring and/or financial assurances for which the association is responsible. The approvals granted by this administrative order shall expire on August 15, 2009, unless an extension is granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. C. The Final Site Plan approval granted under this Resolution is specifically conditioned to the requirement that the petitioner, Fernando Velasco and Oscar Frozini, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part A. D. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. E. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity shall automatically terminate. F, This order shall be recorded in the Public Records of St. Lucie County.
