LUCIE COUNTY INTERNATIONAL AIRPORT PROPERTY, FOR THE DEVELOPMENT AND RELOCATION OF AN EXISTING 0.40 ACRE (724 FOOT) MAN-MADE DITCH AND 0.43 ACRE (365 FOOT) MAN-MADE DRAINAGE SWALE ONSITE TO INCREASE STORMWATER STORAGE CAPACITY AT THE AIRPORT SITE, AND GENERALLY LOCATED AT 3000 CURTIS KING BOULEVARD IN FORT PIERCE, FLORIDA, AND PROVIDING FOR EXPIRATION, PROVIDING FOR NON-SEVERABLE CONDITIONS OF APPROVAL, PROVIDING FOR REGULATORY PERMITTING REQUIREMENTS, PROVIDING FOR PUBLIC RECORDS RECORDING OF THE RESOLUTION AND THE LOCATION OF THE FILE COPY, AND PROVIDING FOR APPLICANT RECEIPT OF THE RECORDED RESOLUTION. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. The Airport Director has presented an application for a Major Adjustment to the Existing Conditional Use on 3.92 acres located at the St. Lucie County International Airport property, for the development and relocation of an existing 0.40 acre (724 foot) man- made ditch and 0.43 acre (365 foot) man-made drainage swale onsite to increase stormwater storage capacity at the airport site, and generally located at 3000 Curtis King Boulevard in Fort Pierce, Florida. 2. The Development Review Committee has found that the proposed project meets all technical requirements and is consistent with the future land use maps of the St. Lucie County Comprehensive Plan. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Comprehensive Plan, and the St. Lucie County Land Development Code. 3. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety, and general welfare. 4. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 5. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. After considering the information presented at a public hearing on August 21, 2007, this 2 Board has determined that the proposed Major Adjustment to the Existing Conditional 3 Use allows for the efficient use of land, resulting in smaller networks of utilities and 4 streets and thereby lowers development costs. 5 6 7. This Board has determined that the proposed development provides design options that 7 encourage an environment of stable character, compatible with surrounding land uses. 8 9 8. This Board has determined that the application for the Major Adjustment to the Existing 10 Conditional Use is in substantial conformity with the Existing Conditional Use. 11 12 9. This Board has determined that the proposed development is consistent with the general 13 purpose, goals, objectives and standards of the St. Lucie County Comprehensive Plan, 14 and is not opposed to the general spirit and intent of the St. Lucie County Land 15 Development Code. 16 17 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie 18 County, Florida: 19 20 A. Pursuant to Section 11.07.05.E.2.b of the St. Lucie County Land Development Code, 21 the Major Adjustment to the Existing Conditional Use is hereby approved as depicted on the 22 site plan drawings for the project prepared by Kimley-Horn and Associates, Inc., dated April 23 2007, last revised on April 2007, and date stamped received by the St. Lucie County Growth 24 Management Director on May 7,2007, and subject to the following conditions: 25 26 1. Prior to approval of a Notice of Vegetation Removal application, a tree mitigation 27 planting plan shall be provided. The plan shall include the proposed locations, species, 28 and diameter at breast height of mitigation trees. 29 30 2. Prior to initiation of site clearing and construction activities, tortoise relocation shall be 31 completed for the project footprint. 32 33 3. Prior to approval of a Notice of Vegetation Removal application, the applicant shall 34 provide documentation from FWS indicating they have approved of the proposed 35 plans, including any required avoidance/minimization/mitigation measures. 36 37 4. Prior to approval of a Notice of Vegetation Removal, the applicant shall provide a draft 38 of their proposed standard protection measures for the Eastern indigo snake, adherent 39 to FWS guidelines. This plan shall be implemented during tortoise relocation and 40 subsequent site clearing and construction activities. 41 42 5. Prior to approval of a Notice of Vegetation Removal, the applicant shall provide to ERD 43 documentation from the US Army Corps of Engineers showing they've approved the 44 permit for this project. 45 46 6. The developer, his successors or assigns, are not relieved from the responsibility of 2 obtaining the necessary permits required by Federal, State, and Local jurisdictional 3 agencies not mentioned within this resolution. 4 5 B. The property on which this site plan approval is being granted is described as 6 follows: 7 8 ALL THAT CERTAIN PIECE, PARCEL OR TRACT OF LAND SITUATE, LYING AND BEING IN 9 SECTION 29, TOWNSHIP 34 SOUTH, RANGE 40 EAST OF THE TALLAHASSEE BASE MERIDIAN, 10 ST. LUCIE COUNTY, FLORIDA. THE BEARINGS CONTAINED IN THIS LEGAL DESCRIPTION 11 ARE BASED UPON STATE PLANE GRID NORTH. THE DISTANCES REFER TO GROUND 12 DISTANCES. The conditions set forth in Part A are an integral non-severable part of the Major Adjustment to the Existing Conditional Use site plan approval granted by this Resolution. If any condition set forth in Part A is determined to be invalid or unenforceable for any reason and the developer declines to comply voluntarily with that condition, the site plan approval granted by this Resolution shall become null and void. F. A copy of this Resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director. G. A copy of this Resolution shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. H.
