LUCIE OAKS COMMERCIAL - 18 PNRD, AND PROVIDING FOR EXPIRATION, PROVIDING FOR NON- 19 SEVERABLE CONDITIONS OF APPROVAL, PROVIDING FOR REGULATORY 20 PERMITTING REQUIREMENTS, PROVIDING FOR PUBLIC RECORDS 21 RECORDING OF THE RESOLUTION AND THE LOCATION OF THE FILE 22 COPY, AND PROVIDING FOR APPLICANT RECEIPT OF THE RECORDED 23 RESOLUTION. 24 25 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the 26 testimony and evidence, including but not limited to the staff report, has made the following 27 determinations: 28 29 1. St. Lucie Oaks Commercial, LLC, through agent Robert A. Burson, Esq., presented 30 a petition for Preliminary Planned Development Site Plan approval for a project with an 31 existing PNRD (Planned Non-Residential Development) and CG (Commercial 32 General) Zoning District designation limiting the site to a maximum of 36 guest units / 33 acre, and Future Land Use designation of Commercial (COM), to be known as St. 34 Lucie Oaks Commercial- PNRD. The proposed development consists of a four-story, 35 eighty-eight (88) room hotel consisting of 56,991 square feet, a restaurant consisting of 36 4,613 square feet, and office space building consisting of 9,008 square feet, on 4.64 37 acres, and is located on the west side of South U.S. Highway No.1, approximately 38 1,500 feet north of Riomar Drive in Port St. Lucie. 39 40 2. The Development Review Committee has found that the proposed project is consistent 41 with the future land use maps of the St. Lucie County Comprehensive Plan. Staff has 42 found that with the limiting Conditions of Approval, the Preliminary Planned Non- 43 Residential Development Site Plan meets the technical requirements of Sections 44 7.02.00, 11.02.05.A.7, and 11.02.10 of the St. Lucie County Land Development Code. 45 46 3. On March 6, 2007, this Board held a public hearing on the petition, after publishing a 47 notice of such hearing and notifying by mail all owners of property within 500 feet of 48 the subject property at least 10 days prior to the public hearing. The St. Lucie County File No.: PNRD - 06-018 August7,2007 Resolution No. 07-002 Page 1 1 Board of County Commissioners moved to continue the review of the proposed project 2 to the June 5, 2007 Commission Meeting, or as soon thereafter, in order for the 3 applicant to review the layout of the submitted Site Plan and submit changes to 4 address the issues raised by the Board. 5 6 4. After considering the information presented at a public hearing on August 7,2007, this 7 Board has determined that with the conditions listed herein, the Preliminary Planned 8 Non-Residential Development Site Plan provides a creative approach to the 9 development of non-residential land and reflect changes in the technology of land 10 development. 11 12 5. This Board has determined that with the conditions listed herein, the proposed 13 development allows for the efficient use of land, resulting in smaller networks of utilities 14 and streets and thereby lowers development costs. 15 16 6. This Board has determined that with the conditions listed herein, the proposed 17 development provides design options that encourage an environment of stable 18 character, compatible with surrounding land uses. 19 20 7. This Board has determined that with the conditions listed herein, the proposed 21 development enhances the neighborhood through the preservation of natural features, 22 the provision of underground utilities, and the provision of recreation areas and open 23 space. 24 25 8. This Board has determined that with the conditions listed herein, the proposed 26 development is consistent with the general purpose, goals, objectives and standards of 27 the St. Lucie County Comprehensive Plan, and is not opposed to the general spirit and 28 intent of the St. Lucie County Land Development Code. 29 30 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie 31 County, Florida: 32 33 A. Pursuant to Section 11.02.05(A) of the St. Lucie County Land Development Code, the 34 Preliminary Planned Unit Development Site Plan to be known as St. Lucie Oaks Commercial - 35 PNRD, is hereby approved as depicted on the site plan drawings for the project prepared by 36 David Lawrence Architecture Inc., dated January 25,2005, last revised on May 24,2007, and 37 date stamped received by the St. Lucie County Growth Management Director on June 28, 38 2007 subject to the following conditions: 39 40 1. Prior to Final Site Plan approval, the applicant shall amend the Site Plan to show the 41 construction design of the South U.S. Highway No. 1 entrance into the project, 42 agreed upon by the applicant and the County's Engineer on July 17, 2007, and 43 received and reviewed by County Staff on July 18, 2007, and submitted herein as 44 Exhibit B. 45 46 2. The plan, once approved, must be adhered to during all vegetation removal and construction activities. Burson, Esq., including any 31 successors in interest, shall obtain all necessary development permits and construction 32 authorizations from the appropriate State and Federal regulatory authorities, including but not 33 limited to: the United States Army Corps of Engineers, the Florida Department of 34 Environmental Protection, and the South Florida Water Management District, prior to the 35 issuance of any local building permits of authorizations to commence development activities 36 on the property described in Part B. 37 38 E. The conditions set forth in Part A are an integral non-severable part of the site plan 39 approval granted by this Resolution. If any condition set forth in Part A is determined to be 40 invalid or unenforceable for any reason and the developer declines to comply voluntarily with 41 that condition, the site plan approval granted by this Resolution shall become null and void. 42 43 F. A copy of this Resolution shall be attached to the site plan drawings described in Part 44 A, which plan shall be placed on file with the St. Lucie County Growth Management Director. 45 46 G. All applicable conditions of approval as set forth above, and all applicable code requirements must be met to satisfaction of the County before final site construction permits are issued. The meeting was held as a follow up to meeting and discussions with the St. Lucie County Gromh Management Office on July 13, 2007. The Developer requested a revision to the previously agreed access connection to the project site to SR 5 (US I). The purpose of this request is to maintain a southbound egress movement from the parking area facing SR 5 north 0 f the existing bank. I revie\\ed their petition and developed a concept that would grant their request and still preserve the original intent of reducing conflict at that particular access point. The Developer submitted the attached drawings which depict the changes discussed in these meetings. I Based on a review of the Developer's proposed access modifications, the design is expected to provide reasonable access to-arxI-from the proposed site uses, and will reduce the potential for traffic queuing into SR5 (US I) improving the safety characteristic of the connection. The proposed plan is substantially safer than the original concept approved by FOOT. I It is recommended that the County Conunission consider approval related to this particular issue.
