LUCIE COUNTY, FLORIDA. +0 ~ ff1 +-8 hh tv\^' WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Saroiben Patel. presented a petition for a Conditional Use Permit to allow the operation of a retail liquor store in the CG (Commercial, General) Zoning District for the property described Part B below. 2. On July 19, 2007, the St. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners a/JfJrove the hereinafter described request for a Conditional Use Permit in the CG (Commercial General) Zoning District for the property described below. 3. On August 21, 2007, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. 4. The proposed Conditional Use is consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.07.03 of the St. Lucie County Land Development Code. 5. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 6. The proposed project is provided water and sewer by the Fort Pierce Utilities Authority and sewer from St. Lucie County Utilities District. 7. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. Lucie County Florida: A. Pursuant to Section 11.07.03 of the S1. Lucie County Land Development Code, a Conditional Use Permit for Sarojben Patel, to allow the operation of a retail liquor store in the CG (Commercial General) Zoning District, with the following condition: 1. The conditional use permit is only approved for the sale of liquor between the hours of 7 am to 11 pm, on Monday through Saturday; and 1 pm to 8pm on Sundays. No liquor sales may occur outside of those hours. 2. The retail liquor store shall be limited to 1,600 square feet of retail space to be located within the Hutchinson Island Shoppes as described in Part B. B. The subject property is described as follows: Commence at the Southeast corner of Windmill Village Unit Two as recorded in Plat Book 16, page 31, public records of St Lucie County, Florida; thence run North 89 degrees 56'52" East a distance of 28.47 feet; thence run South 23 degrees 49'31" East a distance of 163.17 feet; thence run North 89 degrees 56'22" East a distance of 54.63 feet to the Point of Beginning of parcel herein described; thence continue to run North 89 degrees 56'22" East a distance of 273.16 feet to an intersection with the Westerly right of way of State Road A1A, as now laid out and in use; thence run South 23 degrees 49'31" East along said right of way a distance of 289.83 feet to the North line of a parcel described in O.R. Book 270, page 2806; thence run South 89 degrees 56'22" West along said North line a distance of 273.16 feet; thence run North 23 degrees 49'31" West a distance of 289.88 feet to the Point of Beginning. Location: 11027 South Ocean Dr., Jensen Beach C. The approvals and authorizations granted by this Resolution are for the purpose of obtaining a zoning compliance for this property, and shall expire on August 21 , 2008, unless the applicant obtains a zoning compliance for the uses described in Part A above, or an extension has been granted in accordance with Section 11.07.05(F), S1. Lucie County Land Development Code. D. The Certificate of Capacity, a copy of which is attached to this resolution, shall remain valid for the period of Conditional Use approval. Should the Conditional Use approval granted by this resolution expire or an extension be sought pursuant to Section 11.07.05(F) of the S1. Lucie County Land Development Code, a new certificate of capacity shall be required. E. The S1. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of S1. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution.
