WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: CHANGE IN ZONING 1. BJK. Inc. presented a petition for a Chanae in Zonina from the AG-1 (Aaricultural - 1 du/acre) Zonina District and RlC (Residential Conservation - 1 du/5 acres) Zonina District to the PUD (Planned Unit Development - Creekside) Zonina District for property located on the south side of Okeechobee Road (SR 70). Y2 mile west of Gordy Road for certain property in St. Lucie County. Florida as depicted on the attached maps as Exhibit "An and described in Part "Bn below. On October 21. 2004, the St. Lucie County Plannina and Zonina Commission held a public hearina on the petition of BJK. Incoo after publishina a notice of such hearina in the Tribune and the Port St. Lucie News and notifvina by mail all property owners within 500 feet at least 10 days prior to the hearina. and recommended that the Board of County Commissioners BDDrove the Preliminary Planned Unit Development for the project to be known as Creekside- PUD for the property depicted on the attached Maps as Exhibit "An and described in Part "Bn below. 3. On November 15. 2004. this Board held a public hearina on the petition of BJK. Inc. for Preliminary Planned Unit Development approval for the project known as Creekside - PUD. after publishina a notice of such hearina in the Tribune and the Port St. Lucie News and notifvina by mail all property owners within 500 feet of the subject property at least 10 days prior to the hearina and aranted preliminary approval for the reauested chanae in zonina from the AG-1 (Aaricultural - 1 du/acre) Zonina District and RlC (Residential Conservation - 1 du/5 acres) Zonino District to the PUD (Planned Unit Development - Creekside - PUD) Zonino District. On September 20. 2005. this Board held a public hearina on the petition of BJK. Inc.. after publishina a notice of such hearino in the Tribune and the Port St. Luce News and notifvina by mail all property owners within 500 feet of the subject property at least 10 days prior to the hearino and the continued the public hearina to October 4. 2005. Board of County Commissioners meetina. On October 4. 2005. the Board of County Commissioners continued the public hearina on this matter and approved a Chanae in Zonina from the AG-1 (Aaricultural - 1 du/acre) Zonina District and RlC (Residential Conservation - 1 du/5 acres) Zonina District to the PUD (Planned Unit Development - Creekside - PUD) Zonina District and Final Planned Unit Development Site Plan approval for the proiect known as Creekside - PUD for the property depicted on the attached Maps as Exhibit "N and described in Part "B" below.
