LUCIE COUNTY, FLORIDA, GRANTING LOIS BARKER A CONDITIONAL USE PERMIT TO ALLOW FOR THE OPERATION OF AN AUTO BODY REPAIR AND PAINT SHOP IN THE CG (COMMERICAL, GENERAL) ZONING DISTRICT FOR PROPERTY LOCATED AT 411 WEST WEATHERBEE ROAD IN ST. LUCIE COUNTY, FLORIDA; PROVIDING FOR DETERMINATIONS; PROVIDING FOR APPROVAL SUBJECT TO CONDITIONS; PROVIDING FOR DESCRIPTION OF THE AFFECTED PROPERTY; PROVIDING FOR ENFORCEMENT OF CONDITIONS; AND PROVIDING FOR A RECORD FILE LOCATION. WHEREAS, the Board of County Commissioners of S1. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. Lois Barker, has petitioned for a Conditional Use Permit to allow for the operation of an Auto Body Repair and Paint Shop in the CG (Commercial, General) Zoning District for property described in Part B below and depicted in Exhibit "A", attached hereto and made a part hereof. 2. On September 20, 2007, the S1. Lucie County Planning and Zoning Commission held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property, and recommended that the Board of County Commissioners approve the hereinafter described request for a Conditional Use Permit in the CG (Commercial, General) Zoning District for the property described below, 3. On October 16, 2007, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. 4. The proposed Conditional Use is consistent with the goals, objectives, and policies of the S1. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11,07,03 of the S1. Lucie County Land Development Code. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare, 6. The applicant has received a Certificate of Capacity, a copy of which is attached to this order as Exhibit "B", as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.07.05 of the St. Lucie County Land Development Code, a Conditional Use Permit to allow for the operation of an Auto Body Repair and Paint Shop in CG (Commercial, General) Zoning at the location described in Part B, is hereby approved subject to the following conditions: 1. Prior to issuance of a Certificate of Occupancy, any "Category 1" exotic vegetation, as identified in the latest edition of the Florida Exotic Pest Plant Councils "List of Invasive Species" on the property shall be removed, and any remaining stumps chemically treated. 2. Prior to approval of the Vegetation Removal Permit, the applicant, successors or assigns shall provide a wetland and other surface water delineation performed by the jurisdictional agency(ies). This may be in the form of a non- binding wetland determination from the South Florida Water Management District. The site design shall include the avoidance and minimization of impacts to any wetlands or other surface waters which are found to exist on- site. 3. Prior to issuance of a building permit the applicant, successors, or assigns, shall have completed the execution of a final utility service agreement with Ft. Pierce Utilities Authority that provides for servicing this site with water and wastewater services. 4. Within 30 days of issuance of an Occupational License, the applicant, successors or assigns must notify the St. Lucie County Solid Waste Division of issuance of a Certificate of Occupancy for the auto body shop and provide a report of activities generating hazardous waste and an estimated of the quantities of hazardous waste generation in a form and at a frequency acceptable to the Division. Within 30 days an initial inspection with the St. Lucie County Solid Waste Regulatory Technician, Justin Gattuso (772-462- Resolution No. 07-132 October 16, 2007 File No.: CU 320071087 Page 2 1 1624) to discuss Best Management Practices and other recommended 2 pollution prevention measures, shall be scheduled. 3 5. The applicant, successors or assigns shall maintain all required permits and 4 licenses from the Department of Environmental Protection and other 5 applicable federal, state or local agencies, All auto body operations shall 6 comply with the standards, requirements, and procedures for generators of 7 hazardous waste and owners and operators of hazards waste facilities Section 8 403.721, Florida Statutes, 9 6. All areas where vehicles are stored or repaired must have an impermeable 10 surface and have provisions for containment of vehicle leaks. 11 7. All hazardous material shall be stored and disposed of in compliance with all 12 applicable local, state and federal rules and regulations. 13 8. All building areas proposed for the storage or use of hazardous materials shall 14 have no floor drains. 15 9. Water curtains in paint booths must recirculate the water used. There should 16 be no discharges. 17 10. The auto body shop shall include a solvent recycling unit and a paint recycling 18 unit with a hazardous waste storage drum and an emergency spill kit. 19 11 . The auto body shop shall be constructed with a concrete slab with berms to 20 prevent spillage of hazards wastes into the environment. Any new building 21 used to store paints and solvents on site shall be constructed with a concrete 22 slab with berms to prevent spillage of hazardous waste into the environment. 23 12. The building design shall ensure that no liquids would be able to run onto the 24 ground contaminating the soil. 25 13. Prior to issuance of a zoning compliance certificate the applicant must submit 26 a Hazardous Waste Management Plan that indicates how they will control the 27 collection, source separation, storage, transportation, processing, treatment, 28 recovery, recycling, and disposal of hazardous wastes that are utilized on the 29 subject site. 30 14. Prior to approval of the Building Permit, the applicant, successor or assigns 31 shall determine whether or not he is eligible for an exemption or qualifies 32 for an Air General Permit (AGP) by providing the Florida Dept. of 33 Environmental Protection (FDEP) with Application form 62-210.920(4) F.A.C 34 (available at: www.deo.state.fl.us) and applicable fees. Applications should be 35 sent to the Southeast District of the FDEP in West Palm Beach, if applying 36 before September 1, 2007. If applying after this date, the AGP application 37 shall be sent to the FDEP, Tallahassee office. If the facility would not qualify 38 for an AGP or a FDEP air permitting exemption, the applicant shall apply to the 39 FDEP Southeast District for an Air Construction Permit prior to any 40 construction, Please contact the FDEP Southeast District for further October 16, 2007 File No.: CU 320071087 Resolution No. 07-132 Page 3 1 information at (561) 681-6624. Copies of FDEP-approved permits shall be 2 provided to ERD prior to issuance of the Building Permit. 3 15, Prior to issuance of a Certificate of Occupancy an 8 foot high landscape wall 4 shall be provided along the property's southern property line meeting the 5 requirements of Section 7.009,04(E). Height of the wall shall be measured 6 from the highest grade of the two adjoining properties or from the nearest 7 adjacent finished floor of the proposed structure. The method of height shall 8 be finalized subject to the review and approval by the Environmental 9 Resources Department to ensure screening effect is achieved for the adjacent 10 property. 11 16. The hours of operation shall be limited to 8am to 5 pm Monday to Friday and 8 12 am to 2pm on Saturdays. 13 17.AII auto body painting will be conducted within an enclosed building. 14 15 B. The property on which this Conditional Use Permit is being granted is 16 described as follows: 17 18 Beginning 20 feet South and 280 feet East of the Northwest corner of Lot 5, 19 thence South 344.5 feet, thence West 90 feet, thence North 344.5 feet, thence 20 East 90 feet to point of beginning, a subdivided part of Section 3, Township 36 21 South, Range 40 East, including improvements thereon and being further 22 known as 411 Weatherbee Road, White City, St. Lucie County, Florida. 23 24 ParcellD No. 3403-502-0009-0000 25 26 D. This conditional use permit shall expire on October 16, 2008, unless the 27 applicant, successor or assigns_have obtained a zoning compliance for the 28 uses described in Part A above, or an extension has been granted in 29 accordance with Section 11.07.05(F), St. Lucie County Land Development 30 Code. 31 32 E. The Certificate of Capacity, a copy of which is attached to this resolution, shall 33 remain valid for the period of Conditional Use approval. Should the Conditional 34 Use approval granted by this resolution expire or an extension be sought 35 pursuant to Section 11.07.05(F) of the St. Lucie County Land Development 36 Code, a new certificate of capacity shall be required. 37 38 F.
