A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST.
LUCIE COUNTY, FLORiDA, CLOSING, VACATING AND ABANDONING ANY
INTEREST OF ST. LUCIE COUNTY AND THE GENERAL PUBLIC IN A
PORTION OF AN UNOPENED, UN-MAINTAINED 100-FOOT RIGHT-OF-WAY
KNOWN AS DUNN ROAD. SAID RIGHT-OF-WAY LYING IN SECTION 8,
TOWNSHIP 36 SOUTH, RANGE 40 EAST, RECORDED IN DEED BOOK 201,
PAGE 53 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the
following determinations:
1. That Sections 177.101,336.09 and 336.10, Florida Statutes, as amended, and Section 11.10.01 et.
seq. of the St. Lucie County Land Development Code, provide that the County may adopt
resolutions vacating rights-of-way in whole or in part, which are under the jurisdiction of the Board
of County Commissioners of St. Lucie County, Florida.
2. Pursuant to Deed Book 201, Page 53, St. Lucie County and the general public have a dedicated
interest in the following described land:
Being a portion of Parcel 2 of the Plat of Peachtree Place as recorded in Plat Book 41 Page 11

and 11A in the Public Records of St. Lucie County, Florida also known as that part of the Dunn
Road right-of-way lying within the North Y2 of Section 8, Township 36 South, Rang 40 East as

being more particularly described as follows.
Commencing at the Northeast comer of said Parcel 2, thence N63°44'06"W along the North
line of said Parcel 2 a distance of 812.52 feet to a point being 50 feet East of and parallel to the West
line of the East Y2 of the Northwest 1/4 of said Section 8, also, being the Point of Beginning; thence
departing said North line of said Parcel 2 SOoo13'54"E parallel to said West line a distance of933.54

feet to a point at the South line of said Parcel 2; Thence N89°59'38"W along said South line a
distance of 100,00 feet to a point 50 feet West of the West line of the East Yz of the Northwest 1/4 of

Containing 95,825,35 square feet (2,2 acres) more or less,
2. A Notice of Intent to Abandon was advertised on July 19, 2007 and July 26,2007 and no objections
were filed,
3. All relevant public utilities have given written consent for the abandonment.
4. County Staff members have reviewed the petition and have filed no objections to the proposed
abandonment.
5. All abutting property owners have filed consent forms and approve the abandonment.
6. On September 4, 2007, the Board of County Commissioners approved Permission to Advertise for a
Public Hearing on October 2, 2007,
7. On September 12, 2007 letters were mailed to property owners within 300ft.
8. On September 18, 2007, a Notice of Public Hearing was advertised in the Fort Pierce Tribune and
Port St. Lucie News,
9. It is in the best interest of the public to vacate and abandon the right-of-way more particularly
described as follows:

That a portion of the unopened, un-maintained 100-foot deeded right-of-way of Dunn Road more
particularly described as follows:
Being a portion of Parcel 2 of the Plat of Peachtree Place as recorded in Plat Book 41 Page
11 and 11A in the Public Records of St. Lucie County, Florida also lmown as that part ofthe Dunn
