LUCIE COUNTY GRANTING A 12-MONTH EXTENSION OF THE MAJOR SITE PLAN KNOWN AS PINE SUMMIT COMMERICAL LOCATED AT THE SOUTHEAST CORNER OF THE INTERSECTION OF SOUTH US HIGHWAY 1 AND LAKE VISTA TRAIL IN THE CG (COMMERCIAL, GENERAL) ZONING DISTRICT; PROVIDING FOR DETERMINATIONS; PROVIDING FOR DESCRIPTION OF THE AFFECTED PROPERTY; PROVIDING FOR ENFORCEMENT OF CONDITIONS; AND PROVIDING FOR A RECORD FILE LOCATION. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. On November 29, 2005, this Board, through Resolution 05-389, granted Major Site Plan approval for the project known as Pine Summit Commercial, a proposed 84,000 square foot commercial center located at the corner of the intersection of South US Highway 1 and Lake Vista Trail in the CG (Commercial, General) Zoning District, for property described in Part A. 2. On November 29, 2005, the Board of County Commissioners approved the final plat of Pine Summit Replat No, 1 as required by Condition NO.1 within Resolution 05-389, and subsequently recorded the plat in Plat Book 51 , Page 39 ofthe public records of St. Lucie County. 3. The developer of Pine Summit Commercial has requested that a 12-month extension of the Major Site Plan approved through Resolution No. 05-389, be extended for a period of 12 additional months from its date of scheduled expiration, November 29, 2007, with the new date of expiration being November 29, 2008. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: Resolution No, 07-284 November 6,2007 File No.: BCC 920071322 Page 1 of 4 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 A. Pursuant to Section 11.02,06(8)(2) of the St. Lucie County Land Development Code, the Major Site Plan, approved through Resolution 05-389, is hereby extended for a period of 12 additional months from its scheduled date of expiration, November 29, 2007, with the new expiration date being November 29, 2008, for the property described as follows: PINE SUMMIT REPLAT NO.1 BEING A REPLAT OF TRACT "A" OF PINE SUMMIT, AS RECORDED IN PLAT BOOK 40, PAGES 13, 13A THROUGH 13B, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. Location: Southeast corner of the intersection of South US Highway 1 and Lake Vista Trail B. All terms and conditions of Resolution 05-389 shall remain in full force and effect. C. This Major Site Plan extension shall expire on November 29, 2008, unless building permits are issued or another extension has been granted in accordance with Section 11.02,06, St. Lucie County Land Development Code. D. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. E. The St. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution, F. A copy of this resolution shall be placed on file with the St. Lucie County Growth Management Director. This Certificate of Capacity is transferable only to subsequent owners of the same parcel, and is subject to the same terms, conditions and expiration date listed herein.
