5 COUNTY GRANTING APPROVAL FOR A CHANGE IN ZONING FROM THE RS-2
6 (RESIDENTIAL, SINGLE FAMILY - 2 DU/ACRE) ZONING DISTRICT TO THE AG-1
7 (AGRICULTURAL - 1) ZONING DISTRICT FOR A PARCEL LOCATED WEST OF
8 EMERSON AVE. AND SOUTH OF INDRIO ROAD, AND PROVIDING FOR PUBLIC
9 RECORDS RECORDING OF THE RESOLUTION AND THE LOCATION OF THE
10 FILE COPY, AND PROVIDING FOR APPLICANT RECEIPT OF THE RECORDED
11 RESOLUTION.

13 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
14 testimony and evidence, including but not limited to the staff report, has made the following
15 determinations:

17 1. The petitioner, Indrio Groves Limited Partnership, is proposing a change in zoning from
18 RS-2 (Residential, Single-Family - 2 du/acre) Zoning District to the AG-1 (Agricultural - 1
19 du/acre) Zoning District for approximately 39.8 acres located west of Emerson Avenue
20 and abutting the centerline extension of Russakis Road south of Indrio Road.

22 2. On August 3, 1989, the Board of County Commissioners changed this zoning from the
23 AG-1 (Agricultural - 1 du/acre) Zoning District to the RS-2 (Residential, Single-Family - 2
24 du/acre) Zoning District.

26 3. On January 9, 1990, the Board of County Commissioners adopted the St. Lucie County
27 Comprehensive Plan, which applied a Future Land Use of RE (Residential Estate),
28 which allows for 1 du/acre.

30 4. The Development Review Committee has found that the proposed change in zoning is
31 consistent with the Future Land Use of the subject parcel, and is consistent with the
32 surrounding zoning. The proposed change in zoning is consistent with the general
33 purpose, goals, objectives and policies of the St. Lucie County Comprehensive Plan, and
34 the St. Lucie County Land Development Code.

36 5. The proposed rezoning will not have an undue adverse effect on adjacent property, the
37 character of the neighborhood, traffic conditions, parking, utility facilities or other matters
38 affecting the public health, safety, and general welfare.

40 6. After considering the information presented at a public hearing on December 18 2007,
41 this Board has determined that the proposed change in zoning is consistent with the
42 general purpose, goals, objectives and policies of the St. Lucie County Comprehensive
43 Plan, as well as the standards for review as set for in Section 11.06.03 of the St. Lucie
44 County Land Development Code.

46 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie

A. Pursuant to Section 11.06.00 of the St. Lucie County Land Development Code, the
Amendment to the Official Zoning Atlas of St. Lucie County for the subject property is
hereby approved.
B. The property on which this site plan approval is being granted is described as
follows:
LEGAL DESCRIPTION: The NW 1/4 ot the SE 1/4, Section 15, Township 34
South, Range 39 East, LESS rights-ot-way tor roads and drainage canals in St.
Lucie County, Florida.
LOCATION: Approximately 39.8 acre parcel, more or less, per St. Lucie County
Property Appraiser's Property Record, located west ot Emerson Ave. and
abutting the centerline extension ot Russakis (Lateral) Road south ot Indrio
Road and abutting the south right-ot-way line ot Indrio Road.
C. A copy of this Resolution shall be placed on file with the St. Lucie County Growth
Management Director.
D. A copy of this Resolution shall be mailed, return receipt requested, to the property
owner and agent of record as identified on the application.
E. This Resolution shall be recorded in the Public Records of St. Lucie County.
F. The Director of Growth Management shall be authorized to amend the official Zoning
Atlas to change the zoning of the parcel herein described, from RS - 2 (Residential, Single-
Family) to Agricultural - 1 (AG - 1).
