6 RECREATION CENTER LLC A MAJOR ADJUSTMENT TO AN
7 APPROVED CONDITIONAL USE PERMIT TO ALLOW THE
8 PAINTBALL ACTIVITIES TO CONTINUE WITH MODIFIED HOURS OF
9 OPERATION IN AN IL (INDUSTRIAL, LIGHT) ZONING DISTRICT FOR
10 PROPERTY LOCATED AT 2525 CENTER ROAD IN ST. LUCIE
11 COUNTY, FLORIDA; PROVIDING FOR DETERMINATIONS;
12 PROVIDING FOR APPROVAL SUBJECT TO CONDITIONS;
13 PROVIDING FOR DESCRIPTION OF THE AFFECTED PROPERTY;
14 PROVIDING FOR ENFORCEMENT OF CONDITIONS; AND
15 PROVIDING FOR A RECORD FILE LOCATION.

17 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
18 testimony and evidence, including but not limited to the staff report, has made the following
19 determinations:

21 1. On November 14, 2006, this Board, through Resolution No. 06-299, granted a Major
22 Adjustment to an Existing Conditional Use for the St. Lucie Family Recreation Center
23 LLC to allow Paintball Recreational Activities within an IL (Industrial, Light) Zoning
24 District for the property depicted on the attached maps as Exhibit "A" and described in
25 Part B below.

27 2. The applicant of the St. Lucie Family Recreation Center LLC has requested a Major
28 Adjustment to the Approved Conditional Use to modify conditions therein that would
29 allow the existing paintball activities to continue from its date of scheduled expiration,
30 November 14, 2007, and to expand the days and hours of operation.

32 3. On November 6, 2007, this Board held a public hearing on this petition, after
33 publishing a notice of such hearing and notifying by mail all owners of property within
34 500 feet of the subject property, and continued this petition until November 20,2007.

36 4. On November 20, 2007, this Board held a public hearing on this petition, after
37 publishing a notice of such hearing and notifying by mail all owners of property within
38 500 feet of the subject property.

40 5. The proposed Major Adjustment to the Approved Conditional Use Permit is consistent
41 with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan

and has satisfied the requirements of Section 11.07.03 of the St. Lucie County Land
Development Code.
6. The proposed project has not had an undue adverse effect on adjacent property, the
character of the neighborhood, traffic conditions, parking, utility facilities, or other
matters affecting the public health, safety and general welfare.
7. A Concurrency Exemption, a copy of which is attached to this resolution, was granted
by the Director of Growth Management.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners ofSt. Lucie
County, Florida:
A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development
Code, a Major Adjustment to an Approved Conditional Use, approved
through Resolution No. 06-299, is hereby modified to allow paintball
recreational activities, subject to the following conditions:
1. The St. Lucie Family Recreation Center LLC paintball operations may
continue to operate as a conditional use at this location in compliance
with the conditions set forth in this Resolution all other County Codes and
Ordinances. This approval shall not prohibit or impede rehabilitation of
the brownfield site, as per Resolution 06-036.
2. The operation of the paintball recreational activities shall be limited to
Monday through Thursdays from 7 a.m. until 9 p.m. and Fridays,
Saturdays, Sundays and Holidays between the hours of 7 a.m. and 10
p.m.
3. All paintball activities shall be conducted within the oval of the existing
go-cart tract.
4. The applicant shall maintain insurance on the paintball facilities.
5. A 12 foot high net shall be maintained along the northern 50% of the oval
track.
B. The subject property is described as follows:
The West 795.1 feet of the South 1167.5 feet of the North 1217.5 feet of the
Southwest one-quarter (1/4) of the Northeast one-quarter (1/4) and Southeast
one-quarter (1/4) of the Northwest one-quarter (1/4) of Section 31, Township
34, Range 40 East, less roads and canals; containing 56.62 acres more or
less, located in St. Lucie County, Florida.

C. The approvals and authorizations granted by this Resolution are for the
purpose of obtaining Zoning Compliance Certificate from St. Lucie County, and
are not assignable to any other party or institution. Should the petitioner
choose or decide to assign this business to another entity or individual, a major
adjustment to the conditional use permit shall be required.
D. The Concurrency Exemption, a copy of which is attached to this resolution,
shall remain valid for the period of Conditional Use approval.
E. The St. Lucie County Growth Management Director is hereby authorized and
directed to cause the notation of this resolution to be made on the Official
Zoning Map of St. Lucie County, Florida, and to make notation of reference to
the date of adoption and expiration of this resolution.
