A RESOLUTION APROVING THE REQUEST OF CHRISTOPHER AND
VALERIE SLACK FOR A VARIANCE FROM THE PROVISIONS OF
SECTION 6.02.02(B)(2)(A), OF THE ST. LUCIE COUNTY LAND DEVELOPMENT
CODE - ST. LUCIE RIVER SHORELINE DEVELOPMENT REGULATIONS, TO
ALLOW FOR THE CONSTRUCTION OF AN EROSION CONTROL BARRIER
CONSISTING OF TWO LAYERS OF GEOTEXTlLE (SOIL CLOTH) HELD IN PLACE
BY STONE RIP RAPAND NATIVE PLANTINGS ALONG 310 FEET OF THE
PROPERTY LINE LOCATED AT 5103 PALMETTO AVENUE.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence,
including but not limited to the staff report, has made the following determinations:
1. Christopher and Valerie Slack have applied for a variance from the provisions
of Section 6.02.02(B)(2)(a), of the St. Lucie County Land Development Code - St.
Lucie River Shoreline Development Regulations, to allow for the construction of
an erosion control barrier consisting of two layers of geotextile (soil cloth) held
in place by stone rip rap containing native plantings along 310 feet of the
property line located at 5103 Palmetto Avenue.
2. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie
County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St.
Lucie County.
3. The proposed project will not have an undue adverse effect on adjacent property, the character of the
neighborhood, traffic conditions, parking, utility facilities or other matters affecting the public health, safety and
general welfare.
4. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate
vicinity through erosion control design.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida:
A. Pursuant to Section 6.02.02 (B)(2)(a) of the St. Lucie County Land
Development Code, the request of Christopher and Valerie Slack for a variance from
the provisions of Section 6.02.02(B)(2)(a), of the St. Lucie County Land Development
Code - St. Lucie River Shoreline Development Regulations, to allow for the
construction of an erosion control barrier consisting of two layers of geotextile (soil
cloth) held in place by stone rip rap and native plantings along 310 feet of the property
line located at 5103 Palmetto Avenue is hereby approved as shown on the drawings
prepared by Valerie D. Slack dated October 8, 2007 date stamped received by the
St. Lucie County Environmental Resources Department on October 16, 2007.
B. The property on which this variance request is being approved is described as follows:
The North 200 feet of the South 310 feet of that part of Lot 62 % lying East of Canal 71 and North of the Westerly
Extension of the North Boundary of Outlot 14 of WHITE CITY SUBDIVISION, as recorded in Plat Book 1, page 23, Public
Records of St. Lucie County, Florida.
The South 100 feet of the North 300 feet of the South 310 feet of the South 490 feet of Lot 62 % lying East of Canal
Number 71, and North of the Westerly Extension of the North Boundary of Outlet (sic) 14, being also the South Boundary
of Outlots 15 and 16, according to the plat of WHITE CITY, a subdivision of Section 4, Township 36 South, Range 40 East,
as recorded in Plat Book 1, Page 23 of the Public Records of St. Lucie County, Florida.
