HomeMy WebLinkAbout08-074 f) , t1rv 11 '. êR- f) nf)f1?> F "Î ' ~tLc RESOLUTION NO. 08-074 A RESOLUTION ALLOWING OCEAN RESEARCH & CONSERV ATION ASSOCIATION, INC. , A NOT FOR PROFIT CORPORATION, THE USE OF W ALTON SCRUB HOMESTEAD FOR THE PURPOSE OF OPERATING A MARINE RESEARCH, EDUCATION AND CONSERVATION FACILITY; PROVIDING FOR AN EFFECTIVE DATE WHEREAS, Ocean Research & Conservation Association, Inc. ("ORCA"), a not for profit organization, has requested the use of Walton Scrub Homestead, Port St. Lucie, Florida for operating a marine research, education and conservation facility. WHEREAS, Section 125.38, Florida Statutes requires that any not for profit organization wishing to use any real or personal property that may be owned by any county or this state or by its board of county commissioners, for public or community interest and welfare, may apply to the board of county commissioners for a conveyance or lease of such property. WHEREAS, Section 125.38 further states that if it is determined by the Board of County Commissioners that such property is required for such use and is not needed for county purposes, the Board can allow the use of such property. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: 1. The Board does hereby grant permission to use the facility at Walton Scrub Homestead, 10809 S. Indian River Drive, Port St. Lucie, Florida, to the Ocean Research & Conservation Association, Inc. for the operation of a marine research, education and conservation facility. 2. The term of this use shall be for a five year period from March 11, 2008, with an option to extend the agreement for three (3) additional 5 year periods, unless otherwise terminated. 3. The Board further determines that for ORCA's use of the facility there shall be no charge. 1 4. The permission hereby granted to ORCA is contingent upon the signing by the County and ORCA of a mutually acceptable Use Agreement.
