A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST.
LUCIE COUNTY, FLORIDA, CLOSING, VACATING AND ABANDONING
ANY INTEREST OF ST. LUCIE COUNTY AND THE GENERAL PUBLIC IN
A PORTION OF SOUTH MANOR A VENUE, LYING IN SECTION 24,
TOWNSHIP 37 SOUTH, RANGE 40 EAST, AS PER PLAT NO.1 OF BEAU
RIVAGE, AS RECORDED IN PLAT BOOK 11, PAGE 24, PUBLIC
RECORDS OF ST. LUCIE COUNTY, FLORIDA.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made
the following determinations:
That Sections 177.101, 336.09 and 336.10, Florida Statutes, as amended, and Section
11.10.01 et. seq. of the St. Lucie County Land Development Code, provide that the
County may adopt resolutions vacating rights-of-way in whole or in part, which are under
the jurisdiction of the Board of County Commissioners of St. Lucie County, Florida.
Pursuant to Minute Book 2, Page 397, St. Lucie County and the general public have a
dedicated interest in the following described land:
A PARCEL OF LAND LYING IN SECTION 24, TOWNSHIP 37 SOUTH,
RANGE 40 EAST, ST. LUCIE COUNTY, FLORIDA, BEING MORE
PARTICULARLY DESCRIBED AS FOLLOWS:
BEING THAT PORTION OF SOUTH MANOR AVE, LYING EAST OF THE
EASTERLY RIGHT OF WAY OF FLORIDA AVENUE, SOUTH OF THE
NORTHERLY RIGHT OF WAY OF SOUTH MANOR AVENUE, LYING
WEST OF A LINE 40 FEET WEST OF AND PARALLEL WITH THE EAST
LINE OF SECTION 24, TOWNSHIP 37 SOUTH RANGE 40 EAST AND
LYING NORTH OF THE SOUTHERLY RIGHT OF WAY LINE OF SOUTH
MANOR AVE, AS PER THE PLAT NO.1 OF BEAU RIVAGE, AS

3. The abandonment of a portion of South Manor Avenue right-of-way will allow the Beau
Rivage Homeowners Association to convert this right-of-way into a park and the
Association will ensure that the park is maintained.
4. A Notice of Intent to Abandon was advertised on September 19,2002 and September 26,
2002. No objections were filed.
5. All relevant public utilities have given written consent for the abandonment. St. Lucie
County Road and Bridge Division has requested that the abutting property owners
dedicate 30ft utility and drainage easements to the County.
6. All abutting property owners have been notified and no objections have been filed.
7. On November 12, 2002, the Board of County Commissioners approved Permission to
Advertise for a Public Hearing on December 17, 2002.
On November 27, 2002, a Notice of Public Hearing was advertised in the Port St. Lucie
News.

At the February 4, 2003 Public Hearing, the Board determined that it is in the best
interest of the public to vacate and abandon the right-of-way more particularly described
as follows:
A PARCEL OF LAND LYING IN SECTION 24, TOWNSHIP 37 SOUTH, RANGE 40
EAST, ST. LUCIE COUNTY, FLORIDA, BEING MORE PARTICULARLY
DESCRIBED AS FOLLOWS:
BEING THAT PORTION OF SOUTH MANOR AVE, LYING EAST OF THE
EASTERLY RIGHT OF WAY OF FLORIDA AVENUE, SOUTH OF THE
NORTHERLY RIGHT OF WAY OF SOUTH MANOR A VENUE, LYING
WEST OF A LINE 40 FEET WEST OF AND PARALLEL WITH THE EAST
LINE OF SECTION 24, TOWNSHIP 37 SOUTH RANGE 40 EAST AND
