LUCIE COUNTY, FLORIDA, AMENDING RESOLUTION NO. 07-135 GRANTING AN ADJUSTMENT TO THE LANDSCAPE PLAN AND MODIFYING CONDITIONS OF APPROVAL FOR THE PROJECT KNOWN AS ALLIED NEW TECHNOLOGIES, INC., A 55,444 SQUARE FOOT INDUSTRIAL FACILITY SITUATE ON 25.00 ACRES (MORE OR LESS) OF LAND ON THE WEST SIDE OF RANGE LINE ROAD AT GLADES CUT OFF ROAD, IN THE IND (INDUSTRIAL) ZONING DISTRICT. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: 1. On July 24,2007, under Resolution 07-135, this Board approved a Major Adjustment to a Major Site Plan approval for the project known as Allied New Technologies (f1k1a Miami TanklChemTex), for a proposed 35,300 square foot expansion to the existing 20,144 square foot facility to provide for the introduction of a manufacturing operation that will supply water treatment plants with necessary treatment chemicals to create potable water. 2. On September 4, 2007, under Resolution 07-274, this Board approved a Development Order Amendment to modify Condition #6 of Resol.ution 07-135. 3. On May 6, 2008 the St. Lucie County Board of County Commissioners held a public hearing and granted a Minor Adjustment to the Landscaping Plan and a Development Order Amendment to modify conditions of approval which further required a Landscaping Agreement, including a $315,300.00 escrow deposit, to be established. 4. The proposed Minor Adjustment to the Landscaping Plan is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. The Environmental Resources Department has recommended remedial conditions of approval that, if implemented, correct any Code deficiencies and make the proposed Landscaping Plan consistent with the Land Development Code and Comprehensive Plan. 5. The proposed adjustment to the Landscaping Plan with conditions of approval as contained in this Resolution does not alter the prior approvals granted under Resolution 07-135 and Resolution 07-274 which remain in full force and effect. FRY, Jr., CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY FILE # 320892705/19/2008 at 02:03 PM OR BOOK 2974 PAGE 2926 - 2929 Doc Type: RESO RECORDING: $35.50 Resolution No. 08-095 Page 1 , , , 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 .19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A Pursuant to Section 11.02.04(A) of the St. Lucie County Land Development Code, the Adjustment to the Landscape Plan for the project known as Allied New Technologies, Inc., is hereby approved with conditions, including modifications to the site plan drawings for the project prepared by Culpepper & Terpening, Inc., a copy of which is attached as Exhibit A, dated March 28, 2008, and date stamped received by the St. Lucie County Growth Management Director on March 28, 2008, subject to the following conditions: 1. The applicant shall comply with the revised non-irrigated landscape plan dated March 28, 2008 using drought-tolerant native vegetation and approved by SLC Environmental Resources Department. In consideration that future development might occur before this revised landscape plan matures to provide an opaque vegetative screen, the applicant will execute a Landscaping Agreement, including an escrow deposit in the amount of $315,500.00, acceptable to SLC. The agreement shall be executed prior to the issuance of a Certificate of Occupancy and shall provide sufficient funding in escrow to replace the approved drought-tolerant landscape plan with mature, irrigated landscaping, if required by SLC ERD. 2. In the event that any landscaping within a utility easement is removed or damaged, it shall be promptly replaced either in the same location or in an alternate location approved by SLC per Section 7.09.04.0. B. Approval of this Resolution does not alter the prior approvals granted under Resolution 07 -135 and Resolution 07-274 which remain in full force and effect. C. The St. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of St. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution. D. A copy of this resolution shall be attached to the site plan drawings described in Section A, which plan. shall be placed on file with the St. Lucie County Growth Management Director. E. This resolution shall be recorded in the Public Records of St. Lucie County. The recording of this resolution does not authorize the commencement of anyon-site development activities without obtaining such further development permits as may be required. All applicable conditions of approval as set forth above, and all applicable code requirements must be met to satisfaction of the County before final site construction permits are issued.
