A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST.
LUCIE COUNTY, FLORIDA, GRANTING A 12 MONTH EXTENSION OF
THE FINAL PLANNED DEVELOPMENT SITE PLAN KNOWN AS
MILLCREEK - PUD.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida,
based on the testimony and evidence, including but not limited to the staff report, has
made the following determinations:
1. On March 21, 2006, through Resolution No. 06-156, the Board granted approval
for the Final Planned Development Site Plan known as Millcreek - PUD. The
project consists of a 406 residential units on 63.757 acres located on the north
side of Orange Avenue, approximately .5 mile west of the Orange Avenue and
Hartman Road intersection.
2. The property owner, FM Millcreek Holding LLC, has requested that the Final
Planned Development Site Plan granted through Resolution 06-156 be extended
for a period of 12 additional months from its date of scheduled expiration, June 6,
2009.
3. On June 3, 2008, the St. Lucie County Board of County Commissioners held a
public hearing; of which due notice was public and notice mailed to all property
owners within 500 feet at least 10 days prior to the hearing.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St.
Lucie County, Florida:
A.
Pursuant to Section 11.02.06(8)(3) of the St. Lucie County Land Development
Code, the Final Planned Unit Development Site Plan, approved through Resolution
06-156 is hereby granted an extension for a period of 12 additional months from its
date of scheduled expiration, June 6,2008, with the new expiration date being June
6, 2009, with the following condition, subject to the approval of the Developer's
lender:
Within 60 days of the date of this site plan extension approval, the
applicant, successor or assigns shall dedicate a 70 foot right-of-way from
Mariah Circle to the existing 60 foot right-of way for Selena Avenue along

1 this project's northern property line to provide the required minimum right-
2 of-way for Selena Avenue. In locations with an existing 60 foot right-of-
3 way for Selena Avenue (Circle), the applicant, successors or assigns shall
4 dedicate a 10 foot right-of-way along the property's northern property line.
5 Said dedication shall be by general warranty deed, free and clear of all
6 liens and encumbrances, in a form and manner acceptable to the County
7 Attorney.

9 B. All terms and conditions of Resolution 06-156 shall remain in full force and effect.

E. The Certificate of Capacity granted by the Growth Management Director on
September 20, 2006, shall remain valid for the period of this development order. If
this order expires or otherwise terminates, the certificate of capacity shall
automatically terminate.
F. The St. Lucie County Growth Management Director is hereby authorized and
directed to cause the notation of this resolution to be made on the Official Zoning
Map of St. Lucie County, Florida, and to make notation of reference to the date of
adoption of this resolution.
G. A copy of this resolution shall be placed on file with the St. Lucie County Growth
Management Director.
