RZ 220081421 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA AUTHORIZING THE DIRECTOR OF GROWTH MANAGEMENT TO AMEND THE OFFICIAL ZONING ATLAS FROM THE I (INSTITUTIONAL) ZONING DISTRICT TO THE HIRD (HUTCHINSON ISLAND RESIDENTIAL DISTRICT) ZONING DISTRICT FOR LOT 7 OF DIAMOND SANDS, A PARCEL OF LAND LOCATED ON THE EAST SIDE OF SOUTH OCEAN DRIVE APPROXIMATELY 4 MILES NORTH OF JENSEN BEACH CAUSEWAY ON SOUTH HUTCHINSON ISLAND, SITUATE IN ST. LUCIE COUNTY, FLORIDA. WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. St. Lucie County Director of Growth Management presented a petition for an amendment to the Official Zoning Atlas to change the zoning from the I (Institutional) Zoning Districtto the HIRD (Hutchinson Island Residential District) Zoning District for the property depicted on the attached maps as Exhibit "A" and described below in Part A. 2. On September 16, 2003, through Resolution No. 03-222 the Board of County Commissioners granted Major Site Plan approval for the project to be known as Diamond Sands Subdivision in the HIRD (Hutchinson Island Residential District) Zoning District which included the subject property. 3. On January 6, 2004, through Resolution No. 04-26 the Board of County Commissioners authorized an exchange of land between St. Lucie County, Florida and Treasure Cay, LLC which included the subject property. 4, On February 8,2005, the Board of County Commissioners adopted the final plat of Diamond Sands Subdivision and authorized its final execution which included the subject property. 5. On June 27, 2006, through Resolution No. 06-160 the Board of County Commissioners granted a Major Adjustment to a Major Site Plan for the project known as Diamond Sands to provide for the updating of the Mean High Water line and site plan designs subsequent to beach erosion from the 2004 Hurricanes. 6. On April 17, 2008, the St. Lucie County Planning and Zoning Commission held RZ-220081421 June 3, 2008 Resolution No.08-020 Page 1 EDWIN M. On June 3, 2008, the Board of County Commissioners held a public hearing on the petition, after publishing notice at least 10 days prior to the hearing and notifying by mail the property owners of the subject property and surrounding properties. 8. The proposed change in zoning has satisfied the requirements of Section 11.06.03 of the St. Lucie County Land Development Code and is consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan. 9. The proposed change in zoning is consistent with the existing and proposed use of property in the surrounding area. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. The proposed Change in the Zoning District Classification from the I (Institutional) Zoning District to the HIRD (Hutchinson Island Residential District) Zoning District for that property depicted on the attached maps as Exhibit "A" and described as follows: DIAMOND SANDS PLAT NO.2 (PB 54-40) LOT 7 Property Tax ID#: 3527-501-0008-000/1 (Location: East side of South O~ean Drive, approximately 4 miles north of Jensen Beach Causeway on South Hutchinson Island) Owned by LMCM Prop Investments LLC is hereby approved. The St. Lucie County Growth Management Director is hereby authorized and directed to cause the change to be made on the Official Zoning Atlas of St. Lucie County, Florida, and to make notation of reference to the date of adoption ofthis resolution.
