LUCIE COUNTY, FLORIDA 6 GRANTING PRELIMINARY AND FINAL PLANNED NON- 7 RESIDENTIAL DEVELOPMENT SITE PLAN APPROVAL FOR 8 THE PROJECT TO BE KNOWN AS COMMERCE CENTER 9 PROFESSIONAL BUILDING (FKA PGA VILLAGE HOTEL AND 10 OFFICE PHASE II) LOCATED IN THE PNRD (PLANNED NON 11 RESIDENTIAL DEVELOPMENT - PGA VILLAGE HOTEL AND 12 OFFICE) ZONING DISTRICT 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. PGA Golf Development Inc, has applied for Preliminary and Final Planned Non Residential Development Site Plan approval for the project to be known as Commerce Center Professional Building (fka PGA Village Hotel and Office Phase II) consisting of 18,900 square foot two story office building for property located on the north side of Commerce Centre Drive, approximately 800 feet east of the intersection of Champions Way and Commerce Centre Drive in the PNRD (Planned Non Residential Development - PGA Village Hotel.and Office) Zoning District for the property described in Part B. 2. On December 20, 1988, this Board approved Resolution No, 88-357 granting approval to the Application for Development Approval (ADA) for the Development of Regional Impact (DRI) known as the Reserve. 3. The Reserve DRI is approved as amended through Resolution No. 04-081, for a total of 3,200 dwelling units; 500,000 square feet of industrial development; 290,000 square feet of commercial development; 100,000 square feet of office space and 250 hotel/motel rooms. 4. On September 18, 2003, the Planning and Zoning Commission held a public hearing on the petition of Kenneth F. Lowe, Jr., after publishing a notice of such hearing in the Tribune and the Port. On October 7, 2003, this Board approved Resolution No. 03-228 granting approval to a change in zoning from the CG (Commercial, General) Zoning District to the PNRD (Planned Non Residential Development - PGA Village Hotel and Office) for the Preliminary Planned Non Residential Development for a 12,000 square foot office and Preliminary and Final Planned Non Residential Development approval for a. 170-unit hotel known as Parcel37C at the Reserve (aka PGA Hotel and Office). On April 1, 2005, the Growth Management Department, granted a Minor Adjustment to the approved Planned Non Residential D~velopment Site Plan Known as PGA ViUage Hotel and Office to reduce the number of hotel rooms from 170 to 130 units. On June 3, 2008, this Board held a public hearing on the petition of PGA Golf Development, Inc" after publishing a notice of such hearing in the Tribune and the Port St. Lucie News and notifying by mail all property owners within the Reserve Development. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet minimum technical requirements of the St. Lucie County Land Development Code and to be consistent with the future land use maps from the St. Lucie County Comprehensive Plan. The proposed project is consistent with the general purpose, goals, objectives, and standards of review of the S1. Lucie County land Development Code, the St.. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. The proposed project will not have an undue adverse effect on adjacent property, the character ofthe neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening, The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property,. in accordance with applicable district reg.ulations. The applicant has applied for and received a Certificate of Capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. NOW,. THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Luci~ County, Florida: A. Pursuant to Section 11.02.,05 of the St. Lucie County Land Development Code, the site plan for the project known as Commerce Center Professional Building (fka PGA ViUag.e Hotel and Office Phase I I), is hereby approved as shown on the site plan drawings for the project prepared by Thomas Lucido & Associates, Inc., dated, June 15, 2006, and date stamped received by the St. Lucie County Growth Management Director on May 15, 2008, for the property described below, subject to the following conditions: 1. All development activities on this parcel are subject to the applicable requirements of the final development order for the Reserve Development Regional Impact, last revised through Resolution No. 04-081, and as may be amended in the future. 2. Prior to the issuance of a St. Lucie County Vegetation Removal Permit, St. Lucie County Environmental Resource Department will conduct an on site inspection verifying that all protective barricades are in place prior to the commencement of land clearing activities. B. The property on which this Preliminary and Final Planned Non Residential Development Site Plan approval is being granted is described as follows: PGA COMMERCE CENTRE AT THE RESERVE FOURTH REPLAT (58-26) PARCEL 2 (2..163 AC) (TAX ID#: 3327-807-0002-000/4) C, The approvals and authorizations granted by this Resolution for the purpose of obtaining building permits on this property, shall expire on June 3, 2010, unless the developer has obtained building permits for the site plan described in Part A or an extension has been granted in accordance with Section 11.02.06, St. Lucie County Land Development Code, File No: PNRD 06-003 June 3, 2008 Resolution No. 08~016 page 3 1 2 D. 3 4 5 6 7 8 9 10 11 12 E. 13 14 15 16 F. 17 18 19 20 G, 21 22 23 H, 24 25 26 27 I. 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, PGA Golf Development Inc., including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal re.gulatory authorities, including. but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B, A copy of this resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on fHe with the St. Lucie County Growth Management Director, The certificate of capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the certificate of capacity shaH automatically terminate. A copy of this Order shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. A copy of this Order shall be attached to the site plan drawings described in Section A, which plan shall be on file with the St. Lucie County Growth Management Director.
