5 A RESOLUTION GRANTING A VARIANCE FOR
6 CERTAIN PROPERTY IN ST. LUCIE COUNTY, FLORIDA

8 WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony
9 and evidence, including, but not limited to the staff report, has made the following
10 determinations:

12 1. Keith Mahaffev Pools Inc.. presented a petition for a Variance from the Provisions of
13 Section 7.04.01 (Table 7-10), of the St. Lucie County Land Development Code, to
14 permit continued use of a swimming pool screen enclosure that encroaches a
15 maximum of 8 inches into the minimum rear setback of 5 feet required in the
16 Portofino Shores Planned Unit Development (PUD) Zoning District for the property
1 7 depicted on the attached maps as Exhibit "A" and described below,

19 2. On May 28, 2008, this Board of Adjustment held a public hearing on the petition,
20 after publishing a notice of such hearing and notifying by mail all owners of property
21 within 500 foot of the subject property.

23 3. After consideration of the testimony presented during the public hearing, including
24 staff comments and the standards of review for granting variances set out in Section
25 10,01.02, St. Lucie County Land Development Code, the Board of Adjustment has
26 made the following determination:

28 a. The requested variance has met the standards of review as set forth in
29 Section 10.01.02, St. Lucie County Land Development Code and is not in
30 conflict with the goals, objectives, and policies of the St. Lucie County
31 Comprehensive Plan, because:

33 b. The variance granted is the minimum variance that will make possible the
34 reasonable use of the land, structure, or building.

36 c. The variance granted will not have adverse impacts to other property or
37 improvements in the neighborhood.

39 d. The variance granted meets the general spirit and intent of the St. Lucie
40 County Land Development Code and the Sf. Lucie County Comprehensive
41 Plan.

NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
Florida:
A. Keith Mahaffev Pools, Inc" presented a petition for a Variance from the Provisions of
Section 7,04.01 (Table 7-10), of the St. Lucie County Land Development Code, to
permit continued use of a swimming pool that encroaches a maximum of 8 inches
into the minimum rear setback of 5 feet in the Portofino Shores Planned Unit
Development (PUD) Zoning District subject to the following condition:
1. Prior to issuance of any pool permit, the property owner, his successors or
assigns is required to provide an approval letter from the Home Owner
Association.
B. The property on which this variance is being granted is described as follows:
LOT 489, PORTOFINO SHORES, ACCORDING TO THE PLAT THEREOF, AS
RECORDED IN PLAT BOOK 43, PAGES 6 THROUGH 6H, OF THE PUBLIC RECORDS
OF ST. LUCIE COUNTY, FLORIDA. SAID LANDS SITUATE IN ST. LUCIE COUNTY,
FLORIDA. STREET ADDRESS: 5745 STERLING LAKE DRIVE

C, This variance shall expire twelve months from the date of adoption unless a building
