LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. Matthew Reeves, presented a petition for a Variance from the Provisions: · Section 7.04.01 (A) of the St. Lucie County Land Development Code to allow the construction of a single-family residence and a detached garage, which would exceed the maximum 30 percent lot coverage by buildings and the minimum front, . side and rear setbacks allowed in the RS-4 (Residential, Single Family - 4. du/acre) Zoning District, · Section 7.05.06(C) to allow construction of a driveway less than five (5) feet from the side property line, and · Section 8.00.04(A) to allow a fence to exceed the maximum six (6) foot high side and rear height restriction by one foot in a residential zoning district. for the property depicted on the attached maps as Exhibit "A" and described below. 2. On June 25, 2008, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. That meeting was continued to the Board's July 23, 2008 meeting. 3. On July 23, 2008, the public hearing was held by the Board of Adjustment. 4. After consideration of the testimony presented during the public hearing, including staff comments and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determination: The requested variance has met the standards of review as set forth in Section 10.01.02, St. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan, because: 1. The request for a variance from the Provisions of Section 8.00. 04(A) to allow a fence to exceed the maximum six (6) foot high side and rear height restriction by one foot in a residential zoning district was withdrawn by the property owner, Matthew Reeves. The variance granted is the minimum variance that will make possible the reasonable use of the land, structure, or building. 3. The variance granted wif{ not have adverse impacts to other property or improvements in the neighborhood. 4. The variance granted meets the general spirit and intent of the St. Lucie County Land Development Code and the St. Lucie County Comprehensive Plan. NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St Lucie County, Florida: A. Matthew Reeves, presented a petition for a Variance from the Provisions of Section 7.04.01 (A), of the St. Lucie County Land Development Code, to permit the construction of a single-family home which proposes a lot coverage by buildings of 3,673.67 square feet, thereby exceeding by 9.03 percent the maximum 30 percent lot coverage by buildings allowed in the RS-4 (Residential, Single-Family - 4 du/ac) Zoning District and to allow the construction of a single-family residence and detached garage, which would encroach into the minimum front, rear and side setback. In the front by 4 feet, left side by 1.4 feet and the rear by 3.33 feet for the property depicted on the attached maps as Exhibit "A" and described below, subject to the following conditions: 1. The gate indicated on the site plan/boundary survey located at the rear of the property shall be removed and the site plan will be revised to indicate a six (6) foot CBS wall. 2. The oak tree will not be disturbed unless the St. Lucie County Environmental Department has issued and approved a Vegetation Removal Permit. B. The property on which this Variance approval is granted is described as follows: Coral Cove Beach Section One, Block 2, Lot 9 and the North 10 Feet of Vacant Alley Adjacent on the South. (Tax 10#: 1425-701-0030-000(9) (Location: 247 Bimini Drive) B. This variance shall expire twelve months from the date of adoption unless a building permit is approved or an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code.
