HomeMy WebLinkAbout08-149 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 RESOLUTION NO. 08-149 FILE NO,: CUMJ 720071278 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST, LUCIE COUNTY TO AMEND RESOLUTION 07-046 GRANTING A ONE YEAR EXTENSION TO AN APPROVED CONDITIONAL USE PERMIT; GRANTING A MAJOR ADJUSTMENT BY AMENDING THE CONDITIONS OF APPROVAL REGARDING HOURS OF OPERATION; AND GRANTING APPROVAL FOR A MINOR SITE PLAN FOR FORT PIERCE # 4, LOT 13 OF MIDWAY INDUSTRIAL PARK, PHASE III SUBDIVISION IN THE IH (INDUSTRIAL, HEAVY) ZONING DISTRICT SITUATE IN ST, LUCIE COUNTY, FLORIDA, WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: MAJOR ADJUSTMENT TO CONDITIONAL USE PERMIT 1. Ft. Pierce #4, petition for a one year extension to an approved Conditional Use Permit for a concrete block manufacturing plant; a Major Adjustment to a Conditional Use Permit extending the hours of operation to 24 (twenty four) hours per day for indoor manufacturing operations and imposing approved hours of operation for truck traffic to and from the facility to be 7:00 am through 5:00 pm seven (7) days a week in the IH (Industrial, Heavy) Zoning District. 2. On March 15, 2007, the St. Lucie County Planning and Zoning Commission, by a vote of five to one, recommended approval of the petition with a condition approval limiting hours of operation to 5:00 am through 10:00 pm. 3. On April 17, 2007, this Board, through Resolution No. 07-046, unanimously granted an approval for a Conditional Use Permit for Ft. Pierce # 4, to allow the operation of a concrete block manufacturing facility in the IH (Industrial, Heavy) Zoning District. 4. On July 15, 2008, this Board held a public hearing on this petition, after publishing a notice at least 10 days prior to the hearing and notifying by mail all owners of property within 500 feet of the subject property. 5. The proposed Conditional Use is consistent with the goals, objectives, and policies of the St. Lucie County Comprehensive Plan and has satisfied the requirements of Section 11.07.03 of the St. Lucie County Land Development Code. The proposed Conditional Use will not have an undue adverse effect on adjacent 2 property, the character of the neighborhood, traffic conditions, parking, utility 3 facilities, or other matters affecting the public health, safety, and general welfare. 4 5 7. The proposed conditional use will be serviced by adequate public facilities and 6 services. 7 8 SITE PLAN 9 10 8. Ft. Pierce #4, has applied for a Minor Site Plan approval for the project to be 11 known as Fort Pierce No.4, Lot 13 - to allow the operation of a concrete block 12 manufacturing facility consisting of an 18,000 square foot building on property 13 located on the east side of South Jenkins Road, and approximately 1500 feet 14 north of West Midway Road, located in "Midway Industrial Park, Phase III 15 Subdivision", zoned IH (Industrial, Heavy) for the property described in "Paragraph 16 A". 17 18 9. On September 25,2001, through Resolution No. 01-138, the Board of County 19 Commissioners unanimously granted Major Site Plan Approval for an 18 Lot 20 subdivision "Midway Industrial Park, Phase III Subdivision" on 286 acres. 21 22 10. Pursuant to condition number 3 of Resolution No. 01-138, the developer, his 23 successors or assigns, shall be required to submit a complete site plan for review 24 and approval, regardless of the size of the project. Each site plan shall be 25 prepared in accordance with the requirements set forth in Section 11.02.00 of the 26 Land Development Code. The submittal shall be required to provide a traffic 27 impact statement, prepared by a professional engineer registered in the State of 28 Florida and with demonstrated familiarity with traffic planning practices. The 29 purpose of the traffic impact statement is to provide a cumulative review of the 30 developments traffic impacts. Unless the proposed use of the property requires 31 review and processing as a conditional use, all development reviews shall be 32 processed consistent with the Minor Site Plan review process. 33 34 11. The Development Review Committee has reviewed the site plan for the proposed 35 project and found it to meet minimum technical requirements of the St. Lucie 36 County Land Development Code and to be consistent with the future land use 37 maps from the St. Lucie County Comprehensive Plan. 38 39 12. The proposed project is consistent with the general purpose, goals, objectives, 40 and standards of the St. Lucie County Land Development Code, the St. Lucie 41 County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 42 43 13. The proposed project will not have an undue adverse effect on adjacent property, 44 the character of the neighborhood, traffic conditions, parking, utility facilities, or 45 other matters affecting the public health, safety, and general welfare. 46 July 15, 2008 File No.: CUMJ 720071278 Resolution No. 08-149 Page 2 1 14. All reasonable steps have been taken to minimize any adverse effect of the 2 proposed project on the immediate vicinity through building design, site design, 3 landscaping and screening. 4 5 15. The proposed project will be constructed, arranged and operated so as not to 6 interfere with the development and use of neighboring property, in accordance 7 with applicable district regulations. 8 9 16. The proposed project will be served by adequate public facilities and services. 10 11 17. The applicant has applied for and will receive a Certificate of Capacity, a copy of 12 which will be attached to this resolution as "Exhibit B", as required under Chapter 13 V, St. Lucie County Land Development Code and recorded in the public records of 14 St. Lucie County. 15 16 17 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. 18 Lucie County, Florida: 19 20 CONDITIONAL USE PERMIT 21 22 A. Pursuant to Section 11.07.03 of the St. Lucie County Land Development Code, a 23 one year extension to an approved Conditional Use Permit for a concrete block 24 manufacturing plant; a Major Adjustment to a Conditional Use Permit extending 25 limited hours of operation to 24 (twenty four) hours per day for indoor 26 manufacturing operations and imposing approved hours of operation for truck 27 traffic to and from the facility to be 7:00 am through 5:00 pm seven (7) days a 28 week in the IH (Industrial, Heavy) Zoning District, located in St. Lucie County, 29 Florida, is hereby granted for the property described below: 30 31 LOT 13 OF THE PLAT OF "MIDWAY INDUSTRIAL PARK - PHASE 11I- 32 SOUTH", ACCORDING TO THE PLAT THEREOF AS RECORDED IN 33 PLAT BOOK 45 AT PAGE 40, PUBLIC RECORDS OF SAINT LUCIE 34 COUNTY, FLORIDA. 35 36 SAID LOT CONTAINING 323,787 SQUARE FEET OR 7.433 ACRES 37 MORE OR LESS. 38 39 SAID LOT SUBJECT TO ANY/ALL EASEMENTS, DEDICATIONS, 4 0 RESERVATIONS AND RESTRICTIONS. 41 42 Parcel No.: 3406-502-0008-0002 43 44 Location: Lot 13 of Midway Industrial Park, Phase III Subdivision. 45 July 15, 2008 File No.: CUMJ 720071278 Resolution No. 08-149 Page 3 1 2 3 B. 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 SITE PLAN Pursuant to Section 11,02.07 of the St. Lucie County Land Development Code, the site plan for the project known as Fort Pierce # 4, Lot 13 - for a concrete block manufacturing facility in Phase III of the Midway Industrial Park Subdivision is hereby granted as depicted on the minor site plan drawings for the project prepared by Corzo Castella Carballo Thompson Salman, P.A., dated October 18, 2006, and date stamped received by the St. Lucie County Growth Management Directoron March 31,2008, for the property described in "Paragraph A", subject to the following conditions: 1. Prior to the issuance of any permit, the petitioner, their successors or assigns shall comply with all the applicable conditions of the Resolution No. 01-138 granting Major Site Plan Approval for the project to be know as "Midway Industrial Park, Phase III Subdivision" in the IH (Industrial, Heavy) Zoning District for the property located in St. Lucie County, Florida, hereby incorporated herein. 2. The petitioner, their successors or assigns shall comply with all the applicable conditions of the St. Lucie County Noise Ordinance No. 06-021. Compliance with this ordinance shall be enforced by the Code Enforcement Division. 3. The concrete block manufacturing indoor operation is permitted for 24 (twenty four) hours a day and 7 (seven) days a week. The truck traffic to and from the facility is restricted to 7:00 am through 5:00 pm. Compliance with this condition shall be enforced by the Code Enforcement Division. 4. Pursuant to Conditions 4 and 5 of "Midway Industrial Park Phase III Subdivision" Resolution No. 01-138, this project has been determined to be the first (if approved) to apply for a building permit in this development. As such, if approved, the developer shall post a letter of credit or other form of security acceptable to the St. Lucie County Attorney, in an amount of $87,500 ofthe cost to provide for the signalization of the intersection of South Jenkins Road and West Midway Road prior to issuing a building permit. 5. No building permit for any portion of the "Midway Industrial Park, Phase III Subdivision" may be issued until contracts have been let for the construction of dedicated left turn lanes (north, south, east, and west) at the intersection of West Midway Road and Selvitz Road. The developer shall post a letter of credit or other form of security acceptable to the St. Lucie County Attorney, in an amou nt of $160,000 of the cost to secu re the construction of ded icated left tu rn lanes (north, south, east, and west) at the intersection of West Midway Road and Selvitz Road prior to issuing a building permits and Certificate of Occupancy. 6. Prior to the issuance of a building permit, the petitioner, their successors or assigns will require approval from the FPUA (Florida Pierce Utility Authorities) July 15, 2008 File No.: CUMJ 720071278 Resolution No. 08-149 Page 4 1 and the facility will be required to provide a wastewater process diagram. The 2 project may be subject to industrial pre-treatment requirements. The site 3 proposes a well for process water supply. The size and depth of the well may 4 create adverse impacts to existing users in areas. Additional data on well 5 characteristics should be provided to FPUA for review. 6 7 7. Prior to approval of a SLC Notice of Vegetation Removal, the applicant must 8 have performed caracara nesting tree surveys per FWS protocols and provided 9 survey results and methods to ERD. 10 11 8. Prior to approval of a Notice of Vegetation Removal, the applicant must provide 12 ERD with two SLC-approved and signed (executed) and recorded Conservation 13 Easements covering the following preserve areas: 1) Wetland K and its 14 associated upland buffer, and 2) the pre-treatment pond and its associated 15 upland buffer. The PAMP should also be referenced within the Conservation 16 Easement with the following language: "The Grantor agrees to maintain the 17 property in accordance with that certain Preserve Area Monitoring and 18 Management Plan dated [insert date of final approved PAMP version] which is 19 incorporated by reference into this easement". Please coordinate with the SLC 20 Legal Dept. and ERD staff on appropriate language for the two easements. 21 22 9. The applicant will comply with all state and federal agency regulations and 23 requirements. Prior to approval of a Notice of Vegetation Removal, the applicant 24 shall have obtained and provided ERD with copies of all required federal and 25 state permits. Iffederal or state agency compliance requires modification to the 26 development plans, the applicant will promptly modify the plans and submit to 27 SLC for review and approval as required by the LDC. The applicant will not use 28 the County's development approval to prevent compliance with any federal or 29 state agency requirements. 30 31 10. Prior to approval of a Notice of Vegetation Removal, the applicant shall provide 32 a final Preserve Area Monitoring and Management Plan. 33 34 35 36 37 38 39 40 C. 41 42 43 44 45 D. 11. Prior to approval of a Notice of Vegetation Removal, the applicant shall provide ERD with final construction plans showing the areas proposed for vegetation removal. Please be sure that these plans, once approved, are included in the set of construction drawings that are given to the site contractor(s) to work from per Section 6.00.05.8. The approvals and authorizations granted by this Resolution for the purpose of obtaining building permits on this property, shall expire on April 18, 2009, unless building permits have been issued or an extension in accordance with Section 11.07.05(F) of the St. Lucie County Land Development Code has been granted. The Certificate of Capacity, a copy of which is attached to this resolution, shall remain valid for the period of Conditional Use approval. Should the Conditional Use approval granted by this resolution expire or an extension be sought pursuant to Section 11.07.05(F) ofthe S1. Lucie County Land Development Code, a new certificate of capacity shall be required. The S1. Lucie County Growth Management Director is hereby authorized and directed to cause the notation of this resolution to be made on the Official Zoning Map of S1. Lucie County, Florida, and to make notation of reference to the date of adoption of this resolution.
