A RESOLUTION GRANTING A VARIANCE FOR
CERTAIN PROPERTY IN ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony
and evidence, including, but not limited to the staff report, has made the following
determinations:
1. Petition of Wade and Michelle Smith for a variance from the Provisions of Section
7.10.03(B) of the St. Lucie County Land Development Code to permit continued use
of a pole barn to house animals other than household domestic pets that encroaches
a maximum of 55 feet into the minimum one hundred (100) feet required from the
property line in the AR - 1 (Agricultural Residential- 1 du/1 ac) Zoning District.
2. On June 25, 2008, this Board of Adjustment held a public hearing on the petition,
after publishing a notice of such hearing and notifying by mail all owners of property
within 500 feet of the subject property. That public hearing was continued to the July
23,2008, meeting of the Board of July 23,2008.
3. On July 23, 2008, this Board of Adjustment held a public hearing on the petition.
After consideration of the testimony presented during the public hearing, including
staff comments and the standards of review for granting variances set out in Section
10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has
made the following determination:
a. The requested variance has met the standards of review as set forth in
Section 10.01.02, St. Lucie County Land Development Code and is not in
conflict with the goals, objectives, and policies of the St. Lucie County
Comprehensive Plan, because:
b. The variance granted is the minimum variance that will make possible the
reasonable use of the land, structure, orbuilding.
c. The variance granted will not have adverse impacts to other property or
improvements in the neighborhood.
d. The variance granted meets the general spirit and intent of the St. Lucie
County Land Development Code and the St. Lucie County Comprehensive
Plan.

1 NOW, THEREFORE, BE IT RESOLVED by the Board of Adjustment of St. Lucie County,
2 Florida:

4 A. Wade & Michelle Smith presented a petition for a variance from the Provisions of
5 Section 7.10.03(B) of the St. Lucie County Land Development Code to permit
6 continued use of a pole barn to house animals other than household domestic pets
7 that encroaches a maximum of 45 feet into the minimum one hundred (100) feet
8 required from the property line in the AR - 1 (Agricultural Residential - 1 du/1 ac)
9 Zoning District on property as described in Part B, subject to the following conditions:

11 1. The petitioners shall remove all doors from the pole barn forthwith.

13 2. The petitioners, their successors, or assigns shall not tether, or confine the
14 animals in the pole barn.

21 PLAT BOOK 1 AT PAGE 35, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY,
