LUCIE COUNTY 10 CODE OF ORDINANCES AND COMPILED LAWS 11 12 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and 13 evidence, including, but not limited to the staff report, has made the following determinations: 14 15 16 1. On August 2, 2005, the Board of County Commissioners adopted Ordinance Number 05-003, creating 17 Chapter 1-10.2 of the St. Lucie County Code and Compiled Laws, known as the "Historic Preservation 18 Ordinance". 19 20 2. On February 26,2007 the African American Historical Association of St. Lucie County, Inc., a historic 21 organization, petitioned that the home at 4955 Indian River Drive, Fort Pierce, Florida 34982 be 22 designated as a historic structure (site). 23 24 3. On March 17,2008, a certified letter and the Historical Designation Recommendation Report prepared 25 by the Historic Preservation Officer was sent to the owners of the property Mr. and Mrs. James Wika. 26 27 4. On April 2, 2008, Growth Management received verification that James Wika signed for the letter and 28 package on May 31, 2008. 29 30 5. On April 21, 2008, the St. Lucie County Historical Commission held a public hearing on the petition, 31 after publishing notice at least 15 days prior to the hearing and notifying by mail all owners of property 32 within 150 feet of the subject property. The commission voted unanimously to continue this item to May 33 19,2008 at 5:00 p.m. or as soon thereafter. 34 35 6. On May 19, 2008, the Historical Commission held a public hearing on the petition, voting unanimously 36 to recommend the Board of County Commissioners approve the proposed designation and that the 37 property be considered an exceptional historic resource. 38 39 7. On August 12, 2008, this Board held a public hearing on the petition, after publishing a notice of such 40 hearing and notifying by mail all owners of property within 150 feet of the subject property. Through his 41 attorney, the property owner appeared before the Board at the public hearing. 42 43 8. Based on the evidence presented at the public hearing, the Board has determined, this property meets 44 the criteria for an Resource of Exceptional Importance as defined in Subsection 1-10.2-3(18) of the St. 45 Lucie County Code and Compiled Laws, known as the Historic Preservation Ordinance. 46 47 9. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 1-10.2-14 of the St. Lucie County Code of Ordinances, the property on which this Designation as a Resource of Exceptional Importance is being approved is described as follows: That certain portion of Lot 1 of J. ALBERT FISHER property, as in Plat Book 4, Page 92 and being that part of the South 10 acres of Government Lot 2, Section 36, Township 35 South, Range 40 East, lying East of the FEC Railway, said portion being more particularly described as follows: Commencing at the Point of the Intersection of the Dixie Highway with the Southerly boundary line of said Lot 2; thence running in a Northerly direction by and with the Westerly said of Dixie Highway 179.5 feet; thence running in a Westerly direction parallel with the Northerly boundary line of said Lot 2, a distance of 258.8 feet to a point 50 feet Easterly from a point on the Westerly boundary line of said Lot 2, which said latter point is 50 feet Southerly from the Northwest corner of Lot 2; thence Southerly parallel with the Westerly boundary line of Lot 2; a distance of 175.7 feet to the Southerly boundary line of Lot 2; thence running Easterly by and with said boundary line of Lot 2, a distance of 261.5 feet to Dixie Highway, the original point of beginning. Also, all of that part of said Lot 2, lying Easterly of said Dixie Highway and Southerly from a line beginning at a pointon the Westerly boundary of said Dixie Highway 179.5 feet Northerly along said Westerly boundary form the Southerly boundary of said Lot 2, and run thence Easterly parallel with the Northerly boundary of said Lot 2, to the Indian River; TOGETHER WITH all submerged, riparian and littoral rights. LESS AND EXCEPT: Special Warranty Deed (2/28/61) - O.R. Book 5, Page 294 - Rubi G Jackson, a widow to State of Florida for the use and benefit of the State Road Department of Florida; and LESS AND EXCEPT: That part of Lot 2, excepting therefrom the West 50 feet as measured along the South line of said Lot 2, of J. ALBERT FISHER's property, according to the Plat thereof, as recorded in Plat Book 4, Page 92, public records of St. Lucie County, Florida; lying within 33 feet of the South line of Section 36, baseline of survey, according to the right-of-way map of Section 945302151, State Road S-712, filed in the Office of the Clerk of the Circuit Court, St. Lucie County, Florida, containing 0.15 of an acres, more or less.
