LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. Leslie Schneider. presented a petition for a Variance from the Provisions of Section 7.04.01 (Table 7-10) of the St. Lucie County Land Development Code, to permit the construction of a new swimming pool with screen enclosure that encroaches a maximum of 4.47 feet into the minimum rear setback of 15 feet required in the RS-3 (Residential, Single family- 3du/acre) Zoning District, for the property depicted on the attached maps as Exhibit "A" and described below. 2. On August 27,2008, this Board of Adjustment held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. 3. After consideration of the testimony presented during the public hearing, including staff comments and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determination: The requested variance has met the standards of review as set forth in Section 10.01.02, Sf. Lucie County Land Development Code and is not in conflict with the goals, objectives, and policies of the Sf. Lucie County Comprehensive Plan, because: 1. The variance granted is the mmlmum variance that will make possible the reasonable use of the land, structure, or building. 2. The variance granted will not have adverse impacts to other property or improvements in the neighborhood. 3. The variance granted meets the general spirit and intent of the St. Lucie County Land Development Code and the Sf. Lucie County Comprehensive Plan. EDWIN M. B. The property on which this variance is being granted is described as follows: LOT 45, 46, 47 & S. 8.11 FEET OF 48, ORANGE GROVE PARK ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 5, PAGE 46 OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. (TaxID#: 3409-501-0045-000/9) (Location: 5513 Davis Street, Fort Pierce) C. This variance shall expire twelve months from the date of adoption unless a building permit is approved or an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code. II : 500ft, notifIcation area .... /t): J!Jf13 7; hahce" Ptv6// c tJO(~~ RESOLUTION NO, 08- 216 WHEREAS, subsequent to the adoption of the St. Lucie County Board of County Commissioners budget for St. Lucie County, certain funds not anticipated at the time of adoption of the budget have become available from the State of Florida Department of Transportation in the amount of $350,000 for the Traffic Control Signal System. WHEREAS, Section 129.06 (d), Florida Statutes, requires the Board of County Commissioners to adopt a resolution to appropriate and expend such funds. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida, in meeting assembled this 2nd day of September, 2008, pursuant to Section 129.06 (d), Florida Statutes, that such funds are hereby appropriated for the fiscal year 2007-2008, and the County's budget is hereby amended as follows: REVENUE 101219-4109-334411-400 FDOT -Transportation $350,000 APPROPRIATIONS 101219-4109-553110-400 101219-4109-599330-400 Traffic Signal Maint & Installation Project Reserves $200,000 $150,000 After motion and second the vote on this resolution was as follows: Commissioner Joseph E.
