LUCIE COUNTY, 10 FLORIDA, AT NO COST; APPROVING THE WAIVER OF THE APPLICATION 11 FEE; SUBJECT TO SATISFACTION OF CERTAIN REQUIREMENTS; 12 PROVIDING AN EFFECTIVE DATE. 13 14 WHEREAS, pursuant to a request from the applicant, St. Lucie County, the 15 District has determined that it is in the public interest to surplus and convey a parcel 16 of land located in the C-25 Project containing 0.29 acres, more or less, identified as 17 Lot 4, Block P, Harmony Heights Addition, Plat Book 8, Page 38, Section 31, 18 Township 34 South, Range 40 East, to construct a retention pond as part of a county 19 stormwater improvement project, subject to the satisfaction of certain requirements; 20 and 21 WHEREAS, upon the satisfaction of certain terms, conditions and 22 requirements, the Governing Board has determined that the 0.29+/- acre parcel to. 23 be conveyed is not required by the District for present or future use; and 24 WHEREAS, the applicant has requested that the District waive the $1,000.00 25 application fee and that the parcel be conveyed at no cost; and 26 WHEREAS, pursuant to Section 373.056(4} of the Florida Statutes, any water 27 management district may convey to any governmental entity land or rights in land 28 owned by such district not required for its purposes under such terms and conditions 29 as the governing board may determine. 30 NOWTHEREFORE, BE IT RESOLVED by the Governing Board of the South 31 Florida Water Management District: 32 Section 1: The Governing Board of the South Florida Water Management District 33 has determined thatthe District has no present or apparent future use for the subject 34 interest to be surplused and conveyed, and therefore hereby approves conveying to 1 W:\Gb\GB - 2008\September 2008\ca_lr _101Jd.doc 8/20/2008 9:20 AM / 35 81. Lucie County the subject 0.29 acres, more or less. located in the C,..25 Project 36 and more particularly described as Lot 4, Block P, Harmony Heights Addition, Plat 37 Book 8, page 38, Section 31, Township 34 South, Range 40 East, S1. Lucie County, 38 Florida, at no cost, provided all of the following terms, conditions, and requirements 39 are satisfied tethe satisfaction of the District. in its sole and absolute discretion: 40 a. S1. Lucie County shall insure that the Fort Pierce Farms Water Control 41 District (FPFWCD) is aware of the intended use of this parcel. 42 b. St. Lucie County shall pay all costs associated with this surplus and 43 conveyance. 44 c. S1. Lucie County shall, at its sole cost and expense, comply with all 45 applicable subdivision/platting ordinances, laws and regulations applicable to 46 the proposed transaction. 47 d. S1. Lucie County shall obtain all necessary permits from the District, 48 and any other governmental agencies, jf any, and pay all associated fees. 49. e. All of .the foregoing terms, conditions and requirements shall be 50 satisfied to the District's satisfaction, in the District's sole and absolute 51 discretion, no later than September 1, 2010. 52 Section 2: The Governing Board of the South Florida Water Management District 53 hereby declares that there is no representation, guaranty or assurance made by the 54 District thc:t the District's Governing Board will in fact approve the issuance of any 55 required District permits, and there is no. obligation on the part of the District's 56 Governing Board to approve the issuance of any required District permits. The 57 District's review process for any required permits will be done separate, independent 58 and unfettered of the fact that the District has approved this Resolution and shall be 59 in accordance with the District's applicable rules. 60 Section 3: The Governing Board of the South Florida Water Management District 61 hereby authorizes the Chairman to execute the conveyance docume-nt upon 62 satisfaction of all of the foregoing terms, conditions and requirements to the 63 satisfaction of the District in its sole and absolute discretion. No conveyance 64 instrument shall be delivered to S1. The Board hereby waives the $1,000.00 application fee. Furthermore, such conveyance will not be effective until it has been recorded in the Public Records of St. Lucie County, Florida.
