HomeMy WebLinkAbout08-314 11' , RESOLUTION NO. 08-314 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA, DECLARING THE ACQUISITION OF REAL PROPERTY TO BE NECESSARY FOR PUBLIC USE AND FOR THE COUNTY PURPOSE OF CLEARING THE LINE OF SIGHT FROM THE AIR TRAFFIC CONTROL TOWER TO NEW RUNWAY 91/27R AND TO PROVIDE ADDITIONAL SECURITY AND SAFETY AT THE ST. LUCIE COUNTY INTERNATIONAL AIRPORT WITHIN THE COUNTY; AUTHORIZING THE ACQUISITION OF SAID PROPERTY BY DONATION, PURCHASE OR EMINENT DOMAIN; AND, PROVIDING AN EFFECTIVE DATE. WHEREAS, the County is responsible for providing and operating air terminals and public transportation systems within the County; and, WHEREAS, the Board has previously adopted the St. Lucie County International Airport Master Plan; WHEREAS, the County has been delegated the power of eminent domain by Chapters 73 and 74 and SS 125.01(1) and 127.01(1) of the Florida Statutes to acquire property for and to provide air terminals and public trcmsportation systems within the County; and, WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, hereby determines that the County's acquisition of fee simple titles to the properties described in the attached exhibit is necessary for the public and County purpose of providing air terminals and public transportation systems, providing a clear line of sight to the Air Traffic Control Tower, additional security and safety consistent with the approved Master Plan and fQr the general welfare of the County and its inhabitants; and, WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, desires to authorize and approve the County's acquisition of the fee simple titles to the property set forth in the attached exhibit, by donation, purchase or eminent domain; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF ST. LUCIE COUNTY, FLORIDA, THAT: Section 1: this reference. The above recitals are true, correct, ratified and hereby adopted by Section 2: The Board of County Commissioners of St. Lucie County, Florida, hereby authorizes the acquisition of the estates in the property set forth in the attached exhibit by donation, purchase or eminent domain. ,~ . Section 3: The County Attorney is authorized and directed to employ one or more real estate appraisers and such other experts as he determines to be appropriate to secure at least one current appraisal of value of the property described above for the purpose of acquiring said property. Section 4: The County Attorney is hereby authorized and directed to proceed to take all necessary steps for St. Lucie County to acquire in its own name by donation, purchase or eminent domain proceedings, the estates in the real property described above and to prepare in the name of St. Lucie County all papers, pleadings and other instruments required for that purpose and to prosecute all eminent domain proceedings to judgment pursuant to Chapters 73 and 74, Florida Statutes. Section 5: The County Attorney and County Administrator are hereby authorized and directed to take such further actions as are reasonably required to fully accomplish the purposes herein directed.
