AN ORDER GAANTING APPROVAL FOR A MINOR SITE PLAN
TO BE KNOWN AS KING'S CROSSING PARK OF COMMERCE
SUBDIVISION CONSISTING OF SIX (6) INDUSTRIAL LOTS FOR
CERTAIN PROPERTY LOCATED ON THE NORTHWEST
CORNER OF THE INTERSECTION OF NORTH KINGS HIGHWAY
(SR 713) AND INTERSTATE 95 IN _ ST. LUCIE COUNTY,
FLORIDA.
WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for
site plan approval submitted by Culpepper & Terpening, Inc., reviewed the comments of the St.
Lucie. County Development Review Committee on this application, and made the following
determinations:
1. Kellv Tractor Co throuah aaent Culpepper & Terpenina, Inc. has applied for a Minor
Site Plan approval for a six (6) lot industrial subdivision for a project to be known as
the King's Crossing Park of Commerce Subdivision on a 41.5 (mol) acre parcel of
land located on the northwest corner of the intersection of North K.ings Highway (SR
713) and Interstate 95 in the IL (Industrial, light) Zoning District for the property
described in Part 8 below.
2. On, October 4, 2002, the Growth Management Director approved Administrative
Order CD-02-020 granting approval to a Minor Site Plan to be known as King's
Crossing Park of Commerce for an eight (8) lot industrial subdivision.
3. On, October 4, 2004, Administrative Order CD-02-020 expired prior to the recording
the final plat for the King's Crossing Park of Commerce resulting in the need for a
new site plan approval to be obtained prior to the recording of any final plats effecting
the property described in Part 8 below.
4. In September 2006, a new application for Minor Site Plan approval for the King's
Crossing Park of Commerce was filed with the St. Lucie County Growth Management
Department and reviewed by the Development Review Committee.
5. The Development Review Committee has reviewed the site plan for the proposed
project and found it to meet technical requirements of the Land Development Code
and to be consistent with the St. Lucie County Comprehensive Plan.
6. The project is consistent with the general purpose, goals, objectives, and standards
of the St. Lucie County Comprehensive Plan and the St. Lucie County Land
Development Code.
7. The project will not have an undue adverse effect on adjacent property, the character

of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.
8. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping,
and screening.
9. The project will be constructed, arranged, and operated so as not to interfere with the
development and use of neighboring property, in accordance with applicable district
regulations.
10. The project is to be served by adequate public facmties and services.
11. The applicant has applied for and received a certificate of capacity, a copy of which is
attached to this order as Exhibit A, as required under Chapter V, St. Lucie County
Land Development Code.
NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the
proposed Minor Site Plan to be known as King's Crossing Park of Commerce, is hereby
approved as shown on the site plan drawings for the project prepared by Culpepper &
Terpening, Inc., dated February 7, 2007, and date stamped received by the St. Lucie
County Growth Management Department on November 12, 2008, on the property
described below, subject to the following conditions:
1. Prior to issuance of any building permits for any lot within the King's Crossing
Park of Commerce, the petitioner, their successors or assigns, shall convey
to St. Lucie County, in manner and form acceptable to the St. Lucie County
Attorney, the east 2.37 acres of the parcel for the future widening of Kings
Highway. To the extent permitted under the County's Code and Compiled
Laws, any such dedication may be considered eligible for Road Impact Fee
Credits.
2. Prior to the issuance of any building permits on any of the lots within the area
referred to as the King's Crossing Park of Commerce Site Plan, the
developer, his successors or assign to that property shall be required to
submit a complete site plan for review and approval, regardless ofthe size of
the project. Each site plan shall be prepared in accordance with the
requirements set forth in Section 11.02.00 of the St. Lucie County Land
Development Code. Each individual site plan submittal shall be required to
provide a traffic impact report, prepared by a professional engineer
registered in the State of Florida and with demonstrated familiarity with traffic
planning practices, the purpose of which is to provide for a cumulative impact
review of the developments traffic impacts. Unless the proposed use of the
property requires review and processing as a conditional use, all
development reviews, regardless of project size, shall be processed
consistent with the Site Plan Review process. Should a conditional use

permit be required, the appropriate process shall be adhered to.
The property on which this Minor Site Plan approval is being granted is described as
follows:

ROAD AND DRAINAGE CANAL, ST. LUCIE COUNTY, FLORIDA.
THAT PART OF THE SOUTH % OF THE SOUTHEA T %. OF THE SOUTHEAST Y4 OF
SECTION 2, TOWNSHIP 35 SOUTH, RANGE 39 EAST, LYING NORTHERLY OF

C. The approvals and authorizations granted by this Growth Management Order for obtaining
building permits on the property described in Part B above, shall expire on November 5,
2010, unless the developer has obtained a building permit for the Minor Site Plan as
described in Part A or an extension has been granted in accordance with the provisions of
Section 11.02.06 of the St Lucie County Land Development Code.
D. The Final Site Plan approval granted under this Growth Management Order is specifically
conditioned to the requirement that the petitioner, Kelly Tractor Co, including any
successors in interest, shall obtain all necessary development permits and construction
authorizations from the appropriate State and Federal regulatory authorities including, but
not limited to; the United States Army Corps of Engineers, the Florida Department of
Environmental Protection, and the South Florida Water Management District, prior to the
issuance of any local building permits of authorizations to commence development
activities on the property described in Part B.
E. A copy of this Order shall be attached to the site plan drawings described in Part A, which
plan shan be placed on file with the St Lucie County Growth Management Director and
mailed, return receipt requested to the developer and agent of record as identified on the
site plan applications.
F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as this
order. If this order expires or otherwise terminates, the Certificate of Capacity shall
automatically terminate.
G. The Code Compliance Manager shall receive a copy of this Development Order and the

site plan it approves and shall not approve any building permits that do not implement or
are not consistent with this Development Order and the plans hereby approved.
H. This order shall be recorded in the Public Records of St. Lucie County.
