HomeMy WebLinkAboutGM-08-005 - Donahue Warehouse 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 GM 08-005 FILE NO.: MNSP-1020071345 AN ORDER OF THE GROWTH MANAGEMENT DIRECTOR OF ST LUCIE COUNTY GRANTING MINOR SITE PLAN APPROVAL FOR A PROJECT KNOWN AS DONAHUE WAREHOUSE FOR A 3,957 SQUARE FOOT ADDITION TO THE EXISTING 5,536.5 SQUARE FOOT BUILDING AT 7502 COMMERCIAL CIRCLE, FORT PIERCE, FLORIDA, LOCATED ST LUCIE COUNTY. WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for site plan approval submitted by Denuzzio Hopkins & Associates, reviewed the comments of the St. Lucie County Development Review Committee on this application, and made the following determinations: 1. Richard Donahue, through agent Denuzzio Hopkins & Associates, has applied for Minor Site Plan approval for the project known as Donahue Warehouse, located at 7502 Commercial Circle, approximately 1,000 feet east of Kings Highway and 500 feet north of Angle Road, within the Kings Highway Industrial Park in Fort Pierce. The project consists of a 3,957 square foot addition to the northern portion of an existing 5,536.5 square foot warehouse for a total building size of 9,493.5 square feet, to expand its use of an industrial warehouse for the assembling, shipping, and storing of materials. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet minimum technical requirements of the St. Lucie County Land Development Code and to be consistent with the Future Land Use Map of the St. Lucie County Comprehensive Plan. 3. The proposed project is consistent with the general purpose, goals, objectives and standards of review of the Land Development Code and Comprehensive Plan of St. Lucie County. 4. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety and general welfare. 5. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping, and screening. 6. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. The proposed project will be served by adequate public facilities and services. 8. The King's Highway Industrial Park, where in Donahue Warehouse is located, is considered to be vested for concurrency pursuant to Section 5.03.00 of the St Lucie County Land Development Code. Therefore the project is considered to have met the minimum standards of Chapter V and a Certificate of Capacity Exemption has been issued, which is attached to this order as Exhibit A. NOW, THEREFORE, BE IT ORDERED: A. Pursuant to Section 11.02.03 of the St. Lucie County Land Development Code, the proposed Minor Site Plan for the project known as Donahue Warehouse, is hereby approved as depicted on the site plan drawings for the project prepared by Denuzzio Hopkins & Associates, dated November 10, 2008 and date stamped received by the St. Lucie County Growth Management Director on November 12, 2008, for the property described below, subject to the following conditions: 1. Prior to the issuance of any building permits or vegetation removal permits for any portion of Donahue Warehouse, the developer, his successor or assigns shall submit Landscape Plans indicating procedures to remove all invasive exotics from the site, and prior to landscape inspection sign-off by the Environmental Resources Department, all Florida Exotic Pest Plant Council (FLEPPC) Category I listed species must be eradicated from the site. 2. Prior to issuance of any building permits or vegetation removal permits for any portion of Donahue Warehouse, the developers, their successor or assigns shall submit to the St. Lucie County Surveyor a fee in lieu of construction of a concrete sidewalk for the length of the parcel abutting Commercial Circle. An agreement for cost may be reached by submitting two signed and sealed sets of the engineer's estimate of probable cost utilizing a unit cost of $39.22 square yard plus 10% for mobilization and clearing. B. The property on which this Minor Site Plan approval is being granted is described as follows: LEGAL DESCRIPTION: KINGS HIGHWAY INDUSTRIAL PARK - UNIT ONE- BLOCK B, LOT 3, AS DESCRIBED IN OFFICIAL RECORDS BOOK 1198, PAGE 2935, ACCORDING TO THE PLAT THEREOF, AS RECORDED IN PLAT BOOK 26, PAGE 16 AND 16A, OF THE PUBLIC RECORDS OF ST. LUCIE COUNTY, FLORIDA. PROPERTY TAX I.D. #: 1335-801-0020-000/7 LOCATION: 7502 Commercial Circle C. The approvals and authorizations granted by this Growth Management Order for obtaining building permits on the property described in Part B above, shall expire on November 13, 2010, unless the developer has obtained a building permit for the Minor Site Plan as described in Part A or an extension has been granted in accordance with the provisions of Section 11.02.06 of the St. Lucie County Land Development Code. The Final Site Plan approval granted under this Growth Management Order is specifically conditioned to the requirement that the petitioner, Richard Donahue, including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities including, but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. E. A copy of this Order shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director and mailed, return receipt requested to the developer and agent of record as identified on the site plan applications. F. The Certificate of Capacity Exemption, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the Certificate of Capacity Exemption shall automatically terminate. G. The Code Compliance Manager shall receive a copy of this Development Order and the site plan it approves and shall not approve any building permits that do not implement or are not consistent with this Development Order and the plans hereby approved.
