7 APPROVAL FOR THE PROJECT TO BE KNOWN AS
8 KELLY TRACTOR, LOT 6, CONSISTING OF 28,659
9 SQUARE FEET OF BUILDINGS SITUATE IN ST. LUCIE
1 0 COUNTY, FLORIDA

12 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
13 testimony and evidence, including, but not limited to the staff report, has made the following
14 determinations:
15
16 1. The petition of Kellv Tractor Co. throuClh aClent Culpeper & TerpeninCl. Inc. for Major
17 Site Plan approval for the project to be known as Kelly Tractor, Lot 6 consisting of
18 28,659 square feet of total building square footage which include a truck well, wash
19 bay and heavy equipment dealership sales, maintenance, and loffice building for 11
20 acres of property located on the northwest corner of the intersection of Kings
21 Highway (SR 713) and Interstate 95 in the IL (Industrial, Light) Zoning District, as
22 described in Part B.

24 2. The Development Review Committee has reviewed the site plan for the proposed
25 project and found it to meet minimum technical requirements of the St. Lucie County
2 6 Land Development Code and to be consistent with the future land use maps from
27 the St. Lucie County Comprehensive Plan.

29 3. The proposed project is consistent with the general purpose, goals, objectives, and
30 standards of review of the St. Lucie County Land Development Code, the St. Lucie
31 County Comprehensive Plan, and the Code of Ordinances of St. Lucie County.

33 4. The proposed project will not have an undue adverse effect on adjacent property, the
34 character of the neighborhood, traffic conditions, parking, utility facilities, or other
35 matters affecting the public health, safety, and general welfare.

37 5. All reasonable steps have been taken to minimize any adverse effect of the
38 proposed project on the immediate vicinity through building design, site design,
39 landscaping and screening.

41 6. The proposed project will be constructed, arranged and operated so as not to
42 interfere with the development and use of neighboring property, in accordance with
43 applicable district regulations.

7. The proposed project will be served by adequate public facilities and services.
8. The applicant has applied for and received a certificate of capacity, a copy of which
is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County
Land Development Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the site
plan for the project known as Kelly Tractor, Lot 6, is hereby approved as shown on the
site plan drawings for the project prepared by Culpepper & Terpening, Inc., dated, March
6, 2007, and date stamped received by the St. Lucie County Growth Management
Director on November 12, 2008, for the property described below, subject to the
following conditions:
1. Pursuant to Section 11.02.08(B)(6) of the St. Lucie County Land
Development Code, no work shall commence on the site until all regulatory
permits required from Federal, State, and regional agencies and special
districts have been issued. The Florida Department of Environmental
Protection, National Pollutant Discharge and Elimination System compliance
notice must be submitted to the County Engineer with the constructible
engineering plans at the time of building permit application or during permit
review or no paving, grading, and drainage permit and no building permit
shall be issued. All National Pollutant Discharge and Elimination System
Best Management Practices shall be instituted on the site prior to site
clearing and maintained daily. Stormwater ponds shall be roughed in at the
same time the site is cleared of groundcover.
2. The applicant will comply with all state and federal agency regulations and
requirements. Prior to approval of a Notice of Vegetation Removal, the
applicant shall have obtained and provided ERD with copies of all required
federal and state permits, including, but not limited to a SFWMD Water Use
Permit. If federal or state agency compliance requires modification to the
approved development plan, the applicant will promptly modify the plans and
submit to SLC for review and approval as required by the LDC. The
applicant will not use the County's development approval to prevent
compliance with any federal or state agency requirements.
3. Prior to the approval of a Notice of Vegetation Removal or Exemption, the
applicant shall finalize an improvement agreement acceptable to ERD
covering the cost of landscaping and tree mitigation.

The approvals and authorizations granted by this Resolution for the purpose of obtaining
building permits on this property, shall expire on November 25, 2010, unless the
developer has obtained building permits for the site plan described in Part A or an
extension has been granted in accordance with Section 11.02.06, St. Lucie County Land
Development Code.
The Final Site Plan approval granted under this resolution is specifically conditioned to
the requirement that the petitioner, Kelly Tractor, Co., including any successors in
interest, shall obtain all necessary development permits and construction authorizations
from the appropriate State and Federal regulatory authorities, including but not limited to;
the United States Army Corps of Engineers, the Florida Department of Environmental
Protection, and the South Florida Water Management District, prior to the issuance of
any local building permits of authorizations to commence development activities on the
property described in Part B.
A copy of this resolution shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Growth Management
Director.
The certificate of capacity, attached as Exhibit A, shall be valid for the same period as
this order. If this order expires or otherwise terminates, the certificate of capacity shall
automatically terminate.
The Code Compliance Manager shall receive a copy of this Development Order and the
site plan it approves and shall not approve any building permits that do not implement or
are not consistent with this Development Order and the plans hereby approved.
A copy of this Development Order shall be mailed, return receipt requested to the
developer and agent of record as identified on the site plan applications.
This Development Order shall be recorded in the Public Records of St. Lucie County, Florida, in
order to provide constructive legal notice of development conditions that run with the land.
