A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS GRANTING
HOSPICE FOUNDATION OF MARTIN & ST. LUCIE, INC. A CONDITIONAL USE
PERMIT TO ALLOW MEDICAL & HEALTH SERVICES AND SOCIAL SERVICES
AND MAJOR SITE PLAN APPROVAL FOR THE PROJECT TO BE KNOWN AS
TREASURE COAST HOSPICES COUNSELING SERVICE CENTER IN THE I
(INSTITUTIONAL) ZONING DISTRICT FOR CERTAIN PROPERTY LOCATED IN
ST. LUCIE COUNTY, FLORIDA
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the
testimony and evidence, including but not limited to the staff report, has made the following
determinations:
1. Hospice Foundation of Martin & St. Lucie. Inc., presented a petition for a Conditional Use
Permit and Major Site Plan Approval to allow for the Treasure Coast Hospices Counseling
Service Center in the I (Institutional) Zoning District for the property depicted on the
attached map in Exhibit "A" and described in Part B below.
2. On, February 14,2006, the Growth Management Director granted approval through GM
Order 06-009, for a Minor Site Plan to be known as Hospice of the Treasure Coast to
construct a 15,553 square foot facility at 5090 Dunn Road.
3. On October 16, 2008, the St. Lucie County Planning and Zoning Commission held a public
hearing on the petition, after publishing notice at least 10 days prior to the hearing and
notifying by mail all owners of property within 500 feet of the subject property, and
recommended that the Board of County Commissioners approve the hereinafter described
request for a Conditional Use Permit and Major Site Plan Approval in the I (Institutional)
Zoning District for the property described in Part B.
4. On December 2, 2008, this Board held a public hearing on the petition, after publishing a
notice of such hearing and notifying by mail all owners of property within 500 feet of the
subject property.
5. The proposed Conditional Use Permit, with the conditions therein, is consistent with the
goals, objectives and policies of the St. Lucie County Comprehensive Plan and has
satisfied the requirements of Section 11.07.03 of the St. Lucie County Land Development
Code.
6. With the proposed conditions, the project will not have an undue adverse effect on
adjacent property, the character of the neighborhood, traffic conditions, parking, utility
facilities, or other matters affecting the public health, safety and general welfare.
7. The proposed project will be served by the City of Port St. Lucie Utility Systems water and
sewer service.

8. The applicant has received a Certificate of Capacity, a copy of which is attached to this
order as Exhibit "B", as required under Chapter V, St. Lucie County Land Development
Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie
County, Florida:
A. Pursuant to Section 11.07.03 and Section 11.02.07 of the St. Lucie County Land
Development Code, a Conditional Use Permit and the Major Site Plan known as Treasure
Coast Hospices Counseling Service Center is hereby approved as depicted on the site
plan drawings for the project prepared by Friscia Engineering, dated December 1, 2006,
subsequently revised through September 05, 2008, and date stamped received by the St.
Lucie County Growth Management Director on October 01, 2008, is hereby approved
subject to the following conditions:
1. Pursuant to Section 11.02.08(A)(6) of the St. Lucie County Land
Development Code, no work shall commence on the site until all regulatory
permits required from Federal, State, and regional agencies and special
districts have been issued. The Florida Department of Environmental
Protection, National Pollutant Discharge and Elimination System
compliance notice must be submitted to the County Engineer with the
constructible site plan at the time of building permit application or during
permit review or no paving, grading, and drainage permit and no building
permit shall be issued. All National Pollutant Discharge and Elimination
System Best Management Practices shall be instituted on the site prior to
site clearing and maintained daily. Stormwater ponds shall be roughed in
at the same time the site is cleared of groundcover.
2. This Development Order shall be recorded in the Public Records of St.
Lucie County, Florida, in order to provide constructive legal notice of
development conditions that run with the land.
3. The Code Compliance Manager shall receive a copy of this Development
Order and the site plan it approves and shall not approve any building
permits that do not implement or are not consistent with this Development
Order and the plans hereby approved.
4. Prior to the issuance of the first building permit the Road Impact Fees shall
be collected and shall be assigned to a specific finance account for the
future improvements for Midway Road.
5. Prior to issuance of a St. Lucie County Vegetation Removal Permit or
Exemption a tree preservation plan detailing proper root pruning
techniques, must be submitted if necessary, and a pre-construction
meeting with Environmental Resource Department is required.

6. Prior to approval of a Notice of Vegetation Removal or Exemption the
applicant, developer, or assignee shall execute an improvement agreement
for all required landscaping and tree mitigation, including on-site and off-
site preservation and/or relocation acceptable to Environmental Resource
Department.
7. Previous approval granted under GM Order 06-009, together with all
conditions of approval, are still in full force and effect and are hereby
consolidated and incorporated herein.
The subject property is described as follows:

THE SOUTH 2.00 ACRES OF LOT 101, WHITE CITY SUBDIVISION, ACCORDING TO
THE PLAT THEROF AS RECORDED IN PLAT BOOK 1, PAGE 23, PUBLIC RECORDS
OF ST. LUCIE COUNTY, FLORIDA. SAID LANDS LYING WESTERLY OF DRAINAGE
DITCH NO. 103 AND LESS ROAD RIGHT OF WAY.
PARCEL NO.2
LOT 101, WHITE CITY SUBDIVISION, ACCORDING TO THE PLAT THEREOF AS
RECORDED IN PLAT BOOK 1, PAGE 23, PUBLIC RECORDS OF ST LUCIE COUNTY,
FLORIDA, LESS THAT PROTION THEREOF DESCRIBED IN DEED RECORDED IN
OFFICIAL RECORDS BOOK 521, PAGE 653 AND EXCEPTING ALL RIGHT -OF WAY
FOR PUBLIC ROADS AND DRAINAGE CANALS AND ALSO EXVCEPTING
THERFROM ALL THAT OF LOT 1 01 LYING EAST OF DRAINAGE CANAL NO.1 03.
CONTAINING 5.58 ACRES (Property Tax ID# 3403-502-0194-000/3)
The approvals and authorizations granted by this Resolution are for the purpose of
obtaining a Building Permit or Zoning Compliance from St. Lucie County, and are not
assigned to any other party or institution. Should the petitioners choose or decide to assign
this business to another entity or individual, a major adjustment to the conditional use
permit shall be required.
The approvals and authorizations granted by this Resolution shall expire on December 2,
2009, unless a Building Permit or Certificate of Zoning Compliance for is obtained for the
uses described in Part A above, or an extension has been granted in accordance with
Section 11.07.05(F), St. Lucie County Land Development Code.
The Certificate of Capacity, a copy of which is attached to this resolution, shall remain valid
for the period of Conditional Use approval. Should the Conditional Use approval granted
by this resolution expire or an extension be sought pursuant to Section 11.07.05(F) of the
St. Lucie County Land Development Code, a new certificate of capacity shall be required.

F. The St. Lucie County Growth Management Department Director is hereby authorized and
directed to cause the notation of this resolution to be made on the Official Zoning Map of
St. Lucie County, Florida, and to make the notation of reference to the date of adoption of
this resolution.
