LUCIE COUNTY GRANTING GUADAMONTE, INC., MAJOR SITE PLAN APPROVAL FOR THE PROJECT TO BE KNOWN AS MARTIN OFFICE BUILDING, CONSISTING OF 32,000 SQUARE FEET OF BUILDING FOR A FOUR STORY COMMERCIAL OFFICE BUILDING SITUATE IN ST. LUCIE COUNTY, FLORIDA WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: 1. The petition of Guadamonte. Inc.. represented bv Francisco Martin. for Major Site Plan approval for the project to be known as Martin Office Building consisting of a 32,000 square foot, four story commercial office building, for property located on the north side of St. Lucie Boulevard, approximately 500 feet west of the intersection of Hammond Road and St. Lucie Boulevard in the CG (Commercial, General) Zoning District for th~ property described in Part B. 2. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet minimum technical requirements of the St. Lucie County Land Development Code and to be consistent with the future land use maps from the St. Lucie County Comprehensive Plan. 3. On December 2, 2008 the St. Lucie County Board of County Commissioners held a public hearing, of which due public notice was published and mailed to all property owners within 500 feet at least 10 days prior to the hearing, and granted Final Site Plan approval for the project to be known as Martin Office Building. 4. The proposed project is consistent with the general purpose, goals, objectives, and standards of review of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan, and the Code of Ordinances of St. Lucie County. 5. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 6. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 8. The proposed project will be served by adequate public facilities and services. 9. The applicant has applied for and received a certificate of capacity, a copy of which is attached to this order as Exhibit A, as required under Chapter V, St. Lucie County Land Development Code. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the site plan for the project known as Martin Office Building, is hereby approved as shown on the site plan drawings for the project prepared by MBV Engineering, Inc., dated, February 2007, and date stamped received by the St. Lucie County Growth Management Director on October 10, 2008, for the property described below, subject to the following conditions: 1. No clearing or other site work shall commence until after constructible engineering plans have been approved by the County Engineer and all county environmental permits have been issued by Environmental Resources Department pursuant to Section 11.02.08(B)(8) of the St. Lucie County Land Development Code. 2. Pursuant to Section 11.02.08(B)(6) of the St. Lucie County Land Development Code, no work shall commence on the site until all regulatory permits required from Federal, State, and regional agencies and special districts have been issued. The Florida Department of Environmental Protection, National Pollutant Discharge and Elimination System compliance notice must be submitted to the County Engineer with the constructible engineering plans at the time of building permit application or during permit review or no paving, grading, and drainage permit and no building permit shall be issued. All National Pollutant Discharge and Elimination System Best Management Practices shall be instituted on the site prior to site clearing and maintained daily. Stormwater ponds shall be roughed in at the same time the site is cleared of groundcover. 3. This Development Order shall be recorded in the Public Records of St. Lucie County, Florida, in order to provide constructive legal notice of development conditions that run with the land. 4. The developer, his successor or assigns, shall enter into an agreement with the County in a manner acceptable to the County Attorney, to pay a fee in lieu of to the County for sidewalk construction. The fee in lieu of shall be based on an engineer's estimate and approved by the County Engineer. In accordance with Section 7.05.04,(A)4.h of the St. Lucie County Land Development Code the funds delivered to the County shall be used for design and construction of sidewalks at locations as determined by the County. The funds are nonrefundable. 6. The applicant will comply with all state and federal agency regulations and requirements. Prior to approval of a Notice of Vegetation Removal, the applicant shall have obtained and provided ERD with copies of all required federal and state permits, including, but not limited to a SFWMD Water Use Permit. If federal or state agency compliance requires modification to the approved development plan, the applicant will promptly modify the plans and submit to SLC for review and approval as required by the LDC. The applicant will not use the County's development approval to prevent compliance with any federal or state agency requirements. 7. Per the FWS August 13, 2008, comment letter, vegetative clearing for this project shall be conducted outside of the scrub-jay nesting season (March 1 to June 30). 8. Prior to the approval of a Notice of Vegetation Removal, the applicant shall finalize an improvement agreement acceptable to ERD covering the cost of landscaping and tree mitigation, including proposed on-site tree relocation and planting. 9. At least twenty-four (24) hours prior to any crane activity on the proposed site the contractor shall contact the St. Lucie County International Airport Air Traffic Control Tower. 10. The proposed building design shall be required to satisfy the St. Lucie County Architectural Standards as set forth in Section 7.10.24 of the Land Development Code. 11. No Building Permit shall be issued until the developer has entered into a Proportionate Fair Share Agreement, pursuant to Section 5.07.F.2 acceptable to the Board of County Commissioners, for the construction of the transportation facilities identified therein. (Property Tax ID#:1430 343 0028 00010) The approvals and authorizations granted by this Resolution for the purpose of obtaining building permits on this property, shall expire on December 2, 2010, unless the developer has obtained building permits for the site plan described in Part A or an extension has been granted in accordance with Section 11.02.06, St. Lucie County Land Development Code. The Final Site Plan approval granted under this resolution is specifically conditioned to the requirement that the petitioner, Guadamonte Inc., including any successors in interest, shall obtain all necessary development permits and construction authorizations from the appropriate State and Federal regulatory authorities, including but not limited to; the United States Army Corps of Engineers, the Florida Department of Environmental Protection, and the South Florida Water Management District, prior to the issuance of any local building permits of authorizations to commence development activities on the property described in Part B. A copy of this resolution shall be attached to the site plan drawings described in Part A, which plan shall be placed on file with the St. Lucie County Growth Management Director. The certificate of capacity, attached as Exhibit A, shall be valid for the same period as this order. If this order expires or otherwise terminates, the certificate of capacity shall automatically terminate. A copy of this Development Order shall be mailed, return receipt requested to the developer and agent of record as identified on the site plan applications.
