A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF ST.
LUCIE COUNTY, FLORIDA, DENYING THE PETITION TO CLOSE, VACATE
AND ABANDON ANY INTEREST OF ST. LUCIE COUNTY AND THE GENERAL
PUBLIC IN A PORTION OF A 50-FOOT RIGHT-OF-WAY KNOWN AS NORTH
15TH STREET. SAID RIGHT-OF-WAY LYING IN SECTION 33, TOWNSHIP 34
SOUTH, RANGE 40 EAST, RECORDED IN PLAT BOOK 8, PAGE 36 OF THE
PUBLIC RECORDS OF ST. LUCIE COUNTY BETWEEN ROSARITA AVENUE
AND BARCELONA A VENUE.
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, has made the
following determinations:
1. That Sections 177.101, 336.09 and 336.10, Florida Statutes, as amended, and Section 11.1 0.01 et.
seq. of the St. Lucie County Land Development Code, provide that the County may adopt
resolutions vacating rights-of-way in whole or in part, which are under the jurisdiction of the
Board of County Commissioners of St. Lucie County, Florida.
2.
Pursuant to Plat Book 8, Page 36, St. Lucie County and the general public have a dedicated
interest in the following described land:
All that part of North 15th Street right-of- way as shown on the Plat of Paradise Park Addition as
recorded in Plat Book 8 at Page 36 of the Public Records of St. Lucie County, Florida. Said right of way
being more particularly described as follows:
Begin at the Southeast comer of Block 4 of Paradise Park Addition: thence North along said East
line of Block 4 (also being the West right of way line of North 15th Street) to the Northeast comer of said
Block 4; thence East along the Easterly extension of the North line of Block 4 to the Northwest comer of
Block 5 of Paradise Park Addition; thence South along the West line of said Block 5 (also being the East
right of way line of North 15th Street) to the Southwest comer of said Block 5; thence West on the
Westerly extension of the South line of Block 5 to the point of beginning. Said area contains 14,000
square feet.

3. Notice of Intent to Abandon was advertised on September 29, 2008 and October 6, 2008 and no
objections were filed.
4. All relevant public utilities have given written consent for the abandonment. St. Lucie County will
execute Utility Easements to Bell South Telecommunications, d/b/a AT&T Florida and Fort Pierce
Utilities Authority for their utilities within the abandoned portion of North 15th Street.
5. County staff members have reviewed the petition and have filed no objections to the proposed
abandonment.
6. All abutting property owners, which IS St. Lucie County, have consented and approve the
abandonment.
7. On October 21, 2008, the Board of County Commissioners approved Permission to Advertise for a
Public Hearing on December 2, 2008.
8. On November 20, 2008, a Notice of Public Hearing was advertised in the Fort Pierce Tribune and
the Port St. Lucie News.
9. It is not in the best interest of the public to vacate and abandon the right-of-way mor particularly
described as follows:
All that part of North 15th Street right-of- way as shown on the Plat of Paradise Park Addition as
recorded in Plat Book 8 at Page 36 of the Public Records of St. Lucie County, Florida. Said right of way
being more particularly described as follows:

Block 4; thence East along the Easterly extension of the North line of Block 4 to the Northwest comer of

right of way line of North 15th Street) to the Southwest comer of said Block 5; thence West on the Westerly
extension ofthe South line of Block 5 to the point of beginning. Said area containing 14,000 square feet.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St.
Lucie County, Florida:
This Board hereby denies the petition to dose, vacate and abandon of St. Lucie County and the general

public in a portion of a 50-foot right-of-way known as North 15th Street between Barcelona Avenue and
Rosarita Avenue as shown on Plat Book 8, Page 36 of the Public Records of St. Lucie County which is
legally described as:.
All that part of North 15th Street right-of- way as shown on the Plat of Paradise Park Addition as
recorded in Plat Book 8 at Page 36 of the Public Records of St. Lucie County, Florida. Said right of way
being more particularly described as follows:
Begin at the Southeast comer of Block 4 of Paradise Park Addition: thence North along said East
line of Block 4 (also being the West right of way line of North 15th Street) to the Northeast comer of said
Block 4; thence East along the Easterly extension of the North line of Block 4 to the Northwest comer of
