A RESOLUTION GRANTING AN AMENDMENT TO THE
OFFICIAL ZONING ATLAS TO CHANGE THE ZONING
FROM THE RF (RELIGIOUS FACILITY) ZONING DISTRICT
AND THE RS-3 (RESIDENTIAL, SINGLE FAMILY - 3
DU/ACRE) ZONING DISTRICT TO THE PNRD (PLANNED
NON-RESIDENTIAL DEVELOPMENT) ZONING DISTRICT
AND GRANT PRELIMINARY AND FINAL PNRD SITE PLAN
APPROVAL
WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, base~
on the testimony and evidence, including but not limited to the staff report, has made
the following determinations:
CHANGE IN ZONING
Abdul Raoof Shadani, presented a petition for a change in zoning from the
RF (Religious Facility) Zoning District and the RS-3 (Residential, Single
Family - 3 du/acre) Zoning District to the PNRD (Planned Non-Residential
Development) Zoning District for the project to be known as "Fort Pierce
Mosque," for property located on the west side of Sunrise Boulevard,
approximately 180 feet south of the intersection of Bell Avenue and Sunrise
Boulevard St. Lucie County, Florida as depicted on the attached maps as
Exhibit "A" and described in Part "A" below.
2. The Development Review Committee has reviewed the site plan for the
proposed project and found it to meet minimum technical requirements.
3. On October 16, 2008, the St. Lucie County Planning and Zoning Commission
held a public hearing on the petition of Abdul Raoof Shadani, for a change in
zoning from the RF (Religious Facility) Zoning District and the RS-3
(Residential, Single Family - 3 du/acre) Zoning District to the PNRD (Planned
Non-Residential Development) Zoning District, after publishing a notice of
such hearing in the Port St. Lucie News and Fort Pierce Tribune at least 10
days prior to the hearing and notifying by mail all property owners within 500
feet of the property boundaries, and recommended that the Board of County
Commissioners grant approval for a change in zoning for the project to be
known as "Fort Pierce Mosque," for the property described in Part "A"
below.
4. On December 2, 2008, this Board held a public hearing on the petition of
Abdul Raoof Shadani, for a change in zoning from the RF (Religious
Facility) Zoning District and the RS-3 (Residential, Single Family - 3 du/acre)

such hearing in the Port St. Lucie News and Fort Pierce Tribune at least 10
days prior to the hearing and notifying by mail all owners of property within
500 feet of the subject property at least 10 days prior to the hearing and voted
unanimously to continue the hearing on February 3, 2009.
5. On February 3, 2009, this Board held a continuation of the public hearing on the
petition of Abdul Raoof Shadani, for a change in zoning from the RF
(Religious Facility) Zoning District and the RS-3 (Residential, Single Family -
3 du/acre) Zoning District to the PNRD Zoning District. At this time a request
was made to the Board of County Commissioners to approve a continuation
of the petition to February 17, 2009 at 6:00 pm or soon thereafter. The
request was approved unanimously.
6. On February 17, 2009 this Board held a public hearing on the petition of Abdul
Raoof Shadani, for a change in zoning from the RF (Religious Facility)
Zoning District and the RS-3 (Residential, Single Family - 3 du/acre) Zoning
District to the PNRD Zoning District and voted unanimously to grant approval.
7. The proposed change in zoning is consistent with the goals, objectives, and
policies of the St. Lucie County Comprehensive Plan and has satisfied the
requirements of Section 11.06.03 of the St. Lucie County Land Development
Code.
SITE PLAN
8. Abdul Raoof Shadani, presented a petition for an amendment to the Official
Zoning Atlas to change the zoning from the RF (Religious Facility) Zoning
District and the RS-3 (Residential, Single Family - 3 du/ acre) Zoning District to
the PNRD (Planned Non-Residential Development) Zoning District and for
Preliminary/Final PNRD Site Plan approval to be known as the "Fort Pierce
Mosque." The 14,412 square feet of building will consist of a sanctuary, social
hall, library, classrooms, kitchen, and offices.
9. The Development Review Committee has reviewed the site plan for the
proposed project and found it to meet minimum technical requirements, subject
to the conditions set forth in Part "B" below.
10.On October 16, 2008, the St. Lucie County Planning and Zoning Commission

21 14. The proposed project is consistent with the general purpose, goals, objectives
22 and standards of the St. Lucie County Land Development Code, the St. Lucie
23 County Comprehensive Plan, and the Code of Ordinances of St. Lucie County.

25 15. The proposed project will not have an undue adverse effect on adjacent
26 property, the character of the neighborhood, traffic conditions, parking, utility
27 facilities or other matters affecting the public health, safety and general welfare.
28
29 16. All reasonable steps have been taken to minimize any adverse effect of the
30 proposed project on the immediate vicinity through building design, site design,
31 landscaping and screening.

33 17. The proposed project will be constructed, arranged and operated so as not to
34 interfere with the development and use of neighboring property, in accordance
35 with applicable district regulations.

37 18. The proposed project will be served by adequate public facilities and services.
38
39 19. A Certificate of Capacity was granted for this project on September 10, 2008, a
40 copy of which is attached as Exhibit "B".

B. Pursuant to Section 11.02.05(B) of the St. Lucie County Land Development Code,
the Final Planned Non-Residential Development (PNRD) Site Plan to be known as "Fort
Pierce Mosque - A Planned Non-Residential Development," be granted, and the
same is hereby approved as shown on the site plan drawings for the project prepared
by Speath Engineering dated January 9, 2008 and last revised on January 20, 2009 and

1 date stamped received by the St. Lucie County Growth Management Director on
2 January 22, 2009, subject to the following conditions

4 1. Prior to issuance of a Vegetation Removal Permit or Exemption, please provide
5 an ERP permit from South Florida Water Management District.
6
7 2. Prior to issuance of a Vegetation Removal Permit or Exemption, please submit
8 confirmation from Army Corps of Engineers confirming that the onsite wetland is
9 not jurisdictional to their agency.
10
11 3. Prior to issuance of a Vegetation Removal Permit or Exemption, a revised
12 landscape plan clarifying inconsistencies between the tabular and graphical
13 quantities shall be submitted. If these inconsistencies require additional
14 landscape or mitigation plantings, the revised landscape plan shall provide for
15 these requirements.

17 4. Prior issuance of a Vegetation Removal Permit or Exemption, the applicant shall
18 submit a typical cross section of the proposed perimeter berm and fence,
19 specifying the slope of the berm shall be no greater than 3:1.
20
21 5. Within 90 days of site plan approval or prior to approval of a Notice of Vegetation
22 Removal, whichever comes first, the applicant shall finalize an improvement
° 23 agreement acceptable to ERD covering the cost of landscaping. A copy of this
24 agreement can be obtained by visiting the SLC ERD website at:

27 6. Prior to the issuance of any permit, the petitioner, their successors or assigns
28 shall be required to submit an approval letter from the St Lucie County Fire
29 District.

31 7. Prior to the issuance of any permit, the petitioner, their successors or assigns
32 shall be required to submit an approval letter from the St Lucie County Health
33 Department.
34
35 8. Prior to the issuance of any permit, the petitioner, their successors or assigns
36 shall be required to submit an approval letter from the South Florida Water
37 Management District.
38
39 9. Prior to the issuance of Certificate of Completion the petitioner, their successors
40 or assigns shall be required to install lighting facilities in such a manner so as to
41 prevent direct glare or hazardous interFerence of any kind to adjoining streets or
42 properties.
43
44 10. Prior to the issuance of said Development Order, the Director of Growth
45 Management shall determine that all conditions of approval and applicable code
_., 46 requirements are satisfied and shall:

1 a. Obtain comments from the appropriate county staff, legal staff, and
- 2 other responsible agencies regarding the satisfaction of all
3 applicable code requirements and conditions of approval.

5 b. Confer with the County Engineer, Public Works Department,
6 Environmental Resources Department, and Utilities Department to
7 determine the number of constructible engineering plans that shall
8 be required to be submitted for review, and the applicant shall,
9 following notification by the Director of Growth Management, submit
10 the required number of plans to the Department of Growth
11 Management for processing, distribution, and final action.

13 c. Require that a complete set of sealed constructible final
14 engineering plans, supporting calculations and survey data for the
15 site work and offsite improvements are approved by the
16 Engineering Department, the Public Works Department, the Utilities
17 Department, the Environmental Resources Department, the Growth
18 Management Department, the Fire Department, and any other
19 agency that may be determined by the Director of Growth
20 Management to be necessarily involved in the review and approval
21 of the constructible final engineering plans for the site work and
22 offsite improvements. The determination of whether or not plans
23 submitted by the applicant constitute a complete set of constructible
24 plans shall be made by the departments involved in the plan review
25 within five business days of the date the plans are received in the
26 Department of Growth Management.

28 11. Within 60 days after receiving site plan approval, the petitioner, their
29 successors or assigns shall be required to convey 10 feet of right of
30 way for Sunrise Boulevard to St. Lucie County, in a manner and form
31 acceptable to the St. Lucie County Attorney. A Florida licensed
32 surveyor shall prepare a sketch and legal descriptions of the right of
33 way donation. Additional requirements associated with the right of way
34 donation shall include proof of ownership. To the extent permitted
35 under the County's Code and Compiled Laws, any such dedication
36 may be considered eligible for Road Impact Fee Credits.
37
38 12. The petitioner, their successors or assigns shall provide certain
39 improvements to roadways, including sidewalks, required to address this
40 projects impacts on the County's roadway network. The following include,
41 but are not limited to the improvements required to be provided:
42
43 a. Prior to the issuance of any Certificate of Completion, the petitioner,
44 their successors or assigns shall be required to construct a 6 foot wide
45 sidewalk along Sunrise Boulevard and Bell Avenue as shown on the
46 site plan.

1 13. Prior to the issuance of a building permit for this project, the petitioner,
> 2 their successors or assigns shall have entered into an enforceable utility
3 service agreement with the Fort Pierce Utility Authority to ensure the
4 provision of water services. This agreement shall be in a form consistent
5 with the Fort Pierce Utility Authority's regulations regarding utility service
6 extensions and service provisions.

8 14. In no event shall the sanctuary space exceed seven thousand (7,000)
9 square feet without an approved change to the Final Site Plan.
10
11 15. The certificate of completion shall be issued with the condition that there
12 shall be no call to prayer, either by normal voice or amplified sound,
13 outside of the building.

15 16. Prior to the issuance of any permit, the petitioner, their successors or
16 assigns shall be required to submit a letter stating that the petitioner, their
17 successors or assigns shall be responsible for storm-water runoff, that is
18 in excess of the minimum on-site storage requirements set by the South
19 Florida Water Management District, be transported to the Platts Creek
20 Storm-water Attenuation Area via the Sunrise Boulevard system.

22 17. Prior to the issuance of the Paving or Drainage permits, the petitioner, their
23 successors or assigns, shall submit to the St. Lucie County Engineer, who
24 shall utilize his sole discretion to review and approve their proposal for the
25 design and engineering plans to:
26 (1). Construct a drainage outFall along Sunrise Boulevard befinreen the
27 proposed Mosque and Platt's Creek detention pond, using a combination of
28 open swale and/or piped drainage; or
29 (2). Design the stormwater system for the proposed Mosque to retain 100 %
30 of a 3 day- 100 year storm event onsite, with no outFall required.

33 GENERAL PROVISIONS
34
35 C. The Final Planned Non-Residential Development (PNRD) Site Plan approval shall
36 expire on February 17, 2011, unless a building permit is issued or an extension is
37 granted in accordance with Section 11.02.06(B)(3), St. Lucie County Land Development
38 Code.
39
40 D. The Final Planned Non-Residential Development Site Plan (PNRD) approval
41 granted under this Resolution is specifically conditioned to the requirement that the
42 petitioner, Abdul Raoof Shadani, including any successors in interest, shall obtain all
43 necessary development permits and construction authorizations from the appropriate
44 State and Federal regulatory authorities, including but not limited to the United States
45 Army Corps of Engineers, the Florida Department of Environmental Protection, and the
46 South Florida Water Management District, prior to the issuance of any local building

1 permits of authorization to commence development activities on the property described
~ 2 in Part A.

4 E. A Certificate of Capacity, a copy of which is attached to this resolution as "Exhibit B"
5 was granted by the Growth Management Director on September 10, 2008, of which the
6 certificate shall remain valid for the period of the Final PNRD Site Plan approval or any
7 extension granted thereto.

9 F. A copy of this resolution shall be attached to the site plan drawings described in
10 "Exhibit C," both of which shall be placed on file with the St. Lucie County Growth
11 Management Department.

13 G. The St. Lucie County Growth Management Director is hereby authorized and
14 directed to cause the notation of this resolution to be made on the Official Zoning Map
15 of St. Lucie County, Florida, and to make notation of reference to the date of adoption of
16 this resolution.

18 H. The Director of Growth Management shall coordinate the issuance of further site
19 Development Permits. No final site construction authorizations or site Development
20 Permits shall be issued until all requirements for such permits are met.
21
22 I. A copy of this resolution shall be mailed, return receipt requested to the developer
23 and agent of record as identified on the site plan applications.
24
25 J. This resolution shall be recorded in the Public Records of St. Lucie County. The
26 recording of this resolution does not authorize the commencement of any on-site
27 development activities without obtaining such further development permits as may be
28 required. All applicable conditions of approval as set forth above, and all applicable
29 code requirements must be met to the satisfaction of the County before final site
30 construction permits are issued.

32 K. The conditions set forth in Part B are an integral, nonseverable part of the site plan
33 approval granted by this Resolution. If any condition set forth in Part B is determined to
34 be invalid or unenforceable for any reason and the developer declines to comply
35 voluntarily with that condition, the site plan approval granted by this resolution shall
36 become null and void.
