LUCIE COUNTY, FLORIDA WHEREAS, the Board of Adjustment of St. Lucie County, Fiorida, based on the testimony and evidence, including, but not limited to the staff report, has made the following determinations: Petition of Dianne B. Davant, for a variance from the Pravisions of Section 7.04.01(B) of the St. Lucie County Land Development Code to permit the construction of a 292 square foot addition to an existing single family home (porte- cochere) to encroach twenty-three (23) feet into the required fifty (50) foot front yard building setback in the AR-1, Agriculturaf Residential zoning district depicted on #he attached map as Exhibit "A". 2. On March 25, 2009, this Board held a public hearing on the petition, after publishing a notice of such hearing and notifying by mail all owners of property within 500 feet of the subject property. 3. After consideration of the testimony presented during the public hearing, including staff comments and the standards of review for granting variances set out in Section 10.01.02, St. Lucie County Land Development Code, the Board of Adjustment has made the following determination: The requested variance has met the standards of review as set forth in Section 10.01.02, St. Lucie County Land Deve%pment Code and is not in conflict with the goals, objectives, and policies of the St. tucie County Comprehensive P/an, because; 9. The variance granted is the minimum variance that will make possib/e the reasona6/e use of the land, structure, or building. 2. The variance granted will not have adverse impacts to other property or improvements in the neighborhood. 3. The variance granted meets the general spirit and intent of the St. Lucie County Land Development Code and the St. Lucie eounfy Comprehensive Plan. JOSEPH E. Dianne B. Davant presented a petition for a Variance from the Provisions of Section 7.04.01(B), of the St. Lucie County Land Development Code, to permit the construction of a 292 square foot addition to an existing single family home (porte- cochere) to encroach finrenty-three (23) feet into the required fifty (50) foot front yard building setback in the AR-1, Agricultural Residential zoning district subject to the following conditions: Within sixty (60) days of adoption of said variance, an approved building permit shall be obtained from the St. Lucie County Permitting Department for the building addition (porte cochere). B. The property on which this variance is being granted is described as foilows: Lot 29 of Wide Waters subdivision as recorded in Plat Book 17, Page 2 of the records of Saint Lucie County, FL. C. This variance shall expire twelve months from the date of adoption unless an extension is granted in accordance with Section 10.01.06, of the St. Lucie County Land Development Code.
