Ocean Drive #2, Jensen Beach, FL 34957 to St. Lucie County, a political subdivision of the State of Florida ("~rantee") having an address of 2340 Virginia Avenue, Fort Pierce, FL 34982. As used herein, the term "Grantor" shaIl include any and all heirs, successors or assigns of the Grantor, and all subsequent owners of the "Conservation Area" (as hereinafter defined) and the terrn "Grantee" shall include any successor or assignee of Grantee. WITNESSETH: WHEREAS, the Grantor is the owner of certain lands situated in St. Lucie County, Florida, and more specificalty described in Exhibit "A" attached hereto and incorporated herein by this reference ("Property"); and WHEREAS, the Grantor is proposing the expansion of a~i existing clubhouse ("ProjecY') on the Property, which is subject to the regulatory jurisdiction of tha St. Lucie County Board of County Commissioners ("Count~'); and WHEREAS, the Property will be further su6ject to the Declaration of Covenants, Conditions and Restrictions of Island Dunes Country Club to be recorded in the Official Public Records of St. Lucie County, Flarida ("Declaration"}; and Wf3EREAS, the County approved the Major Site Plan for the Praject pursuant to Resolution No GM-08-008 {"Resolution"}; and WHEREAS, the Resolutivn requires t;hat Island Dunes Country Club ("Assoeiation") maintain, in perpetuity, that portion of the Property designated as preserve area ("Conservation Area") as more particularly described in Bxhibit "B" attached hereto and incorporated herein by this reference; and WHEREAS, the Declaration provides that the maintenance of the Conservation Area is the perpetual obligation of the Association; and WHEREAS, the Resolution further requires that the Canservation Area be maintained in accordance with that certain Preserve Area Management and Monitoring Plan, as modified from time to time ("Management Plan"~; and WHEREAS, the Grantor is agreeable to granting and securing to the Grantee a perpetual Conservation Easement as defined in Section 704.06, Florida Statutes, over the Conservation Area. NOW, THEREPORE, Grantor hereby grants, creates, and establishes a perpetual Conservation Easement for and in favor of the Grantee upon the Conservation Area which shall JOSEPH E. The scope, nature, and character of this Conservation Easement shall be as follows: 1, Recitals. The recitals hereinabove set forth are true and correct and are hereby incorparated into and rnade a part of this Conservation Easement. 2. Pu, rpose. It is the purpose of this Conservation Easement to retain land or water areas in their natural, vegetative, hydrologic, scenic, open, agricultural or wooded condition and to retain such areas as suitable habitat for fish, plants or wildIife. Those wetland and/or upland areas included in this Conservation Easement shal~ be maintained in the conditions required by the Managament Plan. To carry out this purpose, the following rights are conveyed to Grantee by this easament: a. Ta enter upon the Conservation Area at reasonable times with any necessary equipment or vehicles to enforce the 'rights herein granted in a manner that will not unreasonably interfere with the use and quiet enjoyment of the Property by Grantor and/or the hzture residents of the Property at the time of such entry; and b. To enjoin any activity on or use of the Conservation Area that is inconsistent with this Conservation Easement and to enforce the restoration of such areas or features of the Conservation Area that may be damaged by any inconsistent activity or use; and c. To enter upon the property of the Grantar to connect the Conservation Area to a bona fide system of trails, greenways or other non-vehicular system. 3. Prohibited Uses. Except for exotic vegetation removal, zeplanting with appropriate native vegetation, vine control, trimming the vegetation along the dune crossovers and the western mulch walking path, removal of trash and debris or other maintenance and monitoring activities described herein that are permitted or required by the Resolution or the Management Plan, the following activities are prohibited in or on the Conservation Area: a. Construction or placing of buildings, roads, signs, billboards or other advertising, utilities, or other structures on or above the ~,~round; b. Dumping or piacing of soil or other substance or material as landfill, or dumping or placing of trash, waste, or unsightly or offensive materials; c. Removal or destruction of trees, shrubs, or other vegetation, except fnr the removal of exotic or nuisance vegetation in accordance with the Management Plan and trimming of mangrave vegetation in accordance with the Mangrove Trimming and Preservation Act (Florida Statutes, Sections 403.932]-403.9333). d, Excavation, dredging, or removal of loam, peat, gravel, soil, rock, or other material substance in such manner as to affect ihe surface; WPB 387,741,367v712/12/2d07 2 OR BOOK 3009 PAGE 2117 e. Surface use except for purposes that permit the land or water area ta remain in its natural or enhanced condition; £ Activities detrimental to drainage, flood control, water conservation, erosion control, soil conservation, or fish and wildlife habitat preservation including, but not limited to, ditching, diking and fencing. 4. Grantor's Reserved Rights. Grantor reserves all rights as owner of the Property, including the right to engage in uses of the Conservation Area that are not prohibited herein and which are not inconsistent with any County rule, criteria, permit and the intent and purposes of this Conservation Easement. 5. No Dedication. No right of access by the general public to any portion of the Property or the Conservation Area is conveyed by this Conservation Easement. 6. Grantee's Liability. Grantee shall not be responsible for any costs or liabilities related to the operation, upkeep or maintenance of the Conservation Area. 7. Acts Bevond Grautor's Control. Nothing contained in this instrument shall be construed to entitle Grantee to bring any action against Grantor for any injury to or change in any portion of the Property other than Conservation Areas that result from natural causes beyond Grantor's col~trol, and not initiated by the Grantor, including but not limited to fire, flood, storm and earth movement. Should any Conservation Area be injured or changed from natural causes, including but not limited to fire, flood, storm and earth movement, the Grantor shall be provided notice and a reasonable opportunity to restore the affected Conservation Area to a condition that satisfies t1~e Management Plan requirements prior to the Grantee bringing any action for noncompliance with the Resolution or the Management Plan. 8. Property Taxes. Grantor shall keep the payment of taaces and assessments on the Conservation Area current and shall not allow any lien on the Conservation Area superior to this Easement. In the event Grantor fails to extinguish or obtain a subordination of such lien, in addition to any other remedy, the Grantee may, but shall not be obligated to, elect to pay the lien on behalf of the Grantor and Grantor shall reimburse Grantee for the amount paid by the Grantee, together with Grantee's reasonable attorney's fees and costs, with interest at the maximurn rate allowed by law, no later than thirty days after such payment. Tn the event the Grantor does nat so reimburse the Grantee, the debt owed to Grantee shall constitute a lien against the Conservation Area which shall automatically relate back to tha recording date of this Easement. Grantee may foreclose this lien on the Conservation Area in the manner provided for mortgages on real property. 9. Enforcemeut bv Grantee. Enforcement of the terms, provisions and restrictians of this Conservation Easement shall be at the reasonable discretion of Grantee, and any forbearance on behalf of Grantee to exercise its rights hereunder in the event of any breach hereof by Grantor or Che Association, shall not be deemed or construed to be a waiver of Grantee's rights hereunder. The Association shall take private enforcement action against any member of the Association who violates the rules relating to the use and maintenance of the Conservation Area as set forth in the Management Pian. 11. Maintenance ObliQations af Association. The Association shall maintain in perpetuity, the Conservation Area in accordance with the Management Plan. Such maintenance shall include, but is not limited to, exotic vegetation removal, replanting with appropriate native vegetation, vine control, and removal of trash and debris. The maintenance schedule should be so as to keep the Conservation Area ecologically functional and high quality, as well as a minirnum 90% free of exotic vegetation. 12. Assi~nment. Grantee will hold this Conservation Easement exclusively for conservatian purposes. Grantee will not assign its rights and obligations under this Conservation Easement except to another organizatian or entity qualified to hold such interests under the applicable state laws. 13. Severability. If any provision of this Canservation Easement or the application thereof to any person or circumstances is found to be invalid, the rernainder of the provisians of this Co7lservation Easernent shall not be affected thereby, as long as the purpose of the Conservation Basement is preserved. 14. Terms and Restrictions. Grantor shall insert the terms and restrictions of this Conservation Easement in any subsequent deed or other legal instnzment by which Grantor divests itself of any interest in the Property. 15. Written Notice. All notices, consents, approvals or other cammunications hereunder shall be in writing and shall be deemed properly given if sent by United States certified mail, return receipt requested, addressed to the apprapriate party or successor-in-interest. 16. Modifications. This Conservation Easement may be amended, altered, released or revoked only by written agreement between the parties hereto or their heirs, assigns or successors-in-interest, which shall be filed in the public records in St. Lucie County. TO HAVE AND TO HOLD unto Grantee forever. The covenants, tenns, conditions, restrictions and putposes iinposed with this Conservation Easement shall be binding upon Grantor, and shall continue as a servitude nuuiing in perpetuity with the Property. Grantor hereby covenants with said Grantee that Grantor is lawfu.lly seized of said Property in fee simple; that the Property is free and elear of all encumbrances that are inconsistent with the terms of this Conservation Easement; and a11 mortgages and liens have been subordinated to this Conservation Easement; and that Grantor has good right and lawful authority to convey this Conservation Easement; and that it hereby fully warrants and defends the title to the Conservation Easement hereby conveyed against the lawful claims of a11 persons whomsoever. INTRODUCTION The intent of the Preserve Area Management Plan (PAMP) is ta provide an outline of methods to provide the long-term protection and maintenance of the values and functions of the preserve area, as required by Chapter 6 of the St. Lucie County Land Developmenk Code. A detailed description of the preserve area's natural history, including its vegetative condition prior to development, will be included in the report. 4biectives A. To preserve the existing wetland ecosystem inctuding canopy, understory, and groundcover. B. F,nhance the viability of the preserve through the removal and control of invasive exotic piant species and the installation of appropriate native buffering plants. C. Prevent the activities of construction equipment, vehicular traffic, recreational or other potential(y destructive uses within the preserve area. D. Sustain areas of viable habitat for regional flora and fauna through the implementation of regular maintenance and monitoring programs. II. SITE DESCRIPTION The project site is located on the west side of AIA, about 3.5 miles south of the Florida Power and l.ight Nuclear Plant and 1/3 of a mile north of the entrance to Nettles lsland, Section 34, Township 36S, Range 4IE, St. Lucie County. The project area is bound to the north by Las Tortugas subdivision, to the south by the Island Dunes Country Club go{f course, to the east by A 1 A, and to the west by the Indiar~ River Lagoon. The site is home to an existing ciubhouse with associated facilities (parking, loading zones, pool, bathrooms, etc.) and a smali mangrove wetland community just to the west of the clubhouse. The preserve area is comprised of 0.07 acres of mangrove wetland and 0.09 acres of wetland buffer on the east side. The material required to plant the wetland buffer on the west side of the wetland has been donated to St. Lucie County in lieu of installation due to conflicts with the existing golf green located adjacent to the wetland. The wetland consists of primarily red mangroves with a few black mangroves along the fringes. Q\I501.1\LDS Environmentdl\SLC ERD\1501.1 Island Dunes PAMP.Jw OR BOOK 3009 PAGE 2128 A. SOILS The project site contains the following soil types (see Exhibit 3, Soil Survey af Saint Lucie County, FL 1480.): 1. 35 Pomnano-Kali~a Varient Association: This association consists of very pooriy drained soits in tidal mangrove swamps in the Indian River. The water table is at or above the surface for most years, flooding during most high tides and storm periods. 2. 10- Canaveral fine sand: This moderately well drained to somewhat poorly drained, nearly leve! to gently sloping soil is on low dunelike cidges and side slopes that border depressional areas and sloughs near the coast. The water table is between depths of 10 to 40 inches for 2 to 6 months or more and is within a depth of 60 inches for most of the rest of the year. B. VEGETATIVE COMMUNITIES The subject arel is predominantly an isalated mangrove swamp community. The dominant tree canopy is red mangrove. The native understory includes a small amount of sea oxeye (see Eachibit 4, Aerial Photograph). CONSTRUCTION PHASE A. PItOTECTION The preserve will have a protective barricade placed around the perimeter, located at a minimum, twice the dripline of any native tree. The fencing material shall consist of material sueh as orange construction fence. The fence will be properly installed prior to the final inspection of St. Lucie County Environmental Resources Department (ERD} staff. In order to control erosion drifting into the preserve during the development activities, a silt fence may be installed around the perimeters for controL This requirement will be determined prior to the final inspection. Prohibited activities inside and adjacent to the preserve during the constniction phase of the project include but not limited to the storage, temporary or permanent placement of equipment, vehic(es, and construetion materials within the preserve boundaries or twice tha dripline of existing native trees to be preserved. B. SUPPLEMENTAL PLANTINGS As part of site plan approval, the wetland buffer in between the ctubhouse expansion and the wetland will be planted with appropriate supplemental vegetation. MAINTENANCE AND MONITORING A. PROHIBITED ACTIVITIES All activities not associated with good environmental practice for the perpetual maintenance of the preserve area will be prohibited. Prohibited activities may include but are not limited to: mowing, sodding, trimming, man-made structures, play equipment, permanent irrigation, dumping, grubbing, man-made runoff or the creation of point source discharge into the preserve area or other alteration wiU not occur within the boundaries of the preserve area. Post-development runoff shall not exceed pre-development runoff and point source discharge shall be prohibited into the preserve. Passive recreational activities including nature waiks, bird and witdlife watching and photography are allowed within the boundaries of the preserve. Any activity which may possibiy impact the integrity and contimied viability of the preserve is prohibited. B. MONITORING The preserve area will be monitored quarterly in perpetuity. Monitoring shall include, but not limited to: rernoval of trash and debris, identifcation of prohibited activities, identif'tcation and eradication of invasive non-native species, ensure compliance with the standards for survivorship of the supplemental planting as specified in the approved PAMP. Failure to comply with these guidelines will be considered a violation of the permit and approved PAMP. Further work on the project may be stopped until compliance with the guidelines af the approved PAMP. V. ExOTIC PLANT SPECIES CONTROL All exotic and nuisance plant species, including but not limited to the most current F~PPC Category I Plant List (target species) shall be removed and eradicated from the preserve. The process of exotic target species vegetation removal will include the fol4owing activities: All chemicals shall be handled and applied by a Florida Licensed Applicator. The following is the proposed methodology to remove and eradicate the exotic vegetation: • cut larger, woody exotic plant species to a stump near tlush with existing ground level with hand tools (chain saw, machete). • remove large trunks and limbs by hand (or gabled to equipment) to be pul(ed out of the preserve avoiding damage/impacts to existing native plant species. • treat the stumps of the removed exotic plants with the appropriate herbicide (Garlon 4~, Rodeo ~}. • cut exotic and nuisance vines at the base of the tree, palm, or shrub. • leave the vine in the tree canopy so as not to damage tree by pulling on the vine to remove. . treat the base of the vine, rhizome, or root mat with the appropriate herbicide. • remove all debris fro-n fhe upland preserve to be chipped and hauled off site for proper disposal. . perform a faltow-up treahnent of any resprouting or newly seeded exotic and nuisance plant species as needed. The preserve area wiil be reviewed and monitored quarterly in perpeh~ity to ensure eompliance for the permanent eradication of invasive non-native vegetation as listed in the most current FEPPC Categocy I Plant List {target species). CONCLUSION The 0.07 acre wetland coupled with the ~.09 acre wetland buffer combine for a total 0.16 acres of preserved habitat for this project. Identified as an important community in the Florida ecosystem, the prese-vation of the existing mangrove swamp and enhancement of its buffer will provede habitat and food sources far a variety of amphibious and avian species. , Affidavit of Responsibility -Lsland Dunes Country Club Property Owners Associatian is the party responsible far the compliance during the developmental phase of the site. The long term/perpetuity resp~nsibility of complying with the standards set forth in the Preserve Area Management Plan shall be with the Island Dunes Country Club Propcrty Owners Association. The preserve shall remain free of all invasive and non-native plant species and no prohibited activities as outlined in this PAMP shall occur within the preserve. The preserve area will be monitored throughout the clearing, tree/vegetation relocation, and construction processes by a knawledgeable environmental professionaL Upon attaivment of the Certificate of (Jccupancy, quarterly inspections will be performed in perpetuity.
