AN ORDER GRANTING APPROVAL TO A SCRIVENER'S ERROR TO
GM-06-030 WHICH GRANTED MINOR SITE PLAN APPROVAL FOR
THE PROJECT KNOWN AS SEMINOLE ACRES S/D IN ST. LUCIE
COUNTY, FLORIDA.
WHEREAS, the St. Lucie County Growth Management Director has reviewed the application for
site plan approval submitted by LaVenture & Associates, Inc. and reviewed the comments of the
St. Lucie County Development Review Committee on this application, and made the following
determinations:
1. On November 8, 2006 the Growth Management Director granted approval of Growth
Management Order 06-030.
2. Following the recordation of Growth Management Order 06-030, staff determined that
the incorrect Growth Management Order number was assigned and recorded.
3. Seminole Acres S/D is a proposed 7 lot subdivision for property located on the east side
of Seminole Road, approximately 1 mile of Immokolee Road in the AG-1 (Agricultural -1
du/acre) Zoning District.
4. The Development Review Committee reviewed the site plan for the proposed project and
found it to meet technical requirements of the Land Development Code and to be
consistent with the St. Lucie County Comprehensive Plan.
5. The proposed project is consistent with the general purpose, goals, objectives, and
standards of the St. Lucie County Land Development Code, the St. Lucie County
Comprehensive Plan and the Code of Ordinances of St. Lucie County.
6. The proposed project will not have an undue adverse effect on adjacent property, the
' character of the neighborhood, traffic conditions, parking, utility facilities, or other matters
affecting the public health, safety, and general welfare.
7. All reasonable steps have been taken to minimize any adverse effect of the proposed
project on the immediate vicinity through building design, site design, landscaping, and
screening.
8. The project will be constructed, arranged, and operated so as not to interfere with the
development and use of neighboring property, in accordance with applicable district
regulations.
9. The project will be served by adequate public facilities and services.

NOW, THEREFORE, BE IT ORDERED:
A. Pursuant to Section 11.02.03 (D) of the St. Lucie County Land Development Code,
the proposed Minor Site Plan for the project to be known as Seminole Acres S/D, is
hereby approved as shown on the site plan drawings for the project prepared by
Engineering Design & Construction, Inc., dated, December 5, 2005 and received by
the St. Lucie County Growth Management Director on December 13, 2005, on the
property described below, subject to the following conditions:
1. As part of the future plat of the proposed subdivision, the petitioner, his
successors or assigns, shall convey to St. Lucie County, the west 10 feet of the
subject property for additional right-of-way for Seminole Road.
2. Prior to the recordation of the final plat of Seminole Acres Subdivision, the
developer, his successors or assigns, shall submit fees in the amount of
$131,864.00 for the fair share contribution towards paving Seminole Road. Said
funds shall be held by St. Lucie County for a period not to exceed ten (10) years
to be used for the paving of Seminole Road. Any funds not expanded or
encumbered by the end of the calendar quarter immediately following ten years
from the date the funds were submitted to the County shall, upon application of
the fee payer, be returned with interest to be determined based upon the average
rate of return to St. Lucie County for the time period the funds were held.
3. This Development Order shall be recorded in the Public Records of St. Lucie
County, Florida. This Development Order shall be recorded in order to provide
constructive legal notice of development conditions that run with the land.
4. The County Engineer shall receive a copy of this Development Order and the site
plan it approves and shall not approve constructible engineering plans or cost
estimates that do not implement or are not consistent with this Development
Order and the plans hereby approved.
B. The property on which this minor site plan is being approved is described as follows:

EXCEPT THE WEST 60.00 FEET THEREOF.
SAID LAND CONTAINS 39.81 ACRES, MORE OR LESS.

C. The approvals granted by this administrative order shall expire on November 8, 2008,
unless a building permit is issued or an extension is granted in accordance with the
provisions of Section 11.02.06 of the St. Lucie County Land Development Code.
D. The Final Site Plan approval granted under this Resolution is specifically conditioned to

the requirement that the petitioner, Jeff Hardwick, including any successors in interest,
shall obtain all necessary development permits and construction authorizations from the
appropriate State and Federal regulatory authorities including, but not limited to; the
United States Army Corps of Engineers, the Florida Department of Environmental
Protection, and the South Florida Water Management District, prior to the issuance of
any local building permits of authorizations to commence development activities on the
property described in Part B.
E. A copy of this Order shall be attached to the site plan drawings described in Part A,
which plan shall be placed on file with the St. Lucie County Growth Management Director
and mailed, return receipt requested to the developer and agent of record as identified
on the site plan applications.
F. The Certificate of Capacity, attached as Exhibit A, shall be valid for the same period as
this order. If this order expires or otherwise terminates, the Certificate of Capacity shall
automatically terminate.
G. This order shall be recorded in the Public Records of St. Lucie County.
ORDER effective the 8th day of November, 2006.
