SMITH, CLERK OF THE CIRCUIT COURT SAINT LUCIE COUNTY FILE # 336268907/01/2009 at 09:26 AM OR BOOK 3104 PAGE 779 - 781 Doc Type: RESO RECORDING: $27.00 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 RESOLUTION NO. 04-229 FILE NO.: MJSP-04-009 A RESOLUTION GRANTING APPROVAL TO A MAJOR SITE PLAN PROJECT TO BE KNOWN AS SILVER OAKS TOWNHOMES WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on the testimony and evidence, including but not limited to the staff report, has made the following determinations: Lennar Communities, presented a petition for a Major Site Plan Project, to be known as Silver Oaks Townhomes, to provide for the construction of a 154 unit multiple-family residential project, on a parcel of land located east of U.S. #1, at the southwest corner of Tilton Road and Shana's Trail and adjacent to the proposed alignment of Lennard Road, in the RM-5 (Residential, Multiple Family - 5 du/acre) for the property described in Section B. 1. The Development Review Committee has reviewed the site plan for the proposed project and found it to meet all technical requirements and to be consistent with the future land use maps of the St. Lucie County Comprehensive Plan, subject to the conditions set forth in Part A of this Resolution. 2. The proposed project is consistent with the general purpose, goals, objectives and standards of the St. Lucie County Land Development Code, the St. Lucie County Comprehensive Plan and the Code of Ordinances of St. Lucie County. 3. The proposed project will not have an undue adverse effect on adjacent property, the character of the neighborhood, traffic conditions, parking, utility facilities, or other matters affecting the public health, safety, and general welfare. 4. All reasonable steps have been taken to minimize any adverse effect of the proposed project on the immediate vicinity through building design, site design, landscaping and screening. 5. The proposed project will be constructed, arranged and operated so as not to interfere with the development and use of neighboring property, in accordance with applicable district regulations. 6. The proposed project will be served water and sewer services by the Port St. Lucie Utilities. 7. A Certificate of Capacity, a copy of which is attached to this resolution, was granted by the Growth Management Director on December 21,2004. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St. Lucie County, Florida: A. Pursuant to Section 11.02.05 of the St. Lucie County Land Development Code, the Major Site Plan to be known as Silver Oaks Townhomes, is hereby approved as depicted on the site plan drawings for the project prepared by Thomas Lucido & Associates P.A., dated 5/04/04, last revised on 8/17/04, and date stamped received by the St. Lucie County Growth Management Director on 8/23/04, for the property described in Section B, subject to the following conditions. Prior to issuance of a building permit for any lot in the project, the developer, or his assigns, shall 4 be required to improve Tilton Road to County standards including construction of right and left turn 5 lanes at the project entrance. 6 7 2. Prior to issuance of a building permit for any lot in the project, the applicant or his assigns shall 8 provide a conservation easement in favor of St, Lucie County for the preserve areas. The 9 conservation easement shall be a form acceptable to the St. Lucie County Attorney. 10 11 3. Prior to issuance of a building permit for any lot in the project, the applicant or his assigns shall 12 provide a monitoring and management plan for the preserve areas within the project. 13 14 4. Prior to issuance of a building permit for any lot in the project, the developer, or his assigns, shall 15 submit a letter from the St. Lucie County School Board indicating that they have satisfied the St. 16 Lucie County School Board. 17 18 5. The developer shall as part of the construction of this development provide for the construction of a 19 weather shelter, or other similar structure at the main project entrance with SR A-1-A for the 20 purpose of providing for a central pick-up and drop off location for any school bus stops/demand 21 response transit or other like transit activity that may be caused by the development of this property. 22 23 6. At all gated controlled access points, the developers shall be reasonable to ensure that all required 24 emergency override devices are provided to the satisfaction of the St. Lucie County Sheriff's 25 Department and the St. Lucie County Fire District. 26 27 28 B. The property on which this Major Site Plan is being granted is described as follows: 29 30 Tracts 1 through 16, both inclusive, of block 4, St. Lucie Gardens, Section 23, Township 36 South, 31 Range 40 East, according tothe plat thereof, recorded in plat book 1 pages 35 and 36, of the public 32 records of St. Lucie County, Florida; less County road and drainage easements along the north and 33 west boundaries thereof, less easements on plat along the east and south boundaries. 34 35 (Location: east of U.S. #1, on the south side of Tilton Road and west of the proposed alignment of 36 Lennard Road) 37 38 C. This Major Site Plan shall expire on December 21, 2006, unless a building permit is issued or an 39 extension is granted in accordance with Section 11.02.06(B)(3), St. Lucie County Development 40 Code. 41 42 D. The Major Site Plan granted under this Resolution is specifically conditioned to the requirement 43 that the petitioner, Lennar Communities, including any successors in interest, shall obtain all 44 necessary development permits and construction authorizations from the appropriate State and 45 Federal regulatory authorities, including but not limited to: the United States Army Corp of 46 Engineers, the Florida Department of Environmental Protection, and the South Florida Water 47 Management District, prior to the issuance of any local building permits or authorizations to 48 commence development activities on the property described in Part B. 49 50 E. A certificate of Capacity, a copy of which is attached to this resolution, was granted by the Growth 51 Management Director on December 21 , 2004, which certificate shall remain valid for the period of File No: MJSP-04-009 December 21, 2004 Resolution No. 04-229 Page 2 """ Site Plan approval.
