4 A RESOLUTION GRANTING A MAJOR ADJUSTMENT TO THE
5 C.A.T. RECYCLING YARD SITE PLAN FOR A PROJECT TO BE
6 KNOWN AS WCA OF ST. LUCIE RECYCLING YARD
7
8 WHEREAS, the Board of County Commissioners of St. Lucie County, Florida, based on
9 the testimony and evidence, including but not limited to the staff report, has made the
10 following determinations:
11
12 1. WCA of St. Lucie, LLC presented a petition for a Major Adjustment to a Site
13 Plan Project known as C.A.T. Recycling Yard, to modify the fencing and
14 landscaping and change the name of the project to WCA of St. Lucie
15 Recycling Yard for property located at 9901 Range Line Road, in the IH
16 (Industrial, Heavy) Zoning District for the property as described below in
17 Section B.

19 2. On January 16, 1996, through Resolution No. 95-232, the St. Lucie County
20 Board of County Commissioners granted a Conditional Use Permit for the
21 ~ C.A.T. Roll-Off Service & Recycling Yard for the operation of a recycling
22 facility in the IH (Industrial, Heavy) Zoning District.
23
24 3. On July 1, 1996, through Community Development Order CD-96-008, the St.
25 Lucie County Community Development Director approved site plan drawings
26 forthe petition property prepared by Lindahl, Browning, Ferrari, & Hellstrom,
27 Inc. on June 28, 1996 and date stamped by the Community Development
28 Director on July 1, 1996.

30 4. On August 7, 2007, through Resolution No. 07-043, this Board approved the
31 petition of S.P. Recycling Corp. for a Major Adjustment to an Approved
32 Conditional Use Permit to allow for the operation of a recycling transfer
33 station on property owned by WCA of St. Lucie, LLC.
34
35 5. On May 20, 2008, through Resolution No. 08-147, this Board approved the
36 petition of Keys Wi-Fi Inc. granting Site Plan approval, with conditions, forthe
37 project to be known as "South Florida Recycle Communication Tower", a 195
38 foot high communication tower to be located on 0.23 acres of the subject
39 property.

1 6. The Development Review Committee has reviewed the site plan for the
2 proposed project and found it to meet all technical requirements and to be
3 consistent with the future land use maps of the St. Lucie County
4 Comprehensive Plan, subject to the conditions set forth in Part A of this
5 Resolution.

7 7. The proposed project is consistent with the general purpose, goals,
8 objectives and standards of the St. Lucie County Land Development Code,
9 the St. Lucie County Comprehensive Plan and the Code of Ordinances of St.
10 Lucie County.

12 8. The proposed project will not have an undue adverse effect on adjacent
13 property, the character of the neighborhood, traffic conditions, parking, utility
14 facilities, or other matters affecting the public health, safety and general
15 welfare.

17 9. All reasonable steps have been taken to minimize any adverse effect of the
18 proposed project on the immediate vicinity through building design, site
19 design, landscaping and screening.
20
21 10. The proposed project will be constructed, arranged and operated so as not to
22 interfere with the development and use of neighboring property, in
23 accordance with applicable district regulations.

25 NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of St.
26 Lucie County, Florida:
27
28 A. Pursuant to Section 11.02.04 of the St. Lucie County Land Development Code, the
29 Site Plan to be known as WCA of St. Lucie, LLC as depicted on the site plan
30 drawings for the project prepared by HSA Golden Environmental and Engineering
31 Consultants, dated November 2008, last revised in April 2009, and date stamped
32 received by the St. Lucie County Growth Management Director on June 5, 2009, is
33 hereby approved for the property described in Section B, subject to the following
34 conditions.

36 1. All previous terms and conditions as contained in GM Order No. 96-008,
37 and Resolution No. 08-147 are consolidated or modified as contained
38 herein. The property owner shall comply with all previous established
39 conditions of approval and deadlines, unless expressly modified herein.

41 2. All recycling operations on the property shall be consistent with the terms
42 and conditions set forth in the Condition Use Permit approval granted

1 through Resolution No. 09-068, as may be amended consistent with the
2 Land Development Code.

4 3. Within 90 days of the date of this approval, the developers shall be
5 required to convey to St. Lucie County, in a manner and form acceptable
6 to the St. Lucie County Attorney, 10 feet of additional right-of-way along
7 the site plan's property line for the future widening of Range Line Road. A
8 Florida licensed surveyor shall prepare a sketch and legal descriptions of
9 the right of way donation. Additional requirements associated with the
10 right of way donation shall include proof of ownership. To the extent
11 permitted under the County's Code and Compiled Laws, any such
12 dedication may be considered eligible for Road Impact Fee Credits. Said
13 dedication shall be by general warranty deed, free and clear of all liens
14 and encumbrances.

16 4. Priorto issuance of zoning compliance the applicant shall make payment
17 to St. Lucie County in the amount of $13,068 for a fee in lieu of
18 construction of a twelve (12) foot multiuse path along Range Line Road.
19
20 5. Prior to issuance of a Vegetation Removal Permit or Exemption, the
21 applicant shall execute an improvement agreement, acceptable to SLC,
22 covering the cost of all required landscaping, irrigation, and related
23 improvements as shown in the Site Plan. A copy of this agreement can
24 be obtained by visiting the SLC ERD website at:
25 http://www.stlucieco.orq/erd/index.htm.

27 6. Perimeter fencing and screening shall be installed around the entire
28 project site as shown on the site plan and shall be maintained in good
29 condition over the life of the project. The applicant, successors or assigns
30 shall submit a compliance monitoring report to the Growth Management
31 Director bi-annually to demonstrate compliance with the screening
32 requirements set forth in LDC Section 7.10.12(3) and the approved site
33 plan. The report shall include pictures from all sides of the property
34 showing the condition of the fencing, screening and landscape materials.
35 All fencing and screening shall remain installed and in good condition.
36 Any screening material not securely tied to the fence, or that is torn, shall
37 be replaced within 30 days. The requirement for the monitoring report
38 shall begin within 12 months following issuance of a Certificate of Zoning
39 Compliance and bi-annually (every 2 years) thereafter.

22 C. The approvals and authorizations granted by this Resolution are for the purpose of
23 obtaining a zoning compliance or building permits on this property, shall expire on
24 June 16, 2011, unless the developer has obtained a zoning compliance or building
25 permit for the site plan described in Part A or an extension has been granted in
26 accordance with Section 11.02.06, St. Lucie County Land Development Code.

28 D. The Site Plan approval granted under this Resolution is specifically conditioned to
29 the requirement that the petitioner, WCA of St. Lucie, LLC, including any
30 successors in interest, shall obtain all necessary development permits and
31 construction authorizations from the appropriate State and Federal regulatory
32 authorities, including but not limited to: the United States Army Corps of Engineers,
33 the Florida Department of Environmental Protection, and the South Florida Water
34 Management District, prior to the issuance of any local building permits of
35 authorizations to commence development activities on the property described in
36 Part B.

38 E. A Certificate of Capacity was granted by the Community Development Director on
39 July 15, 1996, which certificate shall remain valid for the period of Site Plan
40 approval. The certificate of capacity shall be valid forthe same period as this order.
41 If this order expires or otherwise terminates, the certificate of capacity shall
42 automatically terminate.

F. A copy of this resolution shall be attached to the site plan drawings described in
Section A, which plan shall be placed on file with the St. Lucie County Growth
Management Director.
G. The St. Lucie County Growth Management Director is hereby authorized and
directed to cause the notation of this resolution to be made on the Official Zoning
Map of St. Lucie County, Florida, and to make notation of reference to the date of i
adoption of this resolution.
H. The Growth Management Director shall coordinate the issuance of further site
Development Permits. No final site construction authorizations or site Development
Permits shall be issued until all requirements for such permits are met.
A copy of this resolution shall be mailed, return receipt requested to the developer
and agent of record. This resolution shall be recorded in the Public Records of St.
Lucie County. The recording of this resolution does not authorize the
commencement of any on-site development activities without obtaining such further
development permits as may be required. All applicable conditions of approval as
set forth above, and all applicable code requirements must be met to satisfaction of
the County before final site construction permits are issued.
